      Generally yes, and it is recommended to refuse for multiple reasons, including possible charges they could try to stick to anything...planted evidence, and they aren't liable for damage caused by the search....but if they have a warrant, probable cause to arrest (can search or "inventory" an inpinded vehicle) or if there is probable cause a life is in immediate danger

      Watch the series if you haven't yet. To put it simply the officer asking to search is named Nolan. He(the character not the actor) started off ok but ended up being more of a nuisance/asshole in the end. The series name is "The Rookie."

      I am not black so it is not the same experience for me at ALL so I cannot compare, but even for me cops are terrifying. I was walking to work at night (I can't drive) and I had bright red hair and two cops stopped me on my way to work saying I look suspicious and 'fit the description" I had thick, curly RED HAIR with bangs and a flower decoration in my hair. I didn't look like ANYONE dude. I dressed super unique! They asked for my identification and proof, I luckily had my cvs uniform in my bag. It was SO crazy and such a lie. I was like shaking. Going to work after that sucked and I was late bc of them. :/

    She did actually break the law, unless the guns were given to her, or they were in her possession already...she stole the guns from her ex-husband. It's fucked up, but you can't take something that isn't yours without consent of the owner. If her ex was threatening to kill her with knives, she couldn't just go into his house and take his knives from him to turn into the police.

      You do realize it’s still breaking and entering if you use a old key? She doesn’t have permission to be there so it’s still a crime. She just admitted to 3 crimes, like yes he’s the antagonist but he correctly did what was required. She didn’t even want to mention her taking the guns to the police station at first so they would even rise a neutral cop.

      Breaking and entering, violating a restraining order, stolen property, stolen firearms. Even if she didn't consent to the search she would have been arrested for the same crimes. She could have filed a GVRO, which the investigation or weather or not its needed is done AFTER they take the guns, and if it was proved to be true his guns would be gone forever and never given back. She is in the wrong, the cop also asked if she consented so that was up to her...

      @danielbrandstetter8713 incorrect because if you are turning in guns they will do background checks to see if those guns actually belong to you or if you have a license to please able to own a gun. All guns have a serial number. They would run it. Figure out they are not hers, ask her why she is trying to turn in guns that aren't hers, and seeing as her intentions were to try and get her ex husband arrested for allegedly threatening her she would probably waste no time telling them.... and on top of all of this. Just because your crime isn't found out does NOT mean your in the right XD, she would still be in the wrong. She was overly nervous for no reason all the cop initially did was just your run of the mill stop. It gave him a suspicion, and In this case he was correct. That intuition may not always be correct and she has the right to deny the search. But the cop did not search without consent was respectful and she violated multiple laws and a couple of which were felonies, she was not in the right.

      ​@@gamingwithjd2244 & That's alone is enough for officers to check on him & the status of his firearms. If she had proof he is threatening to kill her, she shows it to the police. They get a warrant for her ex husband, & they take possession of the firearms. Especially if he has a history of abusing her. It would be illegal for him to own them anyways, depending on if their divorce resulted in any Domestic Abuse charges. He is threatening her life, she can stay low & inform the police. That's the best thing to do. NOT go to his residence & commit multiple felonies. (Each stolen firearm is another charge) not to mention breaking & entering or at the very least trespassing. (Petty crimes, but still prosecutable.)
      Usually, commiting multiple felonies isn't the proper way to protect yourself.

      Honestly even if they never pulled her over they would have arrested her at the station when she said where she got the guns. If someone threatens you with a gun, you aren't allowed to break into their house and preemptively steal the gun and then "turn it in" to the police.

    I watched this show, it’s called Rookie and it’s on Disney plus. The officer that is saying that she was stealing, is racist. A couple episodes later, when the black officer (not trying to be racist) was getting jumped by people and his partner was just there watching him getting jumped, but the police checked his camera and caught him

    From the cops perspective they have no way of knowing whether the husband threatened you or not, but you did just confess to burglary, theft of property . . . at the least. Maybe the cops aren’t your friends, maybe don’t answer questions and don’t consent to a search.

    Girl I knew, had her ex, who did not live with her anymore, used his key to get into her apartment. I happened to be there at the time and when we attempted to have him arrested for breaking & entering and burglary, cops (Sacramento PD) stated they couldn't do anything since he had a key. If she didn't want him to come in, she should have changed the locks. She went down and filed for an RO the next day. This is not burglary.

    This is a very nuanced scene and that's very rare in modern US TV shows, the white cop is doing his job and being objective she has broken the law multiple times, the young black cop possibly thinks its just racism, now it could be but we don't have any extra context in this video.

    I mean, the arrest seems pretty fair. Are we supposed to believe that walking into a police station unannounced with illegal firearms that you've admitted you stole was a good idea? I get that the show is trying to push a racial narrative, but this seems like a VERY valid arrest regardless of age, sex, race, gender...etc.

    At first to me it actually seems a little routine. I mean he did ask her if she had anything illegal in her car or on her person and she said no until she agreed to a search and then admitted there were her ex-husband’s guns in the trunk and literally admitted that she stole them because he has been threatening her. She could have just been honest from the beginning about that when he asked her. The biggest thing that I think makes him look like a racist is that he jumped to conclusions about her intentions. I think it deserved to be investigated.

    Why are they portraying this like the cop is wrong? It would be wrong to force a search/seizure, but asking is always within bounds. She consented. After finding guns and her admitting to stealing them, that's perfect grounds for an arrest.
    Being arrested isn't the end of the world though. They'll obviously look into everything, and they could easily do more help for her as they look into her allegations of the guy.
    But, yeah, TV show so drama and politcal narratives are played up.

      Yeah she's in possession of stolen firearms which is a felony so obviously she's getting arrested, she claims she's going to turn them into the police but for all they know she's going off to sell them, it's definitely safer to arrest her and bring her back to the station so they can conduct a proper investigation, they could decide not to charge her or only charge her with a misdemeanor and send her on her way if she's being honest, and investigate her ex and possibly arrest him, but no, a cop is apparently racist for doing his job

    Legally, the senior officer may have been right, but his actions were straight up wrong. The correct response would have been to confiscate the weapons and escort (NOT arrest) her in for formal questioning.
    She was being open, honest and cooperative. There was neither the need nor the justification for an arrest.

      This clip doesn't show him being racist at all, the lady should of been arrested, she admitted to breaking into her ex's house and stealing his property, also stealing firearms is a felony, if she was really concerned about her ex she should of simply reported it to the police, and since she apparently has a restraining order on him then he would of been arrested, also her story seems suspicious, she's in possession of stolen firearms which is a felony, she claims she was going to turn them into the police but she could of just as likely been going to sell them and using that ex story as cover, it's safer to arrest her and bring her back to the police station so they can do a proper investigation, now the cop could be racist but he is completely justified in this clip to arrest her and he should arrest her, idk why the other cop just wants to let her go because that would be irresponsible and unprofessional and dangerous, "oh this person is driving around with stolen firearms but she told me a good story so I let her go", "oh this person was a kilo of cocaine but they said it was their ex's cocaine and they swore to me that they were going to the police to turn it in to the police so I let them go" he sounds like an amazing cop lol

    Looking at this from both sides:
    No, she didn't need to approve the search of her vehicle. No authorization->No search->no arrest.
    Alternatively, she DID use her old key to get into her ex-husband's place and take his property. Threats or not, you can't steal other people's things. She was being pre-emptive about it, but could have called the police and they would / SHOULD have issued a warrant and removed the guns themselves if it was merited to do so.

    Even if you've done nothing wrong never allow the police to search yourself your house or your car. If they ask the answer is no I do not consent. Do not say nothing say no I do not consent. Even if you have nothing to hide the police can literally trash your property and not have to pay for it because you gave consent. If you did do something and they search your vehicle or person and find it it can be thrown out in court as it was an illegal search.

    He can ask. Nolan did nothing wrong there. She did steal guns. Reason or intent for theft doesn't matter. It's theft. She admitted to unlawful entry for the purpose of theft, burglary.
    The ex wound have reported then stolen anyhow, and this would have happened later with a court order if she hadn't said anything.
    The right way to handle this for her would have been for her to file a police report for the threats and weapons.
