      well the answer for your question is very short. Students can only claim what they have paid in income tax, so unfortunately most likely the will not get anything back as they dont earn that much

    Hi Ahsan, thanks for yet another excellent video. I wanted to ask can the amount sent via wise -> personal account in home country (myself) -> account of recipient (father) in home country be considered as well? Since it is trackable with bank statements that show the amount sent out to the recipient Also is there any specific time period in the year when the tax must be filed or can it be done any time?

    Hi Ahsan, thanks for the incredible videos. I pay around €500 per month to my parents in South Africa but I pay them from my South African account. I declare my South African income in Germany (but pay the SA tax in SA). Would the Finanzamt accept this? Or does the money have to travel from DE to SA?

      Hi Nicholas, the money has to travel from DE to SA as the tax benefit will be given from the taxes you pay in DE

      Yes its mandatory. The sign can be done by a lawyer, or the bank manager where the bank account is held. Or whatever the equivalent of a Union Council in India is

      Yes students are eligible. Its better that you send the money to the person who is being supported. However you can try your luck by writing a document stating that cash money was given to the supported person and get that document signed by the person being supported and notorized by a lawyer

    Hi Ahsan. Thanks for the video. I think no tax software except Elster supports this functionality. Elster has a place to enter the maintenance details. But I dont think it has a place to attach payment receipts, notarized unterhaltserklärung. Should these documents be sent as a hard copy separately to finanzamt or in person?

      Hey Ajay, i have to do some research on that(if any software has this option). Regarding elster attactments maybe look into "Belegnachreichung zur Steuererklärung" option in elster.

Finance amt rejected that saying that it is not "haushaltsnahen Dienstleistungen". What would you suggest, should I send the objection along with documents (Unterhaltungeserklärung ) using Elster. The second query is under what option the family reunion visa costs should be listed. Thank you for your time.

      Would be very hard to prove you are supporting him, as he has assets to his name. But you can always try to make a claim

      The more complex your transactions are the better it is to ask a consultant. Try wundertax (follow my tutorial) and see if you understand everything and then decide afterwards

    Ahsan, thanks for the useful video and article. In the article you write that it is OK if you send a lump sum to your parents in January, but if you send the money in July refund will only be calculated for some months. What if I start sending money in February? Thanks!

      February is also ok, but the later you send the money, the lower that chances of acceptance of the whole amount.

Could you please also clarify one thing for me: you said if the parents have a flat worth more than 30000 (15000+15000) Euros, then the tax deduction is not possible. But having a flat does not mean they have income. My parents receive only pension, no other income.​

      Well it is written in the conditions. However each case is assessed by a case officer and they do the interpretation.

    As you said limit in 2021 was 9744€ ,so If I sent the same amount 9744 to my parents and wife then how much will I get back(can you plz tell the exact amount refunded from Tax office)?

      Per person is a maximum 9744/4 for Pakistan. So if you can prove the case for you Father and Wife you can claim a max amount of 4872euros.

      @@ahsanfinance actually I did not get your point I mean If I sent my mother 73 years old father 79 years old and wife(student) 3500€ to each person then what will be refunded amount and why you devided 9744 by 4? What is 4? No.of persons? Or it is a fixed digit by tax office?

      As i mentioned in the video the number is Fixed by the Government based on where the money is send. Pakistan is in group 4 so the maximum claimable amount per person would be 2436. So the maximum claimable amount for supporting 3 people in Pakistan would be 7308

      Yes you have to fill out individual forms for each person being supported

      Well legally you should mention everything. Not mentioning the facts could lead you into trouble. As far as the acceptance goes , if your father doesnt get more than 600€/month you should expect at least some return from the Tax office.

      1. How old are they exactly?
      2. Do they have any assets like property?
      3. Do they get any rent?
      4. Are they physically able to work (according to German standards)?

      Have some land but not monthly or year income from that land.
      They don't get any pension or any rent.
      They are not so good for the work.

      According to the rules they both are too young to be supported but if you can some how prove that they cannot work only then can you claim the amount for your parents otherwise not

      Firstly, the claim depends on the income tax you pay during the year so before you can claim anything check how much income tax you payed in 2021

    Can I claim the student loan for the return? My father is a single parent, he will be retired once next 3 years. I am planning to come to Germany on student visa next year.       Hello, there are 2 things.
      1. You cannot claim the loan amount in a tax return, you can only put the interest on the loan in your tax return
      2. As far as I know, you cannot claim the expense on a loan outside Germany, but please confirm this with a tax consultant

      As mentioned in the video you can get a document from your father with a sign from your mother that your father gave x amount to your mother. This should be enough as proof.

Could you please tell me, if i can claim it if i send the entire amount (as u said its easier to send in separate months)?       As I mentioned in the video, you cannot get the whole amount as is. You only get part of it back and as almost 2/3 of the year has also passed your claimable amount will further decrease. That said if you are sending money to your mother then it would be better to send in one payment now. In the reference it sould be as family support.

      You can try your luck. Some times the expenses are approved sometime not.

      It's not about how the money is used, it's mainly for family support i.e. the person being mentioned in the documents is getting it and using it.

    Hi Ahsan, Really liked the video.it is really informative. I have two questions regarding claiming money sent to my father,
    1. I am using wundertax, but there it requires only to declare the expenses(probably the last option to add Additional information). how do I attach these forms and proofs while submiting it ? or shall I claim and wait for the authorites to comeback for proof?
    2. My father has an apartment as an assent but no asset that generates income. Is it possible to get a return in that case?

      Unfortunately Wundertax doesnt have the maintenance declaration feature yet, so you might want to use another platform.
      As far as the property goes, you will have to mention it in the maintenance declaration form and its up to the individual tax officer to assess if your father can support themselves or not. So no harm in applying

      Within one year if there is a profit then it will be taxed after 1 year its tax free. Only the profit will be taxed, if there was a loss within that 1 year (and sale was made at a loss) you can adjust the loss against profit from the same asset class

      If they do not have any disability that can limit their ability to work, then unfortunately you cannot claim this amount

    Salam sir, i am sending money to my mother back in India everymonth for family maintenance. My mom gets a normal pension of 10000 rupees ( 150 €) per month. I'm i eligible for tax return here? Thank you.

      Unfortunately as your father own the house, he does have the ability to sell it and live off that money ( this is what the finanzamt might argue), that said you can always apply and see how the finanzamt responds.

      I am not quite sure. However, If all the conditions are met i.e. Age, the Person being needy then it shouldn't be a problem.
