    What if the lawsuit is against the city/state/USA and they refuse to pay? (AFTER ALL THE DEFENDENTS APPEALS ARE EXHAUSTED) what do we do different?

    I am in a situation where debtor is hiding after I won the case. The guy is prettt shady to say the least. I have found his home address can I show show up there to serve him paperwork?

      It's unfortunate that a rich defendant has so many options to not pay you after you won. He can relocate, ignore you, pretend to be poor, etc.

      @htrland Only in America. Laws are so fucked up here. And then we should question why the justice system even exists?

    If defendent was a no show, (judge awarded me $1650.), he is in contempt of court, are the courts going after him, or do i file contempt of court?

    Im still
    Confused. If you have a judgment is r it past discovery phase?

      Yes; the case is over. But an action to enforce can be a separate proceeding with a new discovery phase.

      I liked the comprehensive treatment of examining insolvency and bankruptcy. I’m familiar with the case of a debtor threatening the use of bankruptcy if any legal action was taken on the debt, and actually following through on that threat to block the legal action.

    What if the debtor has his assets in 3rd party trust?

    • @LawShelf
      @LawShelf  Рік тому +1

      Depends on the trust :)

      If it’s not a spendthrift trust and the beneficiary has other criminal charges against them/bench warrants etc and we’re trying to collect from a trust that has between 150m and 600m?
