I remember when this story first broke in 2014. Absolutely disgusting I thought. Even moreso that it took 8 years for the trial, and the outcome was injustice. The grainy theatre video disputes everything the killer claimed about the victim jumping over the seats into his row. This was a cold and calculated murder by a killer who used his police knowledge of the court system to get off scott free.
All those empty seats in the theater, and the executioner couldn’t move instead of provoke. It reminds me of people who move next to an existing airport and then complain about the noise.

The theatre looked empty! Why did he go and sit behind him again after making the complaint to the manager? LOOK AT HOW MANY EMPTY SEATS IN THIS PLACE!
Inflexibility, entitlement, a default to the use of violence, even deadly violence, to "solve" any and every problem. Sums up a lot of America's social and cultural problems, quite frankly.
It is so sad that the young husband and father had such a strong feeling that he could do whatever he wanted to, any time he wanted to. He could have stepped to the lobby to text, he and his wife could have moved to another part of the theater, he could have apologized for being on his brightly lit phone . He chose to be entitled and confrontational to the point he physically attacked the complainer. This is not normal behavior. The young man’s attitude was fueled by some kind of uncalled for anger with which I am sure his wife was very familiar. I am also sure the retired police officer was highly irritated and issued a rude order for the young man to turn his phone off.

Obviously no excuse for hitting him, but if he really felt that threatened he could have at least warned him that he had a gun.
I find it interesting that saying "I have a gun" should be a warning in this situation. My thinking would be, "OK, but you aint never going to use it now even if I talk 10 hours in my phone" - so the warning should be "S--t up or I'll shoot you dead" which seems totally different to me.

As someone who instructs others in Conflict de-escalation I cannot believe that the retired officer exhibited no skills whatsoever in this area. As a matter of fact, he initiated and continued to escalate the situation when it could have been avoided.
He is an entitled person who used to have authority and therefore feels he is automatically owed respect from everyone without earning it beforehand. He went looking for trouble not looking to resolve anything. The guy could’ve been checking that he’s kids were okay, he wasn’t even disturbing anyone by texting… during previews. It’s probably just a case of a trigger happy maniac with the mindset of “ i have served this country for years, how dare you not respect me and do as I say”. The entitlement is … beyond anything I can even find the appropriate words to express.
Your students need their money back immediately. The retired cop was the only respectful person in this situation. His de- escalation was what every student is taught by professional instructors. He politely asked a self centered dude if he could stop using the phone, due to its lighting. The dude told him to fk off. He immediately refrained from arguing and properly got movie personnel, all while dude running his trap. Dude ignored manager. And continued to talk across rudely to old guy. The retired officer never threatened or made one fkn gesture of escalating the event. Because he used verbal judo and did not escalate he was rightfully found Not Guilty, period. Case closed.
You can see the guy who was shot arms going at the guy who shot him. That is definitely not good. However the guy who shot him had to lean forward. That’s not going to happen if someone is on top of you.
It was pretty straight forward. The case against him was extremely weak with many facts in his favor. Just listen to the prosecutions closing and you can tell how they needed to dance around the facts to try and convict.
also the testimony of the wife DID NOT match what actually happened (and her wounds ironically appears to be as if she was actually holding him back)...reasonable doubt starts adding up real quick
It's because he was over charged. Should have prosecuted him with a lesser charge such as manslaughter. It was very poor judgment on the shooters part. Very careless of human life.
