      I focus on family-based immigration, naturalization, and immigration court. I don't have experience handling diversity visa cases - sorry!

    So if ex-wife has error green card N doesn’t file Form I-90 to fix it right away n when the 2 years anniversary is this year and she doesn’t file Form I-751 because she is on CR-1 status what happens than? Because she was suppose to get 2 year conditional green card by USCIS but they issued LPR by error? What’s on this?

    • @DarianLaw
      @DarianLaw  Місяць тому

      She won't be deportable if she failes to file the I-90 to fix the green card, but if she is a conditional resident then she must file the I-751.

      @@DarianLaw oh she doesn’t want to do either of them! She doesn’t want to fix the error nor file I-751 because she is telling everyone that just because she has LPR that me and my lawyer can’t do anything.

      If you are referring to a sibling petition then you probably need to wait 4 more years. Priority dates from 2007/2008 are current right now.

    Did that man eventually got his citizenship? Did USCIS aknowledged their mistake in the case of that man?

      No, he ended up in removal (deportation) proceedings and it was an absolute nightmare. The immigration judge denied my request to terminate removal proceedings so I filed an interlocutory appeal (which means I appealed while the case was still pending - highly disfavored). The board of immigration appeals agreed with me, and terminated his removal proceedings so he remained a permanent resident. It was one of my greatest victories and, as a result, USCIS issued new policy guidance several months later: www.uscis.gov/sites/default/files/document/policy-manual-updates/20191121-CPRs-Stockwell.pdf
      Once removal proceedings were terminated USCIS resumed processing of the N-400. It took another year to naturalize.
