- The plaintiff hired the defendant to inspect her house before she purchased it, and he gave her a clean bill of sale. After buying the home, the plaintiff hired another company, and they found toxic black mold, so the plaintiff is suing the defendant for a refund. The defendant says he reported issues when inspecting the house, but the plaintiff paid no mind to the defendant's report.

I'm from the Mid West. I'd be very nervous about any spots on my ceiling or elsewhere. It also makes sense that terribly humid areas have more mold issues.

Couple of things.
1} The contractor is absolutely right. If he says "Mold!" and the sale falls through and there is no mold, he absolutely will lose when the seller sues him.
2} She actually expected him to have to pay for her kitchen remodel?!?!?

If she had found out how bad mold was, and how much it was gonna cost her before she closed on the house she could’ve negotiated that in the price.

Plaintiff is a scammer. Trying to get someone else to pay for her own negligence or flatout knew she bought a house with mold and then set the defendant up to try to get him to pay. So glad she lost.

All she had to do was get a contractor in to verify what the problem was, she chose not to, so how is that anything to do with the inspector who did and said everything he was legally allowed to do?...
Why is it so hard for people to read, use their phone to lookup something if they don't know, to actually use their brain, someone tells you to get a specific type of person, yet it's not your fault if you do nothing. People need to take responsibility for their own actions and everything that happens to you is not always someone else's fault. We got hit by 2 hurricanes within 6 weeks apart in Louisiana. We had just bought out house, new construction we lived in for 45 days. By the time we were able to drive back to our house, days after the first storm, one room had mold/mildew everywhere. We took pictures and then ripped it out. Insurance adjuster came done his report and insurance didn't want to give enough to replace everything that was damaged. The roof, all floors had to removed, sheet rock, insulation, painting and siding. Second one happened went through insurance process again. We ended up getting a private adjuster bc the insurance adjuster didn't list all the damage and missed 30k in damages.

Seems like a home inspector should be qualified to diagnose and allowed to say the word "mold"... The entire purpose of an inspection is to inform the potential purchaser to problems... it's a safeguard for possible additional expenses that can be worked out between the seller and buyer prior to closing...
If I were a home inspector, I wouldn't be able to, in good conscience, NOT mention something so serious and such a health concern/hazard...
Not qualified to say mold. He can say moisture present. Then you bring in a specialist
In general these visual home inspections are mostly useless. They always downplay what they find because they don't want to kill the deal. When buying a house hire a few of specialists to do a close look.... plumbing, electrical, pest.
In this particular case though the report did give her enough information on the wet spot that she should have followed up.

You don't need a license to give your professional opinion but if you talk with any professional, they will carefully choose their words to avoid creating a panic. If you go to a family doctor and ask "Can this be cancer", they won't give their "opinion" because they ARE a professional and you'll take their opinion with authority; it's why they refer you to someone that can answer questions. The inspector said "This is wet, you need to call an inspector for MOLD". If he had said "Could be mold", then if it wasn't, this would've sued him for having the deep inspection done because "I trusted them, they said it was mold".

If he says "There is mold" and the sale falls through, he is liable to the seller if he is wrong.

Milian being bragadocious about being from the state of Florida is nothing to be proud or happy about considering the stigma oftentimes associated with the state these days. But I knew that the plaintiff was out of gas as soon as I heard the details of this lawsuit. I own my own home so I know.

Nothing wrong with being bragadocious about the place where you live. As for the stigma of the state where you live or say even the country, should I never move to the US because of all the mass murders that happen or the gang wars or the high levels of crime in general, no, because you can't judge a whole country on a small percentage of people or because of what the media tells you.

The United States these days isn't what it use to be back in the 70s 80s and 90s, particularly for men so the answer to your question is NO! Just like Florida, the states should be avoided. She knew very well those stains were mold yet she still chose to purchase the home. That is on her. The defendant did his job and he did it well.
