    The term ‘walking free’ is used incorrectly here. They have already been convicted and spent 35 yrs or so in jail.
    Edited: for everyone commenting on the length of the sentence: my comment was a linguistic one as ‘walking free’ means to not be convicted (when expected). They were convicted so the term ‘walking free’ is not correct here.

      If I was on the jury I would vote GUILTY on first degree based on the evidence. The rate of jury convictions has drastically gone up since 40 years ago.

    Let’s not overlook that one interview (of their former neighbor) when Jose and Kitty invited her for dinner, and Jose played a VHS tape in front of everyone, including the kids, Erik and Lyle. The tape, which lasted only a few seconds to a minute, had show "child p*rn*graphy" that Jose found hilarious. A parent in the right mind will never find it right and entertaining

      The parents should have been held responsible but they are dead. José should have had his brains (what was left of them) examined. The problem was he ate rice and beans, and had a B1 deficiency. Boys scared at night? They inherited it, this condition is genetic, has to do with learning, emotions, the safety center.

      Gypsy tried to kill her mom 10 years before the murder. She shot her mom 10 times with what she thought was a real gun. It was a BB gun. I don't blame her any more than the brothers. It's human nature to want revenge and, if necessary, kill. We are animals, just civilized. Man made these rules, they go against the nature of us.

      You sound defensive. Why makeup a false assumption that he has to be "very emotional" just because has a different pov than you? He was NOT fake crying with NO TEARS like Erik did or faking emotions and fake crying to police like Lyle and Erik did numerous times. He watched the case and listened for the brothers to depict abuse that was so extreme the brothers had no other choice but to kill the parents. That testimony was NOT there. The abuse accusations were unproven, lacked corroboration, and did NOT convince everyone on the juries. Abuse evidence MUST CONVINCE everyone on the jury in order to call the abuse factual. The abuse evidence failed to convince 3 juries. Erik testified for days at both trials but he was not convincing with his stories and he never said the mother abused him so they are on the hook for her murder.

Oh this man is big mad that people are disagreeing with the prosecution. I'm flabbergasted that a man who reported on the first trial is really here saying that nothing was "corroborated". Did he have his eyes closed for half of the trial or something?

      Did you have your eyes closed for half the trial? Just because different people watch a trial does NOT mean they have the same assessment of the trial. One of the main issues with the first trial juries NOT aggreeing to vote in the brothers' favors was the brothers' testimonies were NOT convincing enough and were missing legal factors to convince a jury they were in imminent fear of their parents when they killed them.

    Holy crap the bias in this conversation is astonishing.
    Mary Winkler served 210 days for murdering her abusive husband with a shotgun while he slept. Francine Hughes was acquitted after setting her abusive husband on fire while he was passed out drunk.
    Obviously mitigating circumstances do matter, but not when the perpetrators are rich boys.
    Anyone who's been in an abusive relationship knows that the "it's them or me" thought pops into your head eventually. I believe it did with Lyle and Erik, just as it did with Mary Winkler, just as it did with Francine Hughes.
    "There's never been any suggestion that Kitty would kill her sons." But there's never been any suggestion she would protect her sons, either.

      Comparing irrelevant cases in other jurisdictions to a CA course is nonsensical. Comparing cases where juries and prosecutors were CONVINCED abuse took place to a case where the juries and prosecutors were NOT convinced abuse took place is nonsensical. Personalizing the case to yourself is nonsensical. Falsely assuming someone had to be "in an abusive relationship" to be able to disregard the governing state laws so their emotions and personalization let you ignore the legal FACT Kitty not protecting her sons justifies her being killed TWICE.

      @@S.Blonde the jury in the second trial wasn't presented with the abuse allegations like the first, so they couldn't consider it to be convinced of it. I never said a person had to be in an abusive relationship; I said that anyone who's been in one knows there comes a point where thoughts you never thought you'd have come to mind. I also only "personalized" anything by stating that I believe them, which many other people have also said.
      Your twisting my words and not understanding what a flipping example is is what's nonsensical. The two other cases I mentioned are to show that people do believe abuse defenses under certain circumstances, including when people are killed while there isn't imminent danger, which is why there was a mistrial the first time around. I think if the same first trial were presented to a jury today with manslaughter on the table, that's the decision the jury would come to.

      @@AprilTheRockStar I disagree. The rate of jury convictions has only gone up since 40 years ago. Manslaughter should NEVER have even been on the table. This was NOT an accident. This was NOT an accidental outcome of a fight. They did not describe imminent fear of their mother. They are guilty of first degree and they would be convicted of first degree. The abuse evidence was certainly presented at the second trial. Erik testified for days. There were 64 defense witnesses at the second trial. Erik never said his mother abused him. Thus, he was not legally justified in killing her. Failure to protect does not justify murder. If everyone on the juries could not agree the abuse even took place then what would the mother be protecting Erik from? Erik was a grown man and should have moved out. Even if the abuse was going on, Erik's refusal to leave is implied consent because he knew the rules of the house yet refused to leave and go to college or get a job. Maybe Erik liked it or learned to like it with Jose. Why else would Erik be so stubborn and kept refusing to leave even after the parents changed the house locks and refused to give him a key.

      @@S.Blondethe minimal sentence for first degree in CA is 25 years to life. They have already served well beyond that. The relevancy of the other cases speaks to the law itself and whether it should be changed to have outcomes that more appropriately match the crime

      This was a JURY trial not a trial according to you or the judge. The jury did NOT agree they were in imminent fear. The brothers' testimonies was NOT convincing of imminent fear of both parents. IMO they should have embellished more and made the abuse sound more extreme since they were trying to use the abuse excuse. Whatever happened to saying you were chained up and tortured? That has been depicted in enough cases and movies and that is the type of abuse that convinces an entire jury. This case had Erik saying only Jose abused him not his mother and Lyle saying both parents abused him but the abuse stopped a long time ago. A jury cannot help defendants that are not helping themselves. Just because you personally cannot see beyond your perception of what the brothers said does not mean everyone shares or validates your pov because many people require more solid evidence and more details of extreme abuse in order to vote in the defendants' favor.

The judge and prosecution already had went above and beyond at the first trial to allow all that irrelevant and unproven child abuse accusations be presented and the accusations and subjected evidence FAILED to convince the two juries. At the second trial the abuse evidence was limited to proving imminent fear of their parents. The REAL dodgy people where the two felonious brothers whose testimonies did NOT describe imminent fear of their mother.

      @@jashley777 It certainly was NOT biased OR BASED off the OJ Simpson. In 1994, Judge Weisburg ordered both the prosecution and defense attorneys to sit down for settlement discussions. Unfortunately, a plea deal was not reached. The defense wanted manslaughter and the prosecutors wanted first degree. Clearly, the best compromise would have been second degree. The second trial was a regular murder trial. Who did the crime? Why did they do the crime? Where is the evidence proving they did the crime? Evidence NOT pertaining to those three questions is legally irrelevant. Lyle deciding NOT to testify was totally up to Lyle. When a defendant chooses NOT to testify you cannot bring forward evidence or testimony corroborating factors the defendant refused to testify to. Erik testified for days but he failed to convince the juries that his abuse accusations against only his father justified him killing his mother. Erik never made abuse accusations against his mom

      The first trial ended up being a hung jury which shows that the evidence presented regarding the molestation had an impact on the jury. The second trial excluded all witnesses and anything related to the abuse. The juries only option given was murder in the 1st° or acquittal. Definitely not a fair trial. It turns out this arrangement was made between the judge and the prosecution because of the bad press due to the O.J. Simpson case. They desperately needed a conviction because they were made fools off after the OJ acquittal.

    I am a little tired of hearing that's it's because of the netflix show. That's not the case a lot of people have thought that what happened during the second trial wasn't fair and people who have went through the same thing that those men went through knew that they were telling the truth.     The brothers didn’t have a chance on the second trial due to judge only allowing
    first degree murder and not manslaughter charges and not allowing their witnesses to testify… judge already made up his mind and wanted a guilty verdict
    The judge should never been allowed to do the second trial, the brothers were doomed from the start of it.

Diane got Kitty and told her what Lyle told her and Kitty just led Lyle back to his bedroom without saying anything to Diane so Diane at that time thought there was probably nothing wrong happening. Diane said Kitty didn't believe her when she told Kitty what Lyle told her about he and his dad touching each other.

    I usually enjoy this channel but this interview was frankly gross and dismissive of abuse survivors and trauma. Shocking that a geriatric male holds the archaic beliefs that led to the brothers being demonized and mocked in the press… he answered the question about boys being able to be abused with non-answer relating it to kids killing their parents and crying about being an orphan… I’m sorry what? 😅 And there was no corroborating evidence about the abuse? What about Erik’s medical exam showing throat trauma as a child? Eye witness testimony? What a pathetic “journalist”.

      The first trial was enough. All the evidence was there. But social stigmas prevented justice.
      Then the DA moved the goal posts to ensure conviction because they were failing hard off the back of Rodney King and OJ.
      The most vulnerable were made the example.

    The brothers TRULY believed Jose was going to kill them because of all the threats that he would. A therapist said Lyle had the mind of a 10 year old & Erik had the mind of an 8 year old. THIS is why the killings were not well planned out.
    I did not follow the trial but saw bits & pieces of it. When Lyle was on the stand & Erik was crying, I knew they were not lying about the SA. They deserve to be FREE.

    As someone who’s never been abused, I do not allow myself to judge other people who’ve been abused as to how they should fear or hate their abuser. Sure they were watching TV but it was an ongoing abuse that both brothers endured. So, how do I know how they felt while being under the same roof with their abuser(s).

    I like most people have seen the Netflix show, then went on to fully look into the case. And I plus everyone I've ever spoken to about this have come to the conclusion that these men were sexualy abused. They bought the guns because they actually did fear for their life because they believed their father would hurt them more if they told anyone. So on that night they went in to put an end to it they could have gone to the police but they wouldn't have been believed as apparently males couldn't be abused and not to mention Jose was a powerful man. As for Kitty, she failed them so completely they saw no other choice but to take her out to I would've done exactly the same.

      When your parents buy you a condo, buy you a car, give you money, pay your college tuition, pay for your international trips you went on without the parents, change the locks to their home and refuse to give you a key that means you are supposed to MOVE OUT. Condos are meant to be lived in. Cars are meant to be driven. Colleges are meant to be attended. There is NO REASON why two adult men are still in their parents house on August 20th instead of being at college getting ready for fall semester to start shortly. The sons REFUSED to leave the parents house so they are the aggressors not the parents. The parents did not want them there and irrefutable factors I listed are ACTIONS the parents did that proves their intentions. I always value people ACTIONS over mere words. You cannot claim you are being abused when you refuse someone's house. Erik KNEW the rules of that house and refused to leave so he knew as a grown man what came with living there so he either liked it or learned to like it with Jose because it certainly was not such extreme "abuse" he did not want to leave Jose. The killed the mother because she was in their way of getting Jose's money.

      all professionals that evaluated them unanimously said that the brothers are not psychopaths. for you to say that means that you have no understanding of what that term might even mean. it is not even used as a diagnosis in psychological evaluation.
      they acted in desperation after years of terror and unimaginable abuse, which resulted in them reacting in the way they did. it was a fight or flight situation. trauma, especially at the level they experienced, affects how the brain reacts to intense threat and fear.
      they feel immense guilt and shame about what happened. but the abuse they suffered was so severe and so prolonged that they snapped and, in a moment of pure desperation and fight or flight, they took their freedom back in the only way they could process: by k*lling their abusers.

    The statement that the parents were quietly sitting there watching television is as full of surmise is your absolute certainty that the sons were not in fear for their lives. You can't possibly say what the parents were actually doing or what was in the sons' minds. And the Oziel tapes were them trying to placate him so he wouldn't go to the police. Oziel was no therapist for them. He wanted to tell them how to invest their money and blackmail them. Mr. Abrahamson is merely rehashing the entire prosecution case which I found many many flaws with. The prosecution did not prove to me that they killed with malice. And to hear this journalist speak as though only he knows the truth tells me all I need to know.

    I am a Canadian lawyer, and of course our legal systems are different. Our national Supreme Court in 1990 allowed an acquittal of a woman who killed her abusive husband because of long-standing abuse, despite no imminent danger. I am simply raising it for comparison for the legally or otherwise interested: R. v. Lavallée.

    Ok. Lyle did not go "moments later" and sob into the phone. They first met with Perry Berman at Taste of LA after dumping the guns off Mulholland Drive and retroactively trying to get alibi movie tickets to "Licence to Kill". Then they came back to the house and saw the parents again, dead......Erik is off wailing, Lyle calls 911. But sure, you were there for 6 months in the courtroom. I may have a better memory. Also the whole Big 5 thing? Not a blatant lie; I believed it was an honest mistake. But Kuriyama sure was proud of himself.

      Their lives were in danger from their point of view and that's what's important. That's what's called "imperfect self defense". You are judging them with your adult brain who had a happy childhood. No, they couldn't have called the police, they had been threatened by their father who had guns in the house, he could pay off anyone and had done it in the past, plus they were so traumatized they thought no one would believe them, and they were right.     Me and my mam watched the series of the Menendez brothers, she was shocked and even cried because she can't comprehend how someone could do such horrible things to children let alone their own children. I truly think they deserve a new trial and to be released.

      Yup there’s a lot of those perpetrators who get away with it for years and years or do short sentences get out and commit the crimes again. Who’s the bigger threat to society- them or the people who’ve had enough, snap and put a real stop to things in a way the justice system keeps failing to do?

    If your interested is all the details go watch Crime weekly podcast about the menendez brothers. There was definitely corroberation about the abuse. Kitty knew and did nothing about it. She was also a drunk and abused pills she was not innocent by any means. Im not saying they shouldn't have gone to jail but they were the product of their awful parents and there should be some consideration 30+ years later

    It is astonishing to me that in this day and age, people still need someone to explain to them the affects of abuse on a victims mind. It’s very easy for us to sit here and go through the things the brothers could and should have done that night, but it’s much more difficult to understand the fact that in that moment, they truly believed their life was in danger because of everything they experienced at the hands of their parents, and they acted out of panic. They’ve served their time and deserve a second chance. FREE THE MENENDEZ BROTHERS!

    People especially young boys are easily influenced by the media and music. If these bums get out, young boys will thing that it's okay to murder your parents. Keep them in there. I am so disgusted by these comments.

      ​@@roachums123The innocent little boys, Lyle lived with his girlfriend in Alabama, mature enough since he was in a relationship without any problems and Erik dedicated himself to stealing, poor boys were so afraid of their father that they never wanted to leave home. The poor mother was afraid of them and the father no longer wanted to give them money, so both monsters decided to plan and execute the murder.

    The ptsd I believe they suffer from it, but weren’t living in a constant state of that. They were functional members of society struggling with trauma and ptsd. So I believe the murder was premeditated with functional mind at that moment. The law is clear.

    “Always follow the money.” Lyle hadn’t been abused since he was a child. He used it as an excuse. He burglarized homes because of his greed. He was a student at an Ivy League University with his own condo, not a country hick living in a shack. Nothing stopped them from going to the police-NOTHING! He was a spoiled rich kid, who could never get enough. His actions after the murders clearly showed, that he was after the money. Purchase of multiple Rolex’s, a Porsche, an apartment, a restaurant, $1000 suits, vacations and casino gambling were clear signs of a person obsessed with wealth and the flaunting of it, not of an abused person who escaped their capture. But that’s just my opinion. And the funny thing is that he and Eric are about 10 years older than their parents now.

    My stance is if we are going to allow gypsy rose out after her “abuse” was proven to be medical necessity not abuse and she was a major part of the murder and planning of the murder of her mother and in my opinion helped in the actual crime these boys have served their time and paid their dues especially when you can’t find a single person to say a nice thing about Jose in particular, these guys should have their opportunity at freedom
