Harassed while Bass Fishing by this Guy! Will the cops be called?

    Getting harassed and told to leave is not fun while you are just trying to enjoy yourself while fishing. In this video the Harbor Master decides to come over and try to kick me out! I know my rights as a angler and know that I am allowed to fish any navigable water way. I told the guy I will not leave and I will continue to fish here because I know it is legal to fish these waters and he has no right to tell me to leave. I also told him to call the police and get the cops involved if he wanted to! I know there is a lot of anglers who have been told they cannot fish in certain areas and for the most part the person telling you to leave is in the wrong. Keep in mind though that some states do have laws regarding where you can and cannot fish. Make sure to check your rules and regulations for the body of water that you will be fishing. If someone does approach you and try to kick you out or yell at you just remain calm and let them know that you have every right to fish here. If they continue to harass you call the cops or get someone of authority to step in. Heck better yet bring out the video camera or phone like I did!

    As a Game Warden, I got to deal with a woman who actually came out of her house and fired a shotgun into the air because two high schoolers were fishing by her dock.She won the silver bracelet award.

      It’s not the fishing that bothers them you dink. Try owning a boat that costs the same as his bass boat as upkeep expenses for 3 months of the year...
      Bass fisherman by practice will always be close to docks, houses, boats etc to the point they’re in peoples business. I’m a fisherman. I live on a lake and always respect boundaries with peoples docks to give them some level of privacy.
      Bass fisherman on the lake will be practically at your bulkhead. They’re the aids of the fishing community.

      I would of just called the game Warden, then tell the guy I'll sit and fish till he gets here. Note: you don't even need a address, if the owner of the property your near won't give you the address you can send them your location via latitude/longitude. Long as you have a smart phone, They send you a link and you just click on it, gives them your location.

    We had a homeowner that put wire in the water around the outside perimeter of a dock so trolling motor props or bug motor props would hit it. The homeowner found out in Tennessee that you only own the dock none of the water around it. End result once caught the home owner lost his privilege to have a dock in the lake and had to remove the dock. Now he doesn't have to worry about people fishing around his dock any longer though.

      Yeah, it's actually an amendment in 22states of their constitution that's called RTHF right to hunt and fish . If you're legally allowed to fish there it's a constitutional violation to harass a person fishing

    I love when fishermen come near my dock at my lake house. Seriously it's great talking to them. Sometime they offer me a beer or two. I also wish that people were more grateful for what they have. The house I have was a gift to me, I am blessed to have it, with that kind of mind set of appreciation, it changes the way you view this kinda thing.

      Some people just see it as a nuisance. For me, it would be an opportunity to learn something, talk to someone new and see people catch neat fish. But all that goes over these harbormaster's heads. Sad

      I think the concern is that while many fisherman such as the ones you encountered are great, there are many jackasses out there that would still everything on your dock and boat that isn't nailed down. Hard to tell the difference between a nice fisherman and a scumbag from a few hundred feet away.

    Here we go...some guy thinks he owns the waterway. Not true and he is harassing the guy fishing. Period. 31 years policing with marine unit also. People you do not own the waterway. The fisherman has a right to be there just as much as you have a right to walk down the sidewalk.

      Had issues with fishing boats with IDIOTS trying to cast at us; we pulled out our wrist-rockets, and started firing steel ball-bearings back at the boat. Radioed the caption who was casting at us, and he left, with a bunch of stupid people on board to get away from US crazies.

      I took over management of a mobile home park about 20 years ago,I'm a pretty easy going,laid back guy.there was this old school meth head who lived there,he was worried I was going to be" That Guy" one night I was out walking with my cats,he stopped me worried about my rule inforcement policies.I looked at my watch and told him it was almost time for curfew and needed to get home.       This law reflects Wisconsin's hunter harassment provision. Under the law, no person may interfere or attempt to interfere with lawful hunting, fishing or trapping with the intent to prevent the taking of a wild animal. It is an affirmative defense to the prosecution for violation of this section if the defendant's conduct is protected by his or her right to freedom of speech under the constitution of this state or of the United States. A court may enjoin action prohibited under this statute and may award damages, including punitive and special damages, to a person adversely affected.
      (1) Definition. In this section, “activity associated with lawful hunting, fishing, or trapping” means travel, camping, scouting, target shooting, dog training, animal baiting or feeding, or other acts that are preparatory to lawful hunting, fishing, or trapping and that are done by a hunter, fisher, or trapper or by a member of a hunting, fishing, or trapping party.
      (2) Prohibitions.
      (a) No person may interfere or attempt to interfere with lawful hunting, fishing, or trapping with the intent to prevent the taking of a wild animal, or intentionally interfere with or intentionally attempt to interfere with an activity associated with lawful hunting, fishing, or trapping, by doing any of the following:
      1. Harassing a wild animal or by engaging in an activity that tends to harass wild animals.
      2. Impeding or obstructing a person who is engaged in lawful hunting, fishing or trapping.
      3. Impeding or obstructing a person who is engaged in an activity associated with lawful hunting, fishing or trapping.
      4. Disturbing the personal property of a person engaged in lawful hunting, fishing or trapping.
      5. Disturbing a lawfully placed hunting blind or stand.
      6. Disturbing lawfully placed bait or other material used to feed or attract a wild animal.
      7. Engaging in a series of 2 or more acts carried out over time, however short or long, that show a continuity of purpose and that are intended to impede or obstruct a person who is engaged in lawful hunting, fishing, or trapping, or an activity associated with lawful hunting, fishing, or trapping, including any of the following:
      a. Maintaining a visual or physical proximity to the person.
      b. Approaching or confronting the person.
      c. Photographing, videotaping, audiotaping, or through other electronic means, monitoring or recording the activities of the person. This subd. 7. c. applies regardless of where the act occurs.
      d. Causing a person to engage in any of the acts described in subd. 7. a. to c.
      8. Using a drone, as defined in s. 941.292(1), to conduct any activity prohibited under subds. 1. to 7.
      (b) No person may knowingly fail to obey the order of a warden or other law enforcement officer to desist from conduct in violation of par. (a) if the order is based on any of the following:
      1. The warden or other law enforcement officer personally observed such conduct by the person.
      2. The warden or other law enforcement officer has reasonable grounds to believe that the person has engaged in such conduct that day or that the person intends to engage in such conduct that day.
      (3) Exemptions. This section does not apply to actions under sub. (2)(a)1. to 8. performed by wardens and other law enforcement officers if the actions are authorized by law .
      (3m) Affirmative defense. It is an affirmative defense to the prosecution for violation of this section if the defendant's conduct is protected by his or her right to freedom of speech under the constitution of this state or of the United States.
      (4) Civil actions. (a) A person who is adversely affected by, or who reasonably may be expected to be adversely affected by, conduct that is in violation of sub. (2)(a) may bring an action in circuit court for an injunction or damages or both.
      (b) The circuit court may enter an injunction under ch. 813 against conduct in violation of sub. (2)(a) if the court determines any of the following:
      1. The defendant is threatening the conduct.
      2. The defendant has engaged in the conduct in the past and that it is reasonable to expect that the defendant will engage in the conduct that will adversely affect the plaintiff in the future.
      (c) The circuit court may award damages to the plaintiff if the defendant's conduct in violation of sub. (2)(a) has adversely affected the plaintiff. The damages awarded may include punitive damages and any special damages. Special damages may include approval fees, travel costs, camping fees, costs for guides, and costs for equipment or supplies to the extent that the plaintiff did not receive the full value of any of these expenditures due to the unlawful conduct of the defendant.

    I got harassed several years ago while fishing in a national-forest lake, by a kid who claimed it was his lake. He was getting so worked up on the boat ramp I was afraid he might swim out to my canoe and I'd be forced to either retreat or club him with my paddle.

    As a Dock Master and marina owner I feel I need to say my piece. We have many tournaments in our area and there is some big money on the line. If I see these fishermen around our marina, I will walk out and chat with them a bit. Usually I will warn them of any underwater hazards they might not know about and I can usually point them in the direction where others have caught fish. I am in WI and have had to educate more than 1 person on the legality of fishing in and around the docks. Yes I have even gone as far as retrieving lures that got somewhere they shouldn't. Not all fishermen are bad and not all Dock Masters and property owners are against fishing.

      I am always surprised by how many of these videos I see. I fish constantly, on many local lakes. Most of them have nice homes around the shore line. My normal encounter with folks who live there goes more along the lines of..."Good morning, having any luck?" Or Hey, it's a beautiful day on the water today, isn't it?"
      I try to respect others property, just as I expect people to respect mine. Never ceases to amaze me how belligerent people get over petty issues.

      @@JaegerNZ So? If there is a hazard at the marina that causes harm to person or property through normal use of that waterway, anyone has the right to sue. If the marina has such hazards they had best fix them, or buy plenty of liability insurance. There are many underwater hazards alongside most docks; just watch the magnet fishing videos, there's everything from shopping carts to full sets of nice golf clubs, and miles of wrapped up monofilament line.

I have 2 brain tumors and one wrapped around my spinal cord inside my L4 vertebrae. The pituitary tumor is almost making me blind and the one in my spine makes it feel like I'm being tased from the bottom of my feet up to my hips and some how I find a way enjoy everyday without being bothered by much.     I fish that same exact spot and was also harassed. Regretfully I left after a killer day of fishing and called the wdnr. They called me back and said I could fish it and they would have a word with the marina. I went out the next day and no issues. Hopefully it stays this way.

    In Wisconsin, if you are excercising your legal fishing rights, the person harassing you can be cited. A game warden could inform him of that fact.

    So as an avid bass angler, I know the feeling man. I myself do the same thing quite often and get the same type of pushback. I had a long conversation about this with the owner of a marina in my area who is also an avid angler, he has had several pipes and lines torn apart by careless anglers. I know you are very careful when back behind docks as I am, but not everyone is 🤷🏼‍♂️. Yea it’s legal, but the harbor master didn’t sound too unreasonable... it’s all about respect like you said. Tight lines!

      Some damage is the chance they take for floating all their crap on public waters. Mother nature does far more damage to their equipment than anglers. I am always amazed at how clean and clear local waters look when fall comes and the marinas take all their junk and their customers boats (most which barely get used) out of the water.

      It's hard to argue a waterway is not navigable when you're in a marina. Some states have different definitions for navigable though. There's a myriad of different rules from state to state.

Some states have different rules for inland vs. tidal waters, natural streams vs. manmade.     I own lake property and am an avid bass fishermen. The only time that I've ever said anything is when someone bounces a weight off my boat. Spent too much money for someone to abuse my stuff. Make sure you're proficient at casting and operating your boat before dock fishing.

      Check the code for underwater pipes in that area. A) I can 100% bet you their is no pipes in that waterway unless they run under the dock and are usually just for hoses for washing of the boats'etc. Otherwise they have to run below the seabed, so realistically theirs probably only a piping system implemented under the dock.. like he said their was a 2x4 there before and most likely it was removed because a) it wasnt part of the engineers design and as such would require a permit to be added and a engineers stamp of approval.

    You are right that the waterway is public (belongs to the state), but incorrect in that specific area being a navigable waterway for your vessel; from the video appears like not enough room to pass or turnaround, but I could be wrong there. A navigable waterway for a kayak may not be navigable for a 100’ yacht, and accordingly, I have to agree with the harbor master in this case. It’s not like the guy was unreasonable or rude, he’s merely trying to lookout for the property he’s responsible for; doubtful that everyone who shows up there has your level of skill/experience, and easy to see how a simple mishap could quickly turn into damage. I do have to applaud you both for handling the situation calmly; too often things unnecessarily escalate where common ground cannot be found. Regardless, thanks for posting this! I wish you well.

      Kris B boats can reverse, that is %100 navigable water, as he can go in and back his boat back out. More than a foot of water either side, no risk of damaging the docks. People think because the have property near something then they have a say in who or what goes on there, you do not

    I’m 100% for fishing rights but many fishermen aren’t sportsmen. They do private property damage and don’t give a crap. I’ve been a hunter/fisherman all my life and I’ve seen firsthand how badly some people treat other people’s private property.

      What would he do if someone pulled in behind him in a bigger boat and someone pulled in from the other end and they started fishing and dude here needed to get out because he had to pick his wife up at the airport and the people blocking him and told him they’re not moving until they get done fishing.     Had a somewhat similar incident happen to me as well in September last year. Fishing public waters, minding our own business, when a woman tried to get us to leave. Lied to us claiming it was private property, threatened to call the police on me, etc. Did my best to handle it as civil as possible. Can't give these people an inch or they'll take a foot. 100% support you for standing your ground and not giving in to this guy. I got a LOT of heat for that video though, but thankfully, I got more support than I did negative feedback. Hopefully your video doesn't get shared on a large local forum full of pleasure boaters for that body of water, or the dislike explosion will hit you too, lol.

      There comes a time and place where a human has to stand up for their rights. My state, the citizens own the water. Even if it's on private property. In theory, you could helicopter onto a pond and fish, legally, expect perhaps for FAA regs, which I don't know.
      I got into it with a woman for fishing in front of her house & dock. I gave my standard reply, which was "If you think I'm breaking the law, call the police." She continued on her rant and my backseater tried to reason with her. Finally, she said "You just don't know what goes on around here1" To which I said "I do, I do! I know what goes on around here!"     Not sure what authority the harbor master has but why would someone drive 14 hours to fish someplace where they are knowingly going to be harassed? You cant make a rule saying only people who know they can control their boat and act responsibly or are just as cool as me can bring their boat in here. No logic to that argument. Just has to be a blanket rule regarding the safety of everyone and the surrounding infrastructure. The entire situation just seems a ridiculous waste of time and energy.

      I don't get it either. Yes there are fish there. Great. Just looks like a dick move to fit between the dock and rocks but I don't fish that much so you win. You know the law and fish away

    It’s a fine line. I live on a confluence of a creek and a river. I own the 160 acres of pasture land directly upstream on the creek of that confluence. I run into a lot of dumbasses that consider the creek to be navigable just because it connects to the river. 200 yards upstream from the confluence is an old railroad bridge with 100 years worth of gnarled tree trunks and sandbars that make the creek impassable by any measure. Idiots will take their boats up that stream, get tangled up, then trespass on foot across 1/2 mile of my land, use my pasture gate to get back to their mired boat with a pickup, tear the fuck out of my pasture fence to get to the creek bank, then use their vehicles to get their boat dragged back into “the navigable” channel that got them there. Yet, somehow, I’m the asshole when I mention to them that it’s not a good idea to go upstream from the confluence.

    You should turn the tables on him and where I’m from there’s a specific law against harassing fisherman that’s in Ontario you might have that law in the states

    At that point when he says he doesn't want you there it's not safe, just say thank you for your concern have a good day! After that you don't have to socialize with them. I just ignore them and if they want to call cops, so be it.

    I'm usually THAT GUY that's screaming about boater & fisherman's rights. However I'm also THAT GUY that's screaming about fishing etiquette & common courtesy. Unfortunately not every fisherman is as trust worthy as you are and for every honest fisherman like yourself there are 3 that aren't. I'd bet at least 8 out of every 10 people that have had a boat in a marina slip for any extended period of time would prefer someone like this guy who's being proactive instead of reactive. If you ask anyone that's had their house boat vandalized and property stolen and it would be 10 out of 10. So in that regard I applaud the dude at the marina for keeping an eye out for his customers. I applaud him even more for the politeness he demonstrated towards you while addressing the issue. I've had this same scenario happen to me on a few occasions thruout the years and not once was I treated or spoken to as politely as you were in this video. I was even shot at in one instance. An older gentlemen was just kind of standing on the bank next to the dock we were fishing. He kind of showed up out of nowhere, then proceeded in vibrantly telling us we were not allowed to fish around his dock & it was private property. I was in the process of trying to start up the boat and I told him, I'm sorry sir, we will get out of here & try our luck elsewhere. The guy fishing with me didn't handle the situation as well as I did and proceeded to tell the old guy he didn't own Taylorsville Lake. As soon as I heard the gunshot I
    pushed the accelerator as far forward as it would go and my friend went from the nose of the boat down to the floor, he still had his pole in his hand. I told him just to stay down til we got out of there & to hold on. He said he had always wanted to go trolling for white bass but that wasn't what he had in mind. There's no fish worth dying for. We were apparently just one boat out of countless others that had run-ins with that man. A few years later he was in a similar situation to the one we had with him & the people in the boat shot & killed him over it. So I do understand where you are coming from and I think your intentions behind this video were sincere and heartfelt. However your actions in addressing this situation will end up causing more harm than good. Causing a confrontation was the sole reason you chose to fish & record at this particular spot. You indicated that on all 4 of your previous attempts (over a 4 year period) to fish at that location were met with resistance & verbal confrontation. Even if every word you said in the video was 100% correct (which definitely is not the case), why would you go there with the sole intent of causing a conflict? Why...? Right or wrong, why would you would rather cause a conflict & engage in a confrontation over a small 8 foot wide 50 foot long narrow stretch of water when you have the rest of the lake to fish in? Why couldn't you be the bigger person and look at things from their point of view instead of being so self centered? It doesn't happen often, but if you do find yourself in a situation where someone doesn't want you fishing around their property, regardless of who's right & who's wrong, just tip your hat to them, wish them a good day & move on to one of the other 5 trillion spots to fish elsewhere on the lake. An uneducated person will see this video & take what you were saying to heart, and when they are faced with a similar situation challenging their interpretation of what constitutes navigable waterways, THEIR OPINION could get them killed. Where's your common sense? Wife or girlfriend, religion, politics, home & property..... name the top 5 things that cause men to think irrationally and act out violently. People don't always think or act as level headed as the man asking you to leave in the video, you were lucky he was so polite. You might not be as lucky the next time you offer up one of those, well... that's just like your opinion... man... OR ahhhh yeahhhh, I'm not moving I'm gonna fish here anyway. You are very well spoken and I enjoy watching your all of your clips, I just feel that you've missed the boat (again I'm sorry for the poor attempt at word play) on this one. No fish is worth dying over man. How about next year before you go up there to fish in that spot for the 6th time in 6 years, you swing by & pickup a Wisconsin wildlife officer & let them fish all day with ya. That way when you do your annual piss off those people at the marina thing, you'll be extra prepared. In Wisconsin it's not a navigable waterway if the vessel in question is blocking the property owners direct line of sight of their property. Also any marina walkway that has one end that connects to land is no different than a bridge and the guidelines and restrictions for both are treated the same. For it to be a navigable waterway a vessel must be able to operate underneath a bridge freely without obstruction. Even tho it's bad ass, I highly doubt you could drive your boat underneath the marina walkway that's pictured in that video. Right or wrong, be the better person & find another spot on the lake to fish. I doubt causing conflict is why you fish. The worst day at the lake fishing is better than the best day ever at work. The more time you spend arguing the more time you lose fishing.

    I was bass fishing in a lake in Central Florida and went into a little "weed cove" (that's where cattails surround an area of beach) and had a guy come down to the bank SCREAMING at me that I had to leave, that was private property, etc. I just stopped fishing for a minute and "schooled" him on the law. He said that he was going to call the law and that he was "sick and tired of people coming into 'my' part of the lake and throwing trash into the water". I asked him if he had seen me throwing trash into the water and he said, "NO, but a lot of people do!" I then told him that I hadn't and wouldn't and that I was going to move on down and leave "his" area and I did.
    He didn't know that I was a pastor and knew his next door neighbors quite well. I pastor their son, who is also a fisherman. I left there and went over to the next dock of my friends and saw the Mom in the yard. I pulled up to the shore, called for the lady, she recognized me and came down to the water. She gave me a hug and I told her what happened with her neighbor, laughing. As we were talking, the guy saw that I knew her and he came over, rather sheepishly, and very apologetic, especially when she told him I was her son's pastor!! I just love pulling that "pastor card", it makes a lot of people scared I'm going to call fire down from Heaven or something! LOL! I did take the time to tell him that he needs to be careful about doing things like that because I know of a lot of fishermen who carry PISTOLS in their boats and will shoot people!! Some people take it that seriously. We talked a few more minutes, shook hands and he apologized AGAIN.

    It was navigable water for the guy in the video, but many people wouldn't be able to do it without bouncing off the docks and rocks (myself included). I'm a kayak guy, so it was obviously navigable for me. In a fishing boat, I believe it would be a different story depending on the driver. I'm on the fence for who was right here. Unfortunately, the harbor master has probably seen a lot of other people going down there that shouldn't. It's another case where a few bad apples ruin it for everyone else probably.
