What Is A 501(c)(6) Nonprofit Organization?

  • Many people are not aware there are nonprofits organized as a 501(c)(6), at least not enough to recognize them for what they are. The 501(c)(3) charitable nonprofit is so engrained in their consciousness, they don’t realize there are other categories. We touched briefly on this in a recent article and video on 501(c)(4) groups. Today’s video takes a look at 501(c)(6) trade associations.

    Can you cover the importance of 501 (C) (6) bylaws? I would like to hear more on this particular category as I serve as a Chamber Board Member. Your videos have been very helpful.

    Hey Greg, Again great video!!! And I think Labor Unions would be 501(c)5 organizations ??? And believe it or NOT, I represented a number of foreign embassies and their national defense companies in Washington DC as a 501(c)6 organization.

      Yes, labor unions qualify under 501(c)(5). Interesting example of 501(c)(6) groups, for sure!

    Im creating a cooperative for the homestead poultry industry. There will be a free user store, a duscounted member store, as well as individuals to be able to develop their own store, but the main focus of the member site is to provide a directory listing, education and business resources and marketing material. Members also have the ability to profit through an affiliate program.
    I would assume one could create the corporation in any state (LLC) to get their EIN prior to filing for the 501c6. Are there boiler plate bylaws available online or should this be a more thorough investment with paid for assistance?

      We wouldn't recommend an LLC structure for a 501c6. Given the complexities of what's involved in getting any tax-exempt organization off the ground, we do not advise founders to do this on your own. Way too easy to make mistakes that can come back to bite you. Let us know if you need help. We've got nearly 30 years of experience helping set up new organizations. It pays to work with someone who knows this process inside and out.

    So, if i wanted to create a nonprofit Point of Sale company, this would be a good idea? Since my goal is to help better restaurants, especially Mom & Pop stores.

      I don't think that would work. A 501c6 is prohibited from providing a commercial equivalent service for fee.

      @@FoundationGroup Well, the idea is to give away the software, and charge a small fee per terminal each month to provide services like online ordering, cyber security, and full time tech support.
      The service fee is to pay employees & services we'd pay for like hosting, etc.

    The EIN process is so difficult with 501c6. Which category? It does not mention it on the IRS website. Which category do I select?
    Also, the form 1024 I fill out says I need an EIN, but the EIN says I need a corporation…. So do I need to get the chamber incorporated and then get an EIN and then apply for 501c6?

      An EIN is the identifier of all business entities. You cannot apply for 501c6 status without one. Also, you don't HAVE to be a corporation, but I highly recommend it. The order of process is usually incorporate, apply for your EIN, then apply for 501c6 status. The EIN application category is usually "Other". Get with our team if you need assistance. It's probably worth the cost to you.

    Do you have any information on a 501c5?

      We don't currently have any 501(c)(5) content available, but we may do that in the future. 501(c)(5) is sort of a catch-all category, covering everything from agricultural nonprofits to labor unions...very diverse category. But also not that many organizations nationally that fall into it, at not percentage-wise.
