      It would be futile... shell companies fold under no pressure and can easily pop back up under a new name. There is no cash flow within the shell company as it would be drained by the time of the law suit, meaning google would be spending time and resources without any compensation.

      Seems to me if enough developers quit using the Google Play store citing these attacks, Google would come on board. Until it costs them, they won't and don't care.

      Legal racketeering. I worked for a company that went under for this very same issue. The lawyer bills broke the bank for them. 7 years millions of dollars.

    Austin, been a supporter of X-Plane since I got my first copy in the early 2000s of X-Plane 6. Hell if I can remember how many CDs it came on, it was a lot with all the land files. Keep up the good fight, I can't wait until X-Plane 11.

      1) there are lawyers and judges who benefit from this
      2) there are lawmakers (aka politicians) who benefit from this (so they have reasons not to change any appicable laws)
      Name them, shame them, shout about it and make it publicly known. In the meantime, perhaps, help crowdfund defence against these practices and in the end, hopefully, the law(s) will be changed because of pure pressure from the people and these practices will stop.

    My thought on solving the patent troll problem would be file a patent for the litigation process used by the trolls and sue their asses for infringement every time a patent suit is filed by entity

    Counter sue uni lock for an unlawful accusation. 1 billion dollars for lost revenue and on going harassment. I won a trial in the past and 6 months later my lawyer told me we should sue them for the above, so we did and won. Wasn't a huge case but non the less I stuck it to them haha. Got to luv the "system" people use it to take advantage of others than just turn it around and throw it back in their face.

      There's nothing to sue for. They produce no goods and their earnings are dispersed to owners as soon as the proceeds from the suit have been received.

      They have a lawful patent. They not only have a right, but a duty to defend it. These guys likely bought the patent because it is something that never should have been approved and with hundreds of different things inside it, it would take billions to fight the whole thing. Its a loophole in the system that just makes innovation and owning a small business that much harder

      @@BonanzaPilot It's so intriguing that the patent and trademark office can essentially create out of thin air the method for transferring wealth in such a dubious way. It is not as if the "inventor" of this patent did anything useful for society which patents are there to protect, but they were admittedly very clever in their wording of the patent. The patent was resurrected so many years later and applied to the App store, something that wasn't really a thing back in 2001 before widespread high speed internet use. And it's all so fascinating and useless. Those folks all could be contributing to the economy but they are leeching off a patent that was never put to use and too vague to ever be describing original innovation in the first place. You could even argue that with modern databases you are not looking up "a name" but actually the UTF-8 representation of a name, first by a hash match, and then a comparison. Maybe I could patent that and get rich!!! oh wait I have morals and ethics and will actually positively contribute to society.

    What also screws these companies is that if they do settle they also sign a non disclosure so they can’t even report or warn others. Fair play to this guy for standing up to them. Keep an eye out for his hour long film on this. Very good and a worthy watch.

    Outrageous. Maybe you should sue the patent office for not performing due diligence. In the UK, many years ago a patent was once issued to an Italian washing-machine manufacturer (Zanussi) for what boiled down to a potentiometer! That got rescinded when challenged.

    Why don't your lawyers simply ask them to prove what they're saying?
    Show an actual instance where Google is violating their "patent". I betcha they couldn't get the warrant against google to open up their vaults of info and actually prove that what they say is happening actually is happening.
    Then sue them for frivolous lawsuits.

I hope that one day you and all the other business owners that won't take one lying down are vindicated and the trolls have to pay all your fees plus some penalties.     The US patent / legal system sounds like a real Mickey Mouse gong show. At least just about everywhere else you could at least counter sue for incurred legal costs if they lose.

    Why are Google allowing this to happen?
    Google have the legal resources to stop this issue dead, or at the very least severely curtail the willingness of these patent trolls to attempt it again in the future.
    It's not good for Google's business to ignore this since they are reliant on people developing third party apps for their store.

      These patent trolls successfully file lawsuits against huge companies all the time. Intel, Apple, Dell and HP are among the victims. Apart from being able to buy your way out by agreeing to settle there really isnt that much that money and power changes in this situation.
      This one particular patent-racket that Austin Meyer fell victim to consisted of two judges and their lawyer sons. Whenever a case actually goes to court there and they do lose, the judges do not make their family patent trolls pay the defendants legal fees, so there you go: they have nothing to lose.

    this is crazy! In ISRAEL if someone or some entity is filing more then a certain number of lawsuits a year, he/she is being considered as a "serial sewer", and then, if they submit a lawsuit, the court will force them to deposit into a special account a sum of money equal to, or proportional to the defense cost of the other side. this deposit will not be returned if they loose... this is very effective! and its only a simple law, no need for drastic changes...

    Man, i'm a Computer Scientist, and i have recently been doing some research about patents,
    and i have found out that more Software Patents are filed every year, than any other kind of patents.
    And most of the software patents are held by either patent trolls, or major companies,
    so it's so freaking hard to make new innovations to the software industry, like a new application, or a new digital product, to better assist humanity, because some dickhead somewhere will be waiting for a new innovation to file a lawsuit upon.
    I'm literally scared to build any apps now, i don't want to go through courts and waste time in lawsuits, i just want to code and make stuff. Not be worried about all this other crap.

    Thank you for standing your ground I thank our Founder Fathers and Vets would thank you and I hope it's possible for you and the others to band together and find out and post the name of the people suing you and help put an end to It.
    One thing for sure one day all flight schools will use a Flight - Sim in there training and I think it's possible for students to land the aircraft on there first flight using a Flight Sim and ground training device like a Rat, As a piloti see the advance in using a product in training or to improve skills
    Good luck and who knows you may come up with a low cost well build flight set up that will be in all flight schools like others did building computers at home and now make millions each day.
    I have never look at X -Plane buy just from your work in the other video it must rock

      @@davejesse949 it's your government which issues the patent since a US patent is not valid in the UK. Should you infringe on a patent registered in the UK, the person whose patent it is, not their government, has a right to sue you.

For example, the use of red/orange/green color coding for the importance of a message. This was deemed novel by the US patent office in 2000.

      @@davejesse949 In order for you to infringe on a US patent from outside the US when selling to non US customers, the US patent must have been registered with the UK patent office. USPTO's patents cannot be enforced in the UK unless the patent is registered in the UK.

    I don't understand law ... but shouldn't it be possible to "undo" patents, which were vague, and prosecute those who made it a patent? I think that patents should be reviewed by experts in the field and these experts should carry the responsibility for their work.

      Maybe not prosecute but if the patent trolls are found to be aggressive as hell on meaningless patents (I especially LOVE the fact that they're going for smaller businesses and not Apple or Google, who would fuck them up), they NEED to be punished with super high fees going towards the defendant.

    Austin you're the best. Best flight sim available :) You own your work. I've watched it develop since at least version 6 or 7. So happy with 11... and can't wait til my PC has a graphics card with at least 1 GB of VRAM so it'll run over 15 fps lol, since that makes my flights take up to twice as long as normal. Now we have the best payware aircraft even for airliners, in my opinion. The Rotate MD-80, the IXEG aircraft, ..so many. Take care of yourself. Also, someday it'd be cool to have an ATC similar to FSX or something but my big wish right now is 1) Seasons in X-Plane 11 by default and 2) a fix for people with slower older PCs like me to prevent the clouds from lagging the FPS as much. No complaints.. that stuff's on me (what hardware I have).

    If their patent was filed in 2001, it should be void this year correct me if I am wrong? It's either 20 or 25 years utility patents expire if I remember correctly.

    I watch The Patent Scam today. I cried and prayed for the victims. I cannot believe that the senate wouldn't pass a policy to fix this. My God pass judgment on all those involved in the scam.

      Not one tear would be shed by ANYONE if those responsible for this were to go through the worst torture imaginable publicly. They are the antithesis of what America is about. Samsung built an ice rink in front of the court in the east texas court where the judges facilitating this extreme waste of people's lives and money reside. I can't fu&king believe it. This needs to stop swiftly with those responsible serving time in MaxiSec, and that's a soft punishment IMHO.

One doesn't have to do those things of course to be useful in life (i did word it too strongly), but using that as an excuse to not do those things is ridiculous and sounds like an excuse for something you don't want to do for other reasons (which is perfectly fine to not want to do)

I work in creative industries that suffer from rampant parasitism by the uncreative, much like patent trolls. My attitude has a basis and while it's not pretty, there it is.

      hourly legal fees. a good corporate lawyer is at least $1000/hour (sometimes $2k or $3k) - so it's just a year or less of work

    This is everyones problem, not just his.We loose a great product or pay triple for it and the criminals continue to grow and spread more corruption. Sadly, the problem is from the top down.

      It is decided by the judge but the judge has a conflict of interest considering the people suing and representing are his children and their friends.

    This is a criticism of the PTO, not the Article III judicial system. I am afraid you didn't beat the Patent Trolls in court, you made a collateral attack through the executive branch which issues the patent. Of course, patents should be harder to get, but that is the PTO's fault for giving them out so blithely, and apparently making it difficult and expensive to correct their mistakes.

    Proof that the American Patent system is very badly broken. And why don't the Patent office use some common sense before issuing patents on something that is so obviously not an original idea, in other words do their jobs properly? Back in the 80's computers were used to look up people on lists. its so obvious it should not need to be said. It's not just the patent owners that are to blame here!

    A PATENT HAS TO BE NEW AND USEFUL. SHOW THAT ALL CLAIMS ARE NOT NEW AND USEFUL BUT HAVE ALREADY BEEN CREATED AND HAVE THE WHOLE PATENT TO BE VOIDED. THIS SHOULD BE THE JOB OF THE PATENT OFFICE. ONE CAN FILE A LAWSUIT FOR ALMOST ANYTHING. YOU SHOULD HAVE THE RIGHT NOW TO HAVE THE PATENT OFFICE CONFIRM TO YOU THAT THIS PATENT COMPLIES WITH 35 USC AND IS VALID. CAN YOU CHALLENGE THE VALIDITY OF THE PATENT TO THE PATENT OFFICE. NO PATENT NO LAWSUIT.

    Hi, as an citizen of the U.K. I can't for the life of me think why the small business people do not All get together on this and pole Google. Apple. Microsoft and any other company out there about how they are going to sort out this stupid dilemma, I don't mean just by email but by telephone as well. If these big companies end up having their phone lines and email addresses blocked They may get off their backsides and do something about this nonsense and help the little guy out there After all they were once the little guysAll the best to all you people in the US of A

    Just out of curiosity mr. Meyer..Is www.uniloc.com/ Uniloc's website? Because I'm telling you that website is dodgy as hell. I'm a QA Engineer, so I'm used to look at not just Java-code, but javascript and html. That website has tons of stuff hidden away in the HTML. Including statements like:
    "
