    I uncovered the fact the MK Access road does not exist on the land records as an official road entity. Someone in the past had paved over a path over the Homelands up the mountain, however a road easement, transfer or setback was never created, to make this a real public road separate from Homelands. Therefore the Senator is absolutely correct that road is just asphalt sitting on top of private Homelands property. DHHL and/or the trust beneficiaries have just as much right to sit upon and live upon that asphalt as anywhere else on Homelands property, and they can fully control who can access the road and any other part of this property.

      Homelands owns miles along the N side of Daniel Inouye Hwy. The only way around it, is build a new road from somewhere near the MK State Park, several miles long up the slope to near the Visitor's Center. Would TMT pay for that? Not to mention new EIS studies, protests, etc. Just throw in the towel and go to Canary Islands. Jeez.

    According to National and International law, Government's oath is to act according to the rule of law; and protection of the people's rights. Human rights violations are war crimes (in this instance for Mauna Kea); regarding the Native Tennant Rights with the people and sacred lands.

    Even if there might be one road owner, multiple governments could exercise jurisdiction concurrently over road construction, improvements, and maintenance projects in Homeland communities. Consequently, multiple and competing laws regarding contract negotiations and employee rights could come into play.🇺🇸🇺🇸
    Formal disclosure of this issue is publicly necessary,. Especially before enforcement attempts any firm posture in reattempting to force , open road status .
    However reasonable past compensated value may have distinctively changed . This may allow negotiations , but only contingent to an open public road as utility throughway . Road improvements have been made also factor in .
    That allows by default assess to TMT equipment

    Sonthey built a road on land they do jot own or had permission to build... guess what you just lost ownership of the road. He is talking about access by “prescription”. But that does not give them the right to control it the hawaiian homelands controls it and can allow DOT access but DOT cannot own it or control it. The 1970’s Realestate term only applies to US law not hawaiian law

    The road follows the path of the old Kalaieha or Humu'ula Trail, a trail that has existed since the days of the Kingdom. It appears on Alexander's 1892 map. As such it remains a traditional public right of way no matter who's land it crosses.
    This trail and later road would be subject to the Highways Act of 1892 signed by Queen Liliuokalani and then encoded into Hawaii State law under chapter 264-1(b), Hawaii Revised Statutes (HRS) . It remains a public road despite Senator Kahele's attempts to say otherwise.

    Not building TMT on Maunakea will not restore the Hawaiian Kingdom, will not resolve the Treaty of Annexation issues. Not building TMT will take away educational opportunities from generations of Native Hawaiians, jobs & careers as well. Native Hawaiians need to be empowered. TMT will help with this if the Hawaiians want it. Many have spoken and most want TMT. What have TMT opponents / protesters offered to their OWN people as far as education and much needed jobs to the local community if TMT is NOT built. NOTHING, NOT A DAMN THING. NOTHING

      What an ignorant comment! This issue has raised the consciousness of the native Hawaiian and all indigenous people around the world. Yes, it will ultimately be the catalyst which removes the illegal occupation of Hawaii, and restoration of the last true democratic Hawaiian State. This is far more important than a telescope, which BTW can do its research just as well on Canary Islands. Regarding education, that is done by the school systems, not telescope corporations. LOL. And you can be sure 99% of the good jobs TMT will go to experienced rsesearchers and technicians from OUTSIDE of Hawaii.

      I dunno don’t you think this is counterproductive?
      Don’t you think we need all the economic benefits we can get?
      You do know that Hawaii’s economy is not self sustaining right?
      If the military alone left Hawaii it’s over for us. Tourists would stop coming because of the lack of security with no military presence. Agriculture would fall next because who would send their ships to pick up cargo with no Coast Guard and naval security.
      Anyways to answer your question we as citizens can organize and petition the federal govt to observe the situation and determine if federal law enforcement is needed being that local and state police seem to be in conflict of interest situation to protect the rights of others. Like I said it’s as much my road as it is anyone else’s and my right to use that road is being denied. To give certain people preferential privileges is discriminatory to others.
      This is the United States of America....
      More than 3000 Americans died defending this state in a single day.
      Most Native Hawaiian warriors died fighting eachother.
