- The City of Phoenix is being sued for failing to produce records about elected officials’ communications with the police union about the Department of Justice investigation. Ken Chapman, a community organizer and police violence activist, filed the lawsuit.

Just think about it you have to file a lawsuits to force law enforcement to follow the law
And it only works to make them follow that law at that time. Someone else might have to sue to make them follow the same law later.

Withholding public records is absolute proof positive that you are dealing with a criminal organization under the guise of law enforcement. You have to deal with the Phoenix police like you do with any other felons.... Threats and prison time.

The city is undoubtedly worried about lawsuits, and they should be. The DOJ has the cases and if the DOJ believes violations occurred, that would bolster people that were wronged to sue. While many cities have insurance that pays liability in lawsuits, like all insurance, there are deductibles that the city (meaning the taxpayers) pay. Also, there are caps to how much they will pay out per incident.
All News Organization in the area should join that lawsuit.
I highly doubt they will mainstream media are the propaganda and cover up voices for police departments otherwise they would of requested those documents long ago.

This police department has gone rogue.
This is not unusual in law enforcement at any level, even a judge to lie,. Some state police do not have body cameras, and I can assure you that is troubling because it’s your word against them and who is the court going to believe? People lie, they make mistakes they see things differently and two people 30 feet apart can see an incident in a different way.. Police officers lie, defendants lie, but the video from the body camera or an iPhone for example and don’t forget ring doorbell, cameras, and surveillance video from businesses always tell a different story. The only thing they can do is withhold public information hoping you will go away. Amazingly eyewitness, a magistrates hearing where a man was charged with disorderly conduct and fighting with first responders. The state police claimed they had in car video and audio of the incident. I observed them completely ignoring the charges because they weren’t approvable and they were lying and they didn’t bring the dash cam video they claimed they had them. The magistrate had to explain to them, the Pennsylvania constitution and the constitution of the United States and what the first amendment means.

Any attorney working with a government agency helping to withhold records can have an ethics complaint filed with the state bar.
I'm way over in VA, but am very familiar with Dave Biscobing (sp?) He's a TRUE investigative journalist who speaks truth to power! The closest we have to him is Jody Barr in Charlotte, NC! They need to be cloned and scattered all over this country! EVERYBODY needs a Dave and Jody.

Get the law changed to 30 days to supply ALL records or go to jail. Conviction will result in being unable to work for the city in any capacity ever again.
I’m not surprised by their actions! Law enforcement believes they are above the law. There is no repercussion to their actions!
We don't really have laws in the US. We have SOME laws, but the term must include a requirement or a prohibition ALONG with a predicate penalty. Open records requests (foia's) and the majority of constitutional 'laws' have no predicate penalties.
So if you violate my free-speech, then there's no mechanism for enforcement -- same with open records.
Until that is fixed, by passing something like a safety-net regulation where any legislative verbiage missing mechanisms like those all fall under something like "five year prison mandatory or two million dollar fine" in order to force those in power to fix the legislation.
Those taking active steps to not have records should be jailed for conspiracy.

Well, when you got the whole department that is corrupt, I guess the only thing you can do is deny deny deny… if everybody had all the records, they practically all lose their job so I guess you could go by each department fire groups of 5 to 8 and put new in there until you get the whole place redone

It is sad that government actors supported by the tax base will now use tax dollars to employ outside attorneys to defend their anti-transparency actions. Average citizens most of the time do not have the resources to question and fight public records holders. For this news story, did you reach out to the Ombudsman-Citizens’ Aide Office for their comment? I thought that is what the staff attorneys in this office were paid (again by tax dollars) to resolve when there were problems with having a public record's request denied or go unanswered, they were the first line of defense. It seems all government actors and law enforcement, including outside council, the judge hearing the case, the court reporter, the courtroom itself, even the toilet paper in the courthouse restrooms are funded by taxpayers. Even a settlement (if there is one requested in this lawsuit) is either paid for by taxpayers directly or indemnified by a taxpayer funded insurance policy. Only the resources and activism by Mr. Chapman and his community are not funded from the taxpayers.

In USA the Legislative branch makes the laws. Police are members of the Executive branch.
