I went to the ER once because I had moved to a new state, gotten new insurance and couldn't find a primary care doctor who accepted my insurance and was taking new patients. So I ran out of my prescription medication which included pain medication. So I went to the ER to see if they could help me because I was in a lot of pain. They told me they couldn't help. Then they asked me if I was going to harm myself if I left, and I told them Yes because I was in serious pain and had not been able to sleep because of it for days. So I got to stay and they actually gave me the medication I needed. It was worth being in the psych ward just for that.
quick correction: they wont give a 5150 for suicidal thoughts, theyll give it for suicidal ideation or intent. just thinking about it doesnt make you at-risk. but often patients will indicate having a plan. the plan is what gets you considered at-risk.
They also want to know if you have taken any steps towards preparing for your plan. Are you an active danger to yourself or others? Not at the moment. Also if they cannot evaluate you within the 72 hours or determine more time is needed to get you on a functional medication regimen that 72 hour 5150 (California Health Code) can become a 5250 which is a 14 day hold. If you appeal your 5250 it can be 6 days before your appeal is heard so plan on being there a week at least.
@@tfodthogtmfof7644 good addition! ill add onto that that weekends typically dont count for these things in most states, so usually, unless youre hospitalized on monday or tuesday, a 72 hour hold lasts 5 days (well technically 4 days if you come in on a sunday but whatever)
My mom said she didn’t want to live during a dr visit. She didn’t have a plan, it was Ahlziemers. They called in a prevention team and also called me to pick her up. So try not to give incorrect info.
@@oakmaiden2133 saying you dont want to live isnt the same thing as saying "ive been thinking about suicide". ive had many psychiatrists, er doctors, etc across two different states tell me that there is a distinction made between suicidal thoughts and suicidal ideation. just having the thoughts won't do it. thinking of those thoughts as desireable as in "i want to die" is a different thing altogether and WILL prompt psych eval and 72 hr hold
I've been taken in for ideation/had taken some pills but what was left in the bottle wasn't enough to do the job. They sent me out a few hours later with a list of numbers that over half of haven't worked since before covid. So it's really up to whoever your talking to and their assumptions (for reference I'm in Portland Oregon and it was a religious hospital)
As a janitor I always felt so sorry for 5150s they were usually for patients that were waiting for a room to go somewhere better but instead they were stuck in a small room with a stranger watching them without anything in their room at the er. We had to take out cords, hand sanitizers, and even the sheets.
Lots of patients still leave AMA. Frustratingly, they also come back. Best excuse I ever heard was “I just gotta move my truck.” Yeah, and hit some meth.
Had a breakdown while pregnant at work in the hospital lab. Husband picked me up after chrisis told me to report to the ''closest''. No, ma'am, respectfully, I am not reporting to my work and also there's a hospital an hr north that is much better to get admitted via the ED to the unit rather than getting transferred. I was not about to deal with ED for what realistically ends up being closer to 80ish hours.
The emergency room in Kentucky tried to keep me, but I put the fear of me in them and walked out. It was just a bike wreck, and I was walking just fine. 😊
Ive placed many 5150s or form 1s on patients coming to the ER. The USA has vha ged from when i worked there and many previous 5150s go to jail because those states have downsized psych beds, and the drug induced behaviours seem to go detox at jail.
As a cop I don't understand the one with the knife. It is not illegal to hold the knife. There is so much context and nuance needed to make this anything. Are you holding a knife in the kitchen? How was this unusual? Did they make threats of hurting others or self-harm? Are they amped up? Are they pointing it at you? Aggressively or casually? Or are they cutting a sandwich?
72 hour stay in the pysch ward after an attempt. I still get nightmares about that feeling of being trapped, in there- those nurses and doctors stopped seeing us as human a long time ago
Unless of course you’re in the Bay Area. I’ve never heard of anyone being held for a full 72 hours, it’s usually less than 12. However, they’re usually back in a few days. This can go on for weeks, since there’s no long term mental health support available.
What/whose information are you basing these claims on? There are many behavioral hospitals all around the Bay Area (but due to the large population and lack of social services that help people outside of hospitals we could always use more). Unless someone is on a voluntary hold it’s 72 hours, usually it’s extended to two weeks (a 5250).

You can recommend them but until SB 402 is enacted they would be evaluated by the mental health professionals at the hospital or crisis center and if they determine the hold is unnecessary then, yes, they can release the patient.

And if you’ve had previous bad ER experiences, they may decide to quarantine you for COVID-19 symptoms…. showing no signs, and not leaving the country or being around anyone who has is still no reason. TEXAS HEALTH in BEDFORD, TX pulled this on me! Then their phlebotomist trainee jammed a needle nearly thru my left forearm for a pic line! Ohhhh, the memories! Getting any legal help or filing with the Texas medical board is a waste of time.

It’s the code numbers for an immediate mandatory psychiatric evaluation. If you plan on harming yourself or another person or if the another person perceives it as a threat of imminent danger, they hold you at the ER for 72 hours. If the threat is mediated through counseling and/or medication intervention, then the patient is free to go after a thorough evaluation of deescalating the situation. Sometimes it’s 12-24 hours, other times, if it’s more severe then it’s 72 hours.

Every state has there own law. Florida's is called Baker act. 5150 is a generic term from California. Form 1 is the international term for the 72hr hold. So names state, province have laws providing the same protection for those who are risk to self, others, or not mentally competent to be released. Yes a Psychiatrist can release earlier if the problem was drug related.
Well, you can try that. But ERs have security guards, injectable sedatives, and often some pretty burly male nurses and CNA’s. So, if you become threatening, maybe they’ll let you leave. But then again, depending upon the situation, maybe not. And they can and will file assault charges against you. Usually it doesn’t get that dramatic, though. For medical, not psychiatric care: What they will require is that you sign an AMA; a statement that you are refusing medical care, and leaving Against Medical Advice. Which means that if you leave and croak, or lose your leg or something, neither you nor your family can hold the hospital or its employees liable for failing to provide medical care. Big mean drunk guys can be scary. But lawyers are scarier.
I've managed to convince them that I'm leaving and willing to go through them if they force the issue. They've always decided if wasn't worth risk. It's never been a psychiatric hold though. Only ever had to force the issue a few times.
Worked in In-pt Acute Mental Care with a specialty in Addiction Medicine. If we say you stay, you stay. 20 trained hospital staff and police if needed, will help you walk to the seclusion room, remove your clothes and personal belongings, and if you decide to fight us, Mr. JABBY JAB comes out to play in your hip muscle and leaves you passed out on a mattress on the floor in a paper gown. If someone gets hurt because of your actions, you will be charged. The only way to get out is to follow the rules, say a little sorry, and you can come back out and play. If you decide you like the time in seclusion, and keep ending back there, your form becomes a two week form, then if you really like your accommodations, you get to stay for another full month. Most people "get it" and start taking meds and attending some therapy so they can get released without losing their drivers license, jobs, or family. But yeah, you keep telling people it goes your way.
The more you take the less I have to loose. Again I've never been to the psychiatric side. The ER side is a different place. I just let them know what the cost will be in a calm but very resolute manner. Never had them force the fight yet. Been very close though.

I disagree with you. I've had psych evaluations many times. I also have various mental health problems. But I've learnt to see it in a lighthearted way. I found my sense of humour. You should try it 😉👍🏻♥️
@erineddy7999 but help may be being held until the danger of self harm or harm to others has passed. It's simply a stay in hospital, not incarceration. If ypu don't intend self harm, or plan to harm others why say it then? Oh because you aren't in control of yourself..thus a danger.

They absolutely kicked me out the same night and on some pills that made me want to REALLY off myself
I ask people all the time if they know what a 51/50 is. 90% of the time, they don’t
I got 5150 and spent five days in a padded room, restrained in the bed. No fun

5150 is the California code for involuntary commitment. In Alaska it's Title 47 (AS47.37.180 for drugs or alcohol).
