Philadephia police do NOT seize properties. There were uniformed police escorting a D.A’s office. PPD are NOT permitted to remove people from their homes. Hell, PPD cannot remove squatters!! The evicting office must show up with warrant/eviction.PPD don’t carry tools to break down doors or locks. PPD just makes sure seizing department and tenants stay safe. This is video is misleading and the homeowners are reporting incorrect. The same rules apply with evictions in assisting the sheriff’s department. Reports like these are misleading for the misinformed.

In that case it was a $42,000 pickup bought with an inheritance vs. drug charges witha $10,000 statutory maximum fine (he got hooked on opiates after a legal pain med prescription and then did some petty sales after things spiraled out of control). This is for an entire house for an even smaller offense. Let's hope this gets shutdown harpd. Notice both liberal and conservative justices agreed. For the record, the late Chief Justice William Rehnquist, a leading conservative judge, is the one who opened the floodgates for civil forfeiture abuse. The Supreme Court has ruled that a seizure cannot be disproportionate to the actual crime committed. If a $40 sale of heroin is a $1000 fine, let's say, they cannot seize a $200,000 home. This is the law now so hopefully this has stopped the Philadelphia ("City of Brotherly Love") police from seizing these assets. But I wouldn't put it past them to try to find some loophole, no matter how trivial, to keep doing what they're doing.

The truth is that we resolve most of our real estate forfeiture actions by agreement, just as we are doing here, and we have been doing that since long before this lawsuit was filed. We do it because the purpose of the forfeiture process is to protect public safety and relieve neighborhoods of rampant drug dealing. In a small number of cases, the owner of the property is unwilling or unable to control it so that the drug activity stops. In those cases, we pursue forfeiture in order to do what the owner will not. In most other cases, however, the owner is able to provide reasonable assurance that he will prevent further drug activity. In that event, the forfeiture petition is withdrawn by agreement. That is all that happened in this case. The owners’ son was arrested for selling heroin from the house. When police came to arrest him at the house, they recovered heroin there, as he was trying to flush it down the toilet. The son was charged and is participating in a drug treatment program. The owners have signed an agreement certifying that they will take all reasonable measures to make sure that their neighborhood is no longer subjected to the offenses previously perpetrated. As the owners are well aware, if they fail in their promises, the proceedings may be renewed.”

She and her husband, Christos, have fought to keep the home and are lead plaintiffs in a lawsuit that claims the city’s asset forfeiture process is unconstitutional.
The DA’s office issued the following statement:
"The class action lawyers are trying to portray today’s events as some sort of victory. The truth is that we resolve most of our real estate forfeiture actions by agreement, just as we are doing here, and we have been doing that since long before this lawsuit was filed. We do it because the purpose of the forfeiture process is to protect public safety and relieve neighborhoods of rampant drug dealing.
In a small number of cases, the owner of the property is unwilling or unable to control it so that the drug activity stops. In those cases, we pursue forfeiture in order to do what the owner will not.
In most other cases, however, the owner is able to provide reasonable assurance that he will prevent further drug activity. In that event, the forfeiture petition is withdrawn by agreement.
That is all that happened in this case. The owners’ son was arrested for selling heroin from the house. When police came to arrest him at the house, they recovered heroin there, as he was trying to flush it down the toilet.
The son was charged and is participating in a drug treatment program. The owners have signed an agreement certifying that they will take all reasonable measures to make sure that their neighborhood is no longer subjected to the offenses previously perpetrated. As the owners are well aware, if they fail in their promises, the proceedings may be renewed.”
You can legally go after city Hall and repossess city Hall as it is in conjunction with committing crimes of drugs and sale of drugs so any eminent domain can take their property and their aint schip they can do about it
This is a common story, more than you might think. Cars, houses, money, it gets seized without cause every day, bypassing and totally ignoring Constitutional protections (in my view, and many others, totally illegally.) Somebody in the police department or county probably had their eyes on that house & wanted it. So that's what they do that..
Vote that DA out.

This will be a standard Government practice state to state in the near future!
People have no right to complain if they are going to do nothing about it but whine. They are doing what they feel they can get away with. Take to the streets and stay there until they get rid of that law.

Sue the department, the jurisdiction, the individual officers, and the pension funds into bankruptcy. They might even get the hint, though I doubt it.
Plaintiff attorney Robert Frommer says the class action will continue:
“Our client’s homes are safe now we’re trying to make everyone else’s homes safe as well.”
Something needs to be DONE. THEY DON'T CARE ABOUT JUSTICE.

Law enforcement can be like kids sometimes. You have to babysit them and tell them don’t do this, don’t do that.
Sounds like the citizens need to kick out the elected officials and ban or modify civil forfeiture laws.

The forfeiture law does NOT require a CONVICTION . It does not require you to be FORMALLY CHARGED. Just to roll over and let them have whatever they want to add to their own coffers!
Imagine what would happen when they fuck around with the wrong person.
They should be angry at their SON, not the city. Clearly he was selling thousands of dollars of drugs thru that home even though he got caught with only $40 worth.
