      there are 2 types of security guards....commissioned means you can have a gun like guarding a bank or car dealership. The other type of guard is non-commisoned like I was = no gun involved. Always ALWAYS do your homework.....ALWAYS!!

      Fun fact: all a security guard can legally do is use reasonable force to detain you if they suspect you of a crime.
      If one attempts to and you have done no crime or attempts to make you do anything else than make you wait for police, call the police yourself.

      @@Quietu security guards dont even have that authority. All they can do is gather any evidence of the fact at the moment, ask you to leave the premises. If you were caught shoplifting or something like that they can do a citizen’s arrest.

      Key words: reasonable force.
      Hitting a cone in reverse wouldn't justify that level of response. In fact, in my state of SC. Entry into an occupied vehicle is a class A felony as it fall under our states castle doctrine. Therefore,, one should expect a felony level response to illegal entry.. You also have a legal right in my state to resist a clearly unlawful. detainment. Being that a security gaurd is non commissioned by the state......

      Everything you said is correct, except. The part of carrying a firearm without a firearms permit or license.
      You don't need a firearms permit or license to carry firearms. You don't even need a background check.
      It is your Constitutional Right.
      No firearms permit or license needed.
      You don't need to ask The Government for permission to carry firearms.
      Again, it is your Constitutional Right.
      The Government shall not infringe on The Rights of The People to carry firearms.
      The Government has NO say so in this area.
      We The People elect Our Government Officials into Office to Uphold and Defend The Constitution.
      So carrying firearms is not the issue here. Now let's move on to other violations.
      From the looks of it; this security company is out of order.
      From the supervisor down to the security guard.
      Everybody's getting sued. I would sue them. But that's me.

    See this is a smart man. He’s not just suing “the department” (the security company in this case), he’s personally suing the 2 security guards. That’s the only way you can change their bad behavior, is by personally suing them.

    As an armed security guard our main objective is to “Observe & report” we have no legal authority to pursue. Only time youre are allowed to get involved is self defense or defense of another.

      Now let me share with you some history.
      Question :Do you know why the body of a police force was created in the US ?
      Answer : It was created to do EXACTLY what security guards does today. To report and protect private property.
      With that being said i will never support what this security officer "WANNABE" did. That was terrible. And the "Supervisor" had some ego boosted into his head to request a private citizen to get out his car.
      I am happy the driver sue the hell out of these idiots & the security company. The mall won't be held liable for had happened because the security staff was not hired directly by the mall.

    Even if it had of been a real cop - I couldn't imagine how it feels to have a gun pointed right at my head - - - for running over a piece of plastic! Imagine potentially losing your life because the cop or security guard thought the wellbeing of a none sentient inanimate object is worth more than your life! WOW! Just., WOW! I hope the driver won his lawsuit and lives comfortably for the rest of his life. And shouldn't the security guard be spending some amount of time in jail for attempted murder? The look on that guard's face shows he was just itching to pull that trigger

      When a security company hires someone who does not have a gun permit, the security officer is generally allowed to work unarmed posts only until they qualify with their weapon and obtain the permit. The security company in question screwed the pooch on this one.

      In my view, you NEVER point a gun at someone UNTIL you're ABSOLUTELY going to pull the trigger. PERIOD!
      Even if the person you're concerned with is close, you maintain a ready position, with both hands firmly on the gun if possible, with it pointed down UNTIL you're forced to fire. THAT is when you raise it, aim, and fire.
      Doing otherwise, especially with your finger ON the trigger, is a recipe for NEGLIGENT HOMICIDE!

      The guy with the gun was probably pulling down minimum wage. The supervisor was probably making a dime an hour over minimum wage. My brother once wanted to sue an uninsured driver over a traffic accident. He talked to a lawyer who determined that the guy had no assets worth suing for.

      I agree!! I worked as an armed security guard and I had to get a background check plus apply for a SLED card for police powers in my capacity of work.

      and if you read the quick flash of the police report, it doesn't say he didn't have the necessary permit and licence, it says he didn't have them on him. I know that may sound like splitting hairs, but it's a big difference between being unlicensed and not being in possession of the required paperwork.

    In my job, I had to install and maintain equipment for network telecom services to large companies and government facilities as well. Some customers had "security services" that mandated me surrendering my personal drivers license to them to hold while I was escorted the whole time on site. I told them I refused to, the main reason being is that I had no idea how and by whom these security services were vetted. This video definitely enforces my concerns, and actions. Nothing in my job requirements by my employer said I was forced to surrender my personal DL to a customer. Government sites usually just verified me, then escorted me, which was acceptable.

      You would be driving without a license. You don't need any other reason to say no, but "I don't know you" is a great reason.
      In the Navy, we had a superior try to have us surrender our IDs to him while in port so we couldn't leave when off [we had to work that day, but it wasn't a duty day so we could actually leave]. He was concerned we'd leave, get drunk, and be useless the next day. And we wouldn't be able to leave without ID. Everyone refused as it's required everyone carry their ID at all times. He tried to threaten us for disobeying an order, but nobody gave them up. He couldn't take it further because we'd be ordered to be out of uniform (you're out of uniform even if all you're missing is ID). I don't know about anyone else, but I left the ship after work and went to a great burger place, then went back to the ship. I had dinner with a couple beers. Worked fine the next day. He never tried it again. This was San Francisco about 20 years ago.

      @@c3sPAze That is not an option in Illinois.I could have gotten a duplicate photo license, but then, the "security" person, who I have no idea how they are vetted, or how my license and info is held, is still in possession of personal information that can lead to identity theft, I am NOT the insurer/bond holder for damages that I may be accused of doing while on site, my employer is, and, that duplicate license will cost me out of pocket money and can still be held, or lost, by the security person. I just was not required by my company to present my license to be held for access, so I chose not to. If they want to verify my identity with the info, and return it to me, that's fine.

      Likely hired and was going through training.
      Even in restaurant business, you need a server's license, but they allow you to work first and get so many hours under the belt and you naturally get the license.

      Lawsuits like this you name everyone but the mall probably has only a small percentage, if it's a store security then it's not the malls issue. The real percentage will lay with the security company that is hired. They will probably loss their contract and I bet they are ordered to pay out. Obviously just a security company if they are not huge they might just close on paper and re-open as a new company. Happens all the time to avoid Judgement. Nothing you can do. It's why they name the mall and store, they have deeper pockets and a Judge might order a percentage of blame on them. No store is closing, and no mall is being owned...LOL In the end I bet they settle out of court. In fact the store or mall might just say here s $100K go away...spend more in lawyers.       Meeker Extreme if you read the story the guy actually got more than a million. this vid is old. the mall was partially at fault for hiring the company so he got money from the mall and the security place is closed for good. so in the end he got well over a million in total.

      Now, he would of course be proven right posthumely - but be dead nontheless. - If a security dares to pull the gun on you for nothing, there is a chance he is on drugs, is mentally disturbed, etc. ...

      That's not necessarily true. A lot of training goes out the window when a human feels stressed out. The purpose of training is to mimimze skill loss that is induced by stress. The more you have to begin with, the less you lose. That said, we have no idea how much time this guy has spent at the range. He may or may not be a good marksman under ideal conditions.
