Would you rather someone be convicted if they're innocent or found innocent if someone is guilty? You can't just assume that people are guilty because of what they're accused of. There's no evidence in the video whatsoever other than the list of accusations. What if the jury invoked a guilty verdict because they were afraid of retaliation from the judge and the accused was actually innocent? If you were on trial regardless if you committed the crime or not you should hope that if there was a shred of misconduct in the court that you'd get some sort of consideration from the state to ensure due process was upheld.
Was he eventually found guilty? If not, you run the risk of guaranteeing the freedom of the actual monster by wanting to kneejerk believe they got the right person. Any time an innocent person goes to jail, it guarantees that no one is looking for the actual guilty party and they are free to victimize others. People tend to not think about that part. That's what cutting corners and rushing to judgement does. It puts innocent people in jail, AND it keeps criminals on the streets.

As a criminal defense lawyer, it is extremely important to have a fair and impartial jury. It is further extremely important that jurors are open and honest during jury selection about any potential biases and beliefs they may have that could affect their ability to be fair and impartial. A judge and the attorneys want to openly encourage jurors to be open and honest during jury selection and if jurors are discouraged from sharing biases it certainly you risk not having a fair jury trial. I have done several jury trials and have never seen anything like this from a judge.

Maybe I've been wrong, but it's always been my understanding that it's the responsibility of a potential juror to disclose any biases they have that might taint the impartiality of the trial. From the way things look to me this woman got bashed simply for doing what she was legally obligated to do. This judge should be ashamed for his behavior.
Not just that, but the lawyers ask the potential jurors dozens of questions to uncover bias. One of them is a simple, “Do you believe you have any biases for reasons we haven’t asked about?” The nurse did what the lawyers wanted her to do, what the entire selection process is designed to do. The fact that the judge forgot that means he’s not fit to be on the bench.
It varies during the selection. You can be pulled into a room and talked about for 3 hours before you can signal that you would have a bias or know someone on the case, etc. Sometimes youre not asked until the NEXT day when you show up inside the court, like in this video.
Shame, shame, shame. She was only being honest about being biased on the case because of her field of work, and the judge snapped. For the judge, had the shoes been on the other foot for that attitude and throwing that book, that would have been a contempt of court charge
If I were a nurse who was involved with child abuse, incest and all the other thing she said, there's no way I could be impartial on a case like this, and I'm guess that this judge has the attitude that anybody who admits to any kind of issue is doing so for the sole purpose of getting out of jury duty. We used to have supervisors and managers who treated every employee who came to them with a question as if they were purposely "playing dumb" to get out of work. @@sese6227 and why would you want to keep people on a jury who resent being there? As the follow up described, his actions permanently tainted every person on that jury pool. Then the judge threw a hissy fit because he saw some people on their phones while waiting for the court to begin and threatened to hold everyone in contempt because he needed a jury that would "pay attention". Like...I'm sorry, I didn't know someone being in an entirely different room, making a sandwich, and nowhere near their computer meant they were paying MORE attention than being right in front of the computer on a device they put down as soon as the session started? I didn't get his logic. I honestly wonder if that case is going to go to retrial because he made everyone feel like they if they missed a single small detail or if we tried to ask a question we'd be jailed or something :/

Exactly! There was a flicker of remembrance when she reminded him that she told him she had "issues" with the case. Instead of backing down, apologizing, or simply shutting his mouth- he decided to "double down on his douchebaggery". Jury duty is a major inconvenience for some people. Sometimes there is no way out unless you go to jail. Being forced to do things like this can literally destroy your life and apparently the judge couldn’t care less.
Weird to think a judge doesn’t understand the point of jury selection. Her reasoning for why she wouldn’t be impartial is completely reasonable and valid. So, what, because he can’t bother to discuss the concerns she brought up prior to that day in court, he gets to throw a tantrum that the first handful of choices aren’t perfect for the jury? So gross and immature, I hope someone else is elected into the position.
Courts need to do one of two things…. Either force employers to pay employees full pay while on jury duty…. OR courts need to use some of those tax dollars to pay every juror the exact same pay they make at their fulltime job for serving on a jury. The government has screwed up the economy and people have bills ya know. We can’t just stop paying bills or working to serve on a jury. Make people on welfare serve on jury duty
People should be very eager to get on jury duty so justice can be done. I got selected for jury duty & the defendant was absolutely guilty but some professionals on the jury(attys) were trying to fall asleep. They would have had this monster walk free. The rest of us got him put behind bars where he can’t hurt the public. People seriously we need to get involved at all levels in justice. Our country is in trouble.
Jurors should feel free from persecution to voice their potential bias, and it's CRUCIAL that they do so for our justice system to function. This is just my opinion, but her justification for claiming she "may be biased" sounded entirely legitimate - which doesn't even matter because she felt she may be biased, which right there is enough of a justification. This judge was wholly inappropriate and showed a lack of understanding on our justice system.
I was chosen for jury duty once when I was 6 months pregnant, in college full time and working at my dad’s practice full time. Yeah, what a horrible judge. Literally throwing a temper tantrum like a spoiled brat.
Yeah--I saw the reversal coming, because of the intimidation of other jurors who now would be reluctant to voice problems.
From the way things look to me this woman got bashed simply for doing what she was legally obligated to do. This judge should be ashamed for his behavior.
Not just that, but the lawyers ask the potential jurors dozens of questions to uncover bias.
