The reservation for differentially abled (PWD) in the result published by NTA & UGC with PWD reservation is discriminated on the basis of caste, it is ILLEGAL. Thereby high cut off marks are published from December 2019 onwards. The reservation to PWD is not based on caste. It is Horizontal reservation whereas UGC & NTA is providing Horizontal reservation to PWD across Vertical reservation, it is ILLEGAL and inconsistant with the provisions of RPWD Act, 2016. The reservation @ 4% under Sec. 34 is not based on caste as per RPWD Act. The method followed by UGC & NTA is against the verdict of the Hon'ble Supreme Court in Rajeev Kumar Gupta Vs. Union of India in 2016. The Indra Swahney verdict has no implication on PWD reservation which was declared by Hon'ble Supreme Court in Rajeev Kumar Gupta case. The Hon'ble Supreme Court in Mahesh Gupta Vs. Yashwant Kumar Ahirwar declared that the reservation to PWD should not be further classified on the basis of caste. It is based on disability alone. You see 20 categories in PWD is published, actually as per RPWD Act only 4 categories of PWD according to thier disability. The result and notification issued by UGC & NTA is illegal and against the Hon'ble Supreme Court directions and RPWD Act, 2016. If it is declared on the basis of RPWD Act the cut off marks for PWD will be much lower than published from Dec. 2019 onwards. Now in the notification for Dec. 2021 & May 2022 they have violated the same and published it with discrimination of caste for PWD, it is ILLEGAL.
