Im NOT that into the vtuber scene. Thats obvious from my horrible pronunciation of names, including the person this video is about. I just found out about this today and thought it was absolutely wild so I wanted to make a video on it.
The situation of the video, while it's a little bit complicated, was not so much about the copywrite issues. She had all the permissions from the musician, from the animator, etc. Apparently, the issue was that she made an animated video with a song and it featured v-tuber characters who had left the company. Those characters are owned by Nijisanji so they not wanting to let her post the video was all their decision.
@@kissena3830 The reason is that they don't see the livers as people and they don't want people thinking about someone who they don't have control over anymore, even in a video which clearly nostalgic undertones. They don't care about the past employees, they don't care about the fans. They only care about money. And they can't make money with v-tubers that moved on. It would cost them nothing to approve. They would lose nothing by approving. They did it out of spite.
I'm gonna comment as one of the people that are in the Vtuber sphere for a long time. First, the company Nijisanji EN have cancelled if not declined many of her project before this termination, one of it was an international tournament (i forgot what tournament it is), that she want to held including talents from other branch than the EN branch, Nijisanji has 4 branch before, now only 2 (EN and CN/Virtua Real), but when she propose the project to management they just say no to her and in the result she only get permission to held tournament within Nijisanji EN only. Later on she also want to held and event for the fanartist where they draw new outfit for her and the winner will get paid, but the company said "NO", the fanartist that win will not be paid and all of the drawing from the artist that didn't win will become the company assets, but Selen said no, she want to pay for the winning artist and had clash with the management about that. The breaking point is about a cover song of Lily Pichu song, so in the Vtuber company you have to tell the management what song you want to cover, the materials that gonna be inside the cover, the permission to cover the song and so on, it was all to prevent a copyright claim, selen basically have done all of that and got the last permission from management to post the cover, the cover song took about a year to finally finish it and she spent US$15k+ for the cover MV, but not long after the cover MV was posted they privated it and lock Selen out of her account on January. What makes the community angry and furious is that they were triying that the bad reputation of their company is all because of Selen, when in fact they build up that reputation themselve.

A recently retired Liver (in the vtubing community this retirement is referred to as a "graduation") named Pomu Rainpuff stated through tears on a members-only stream that she had a once-in-a-lifetime opportunity that she had to let go of because Nijisanji EN management said "no". From everything that former Livers have stated about Nijisanji EN management, it comes down to sabotage of their projects or flat out denial of their ideas. This is not how a vtuber agency fosters creativity - this is essentially treating their talents as products to sell. Hence why Nijisanji EN is referred to as a black company.

On the rule regarding the MV, just wanted to add. Selen got permission from the owner of the original song in August of 2022. Management didn't look at the MV until the day before it was released, and gave her a last minute "No". So, another mismanagement issue of them not putting any time or effort into looking at what the talents are doing. Its also not the first time a talent has had "permission" issues that weren't issues until after the fact.
I am pretty sure that the termination also broke labor laws in both Japan (where they are based) and Canada (where Doki is). Don't know what all will hapen with that, but they even admitted to it within their statement. As I understand it they have to alert her 30 days before fire date in jp law and can't fire here while in hospital per ca law. Whe found out about the termination by a friend messaging her.
Kuroshitji hires the talents as CONTRACTORS. So even that is no possible due to the legal differences in status regarding a Formallt hired employee and a Hired Contractor. Though IF Selen or any Canada based talents wanted to, and HAVE enough evidence to make a solid case to Cucknada's Labor Law agency, they could hammer down Kuroshitji EN so hard the atocks would likely drop 30% in one go as the Drama would basically explode into worldwide range scale, nuking Kuroshitji from anywhere but JP markets (and perhaps even there as likely the Politicucks there would LOVE something to earn "Brownie points" with the electorate). But that would require the case being big enough to get the Cucknadian Goebelsnment to fire off an International chase against Kuroshitji.
it is not just about communication failure. NIJI EN deserve it they even bully sayu in her first stream the management is toxic and forcing the talents to be toxic
The thing is, if this is a singular case within like, let's say 4-6 months..... we can think a bit positively of the company, but what happen for the last let's say two years, no wonder the public weight more negatively on the corpo, it's their history that turns their own customers and audiences that way

Instead by suddenly releasing such a hostile document they tried to fluster her into making some type of mistake or controversial statement so they could smear her image even more. Unfortunately for them Selen/Doki and her lawyer had prepared a statement in advance just in case something like this happened.
Even thought you mispronounced a lot of names, you did your best and were respectful which is a great sign for your future UA-cam career , and it's always import to inform the public about the news that are going on
I dont want to be that guy, but everytime i hear you say SelEEEEEEN it irritates me. It doesnt take more than a minute to look up how her name is pronounced. If you are gonna ride the wave to get views, at least get her name right.
