Question : in 261 Magistrate of 2nd class can give punishment for upto 6 months but in 262 it is said that no sentence for improvement exceeding 3 months ??

कृपया यह बताने का कष्ट करें कि 261 crpc में मृत्यु, आजीवन कारावास, या 2 वर्ष से कम सजा वाले अपराध का संक्षिप्त विचारण के बारे में बताता है ,फिर 379 में तो 3 साल की सजा का प्रविधान है ऐसा क्यों ?

379 कहता है, अधिकतम सजा 3 साल है, आप 3 साल से अधिक की सज़ा नही दे सकते,summary trial कहता है वो कोई भी मामला जिसमे सज़ा 2 साल तक कि हो, कहने का मतलब, अगर मजिस्ट्रेट को लगता है किसी चोरी में सज़ा 2 साल की देनी है,तब ही वो trial summary trial में चलाया जाएगा।
जाहिर सी बात है,200 रुपये तक कि चोरी के लिये 2 साल तक कि सज़ा काफी है।
