It's always been illegal to take the difference out of the server's pay. However, there are a LOT of labor law violations that occur in the US every day and "no one bats an eye" due to the fear of retaliation. I remember having my hours cut for less than asserting my rights.

Ive had to call the cops on people who threatened physical violence on me just because they had a bad day. And they continued to do so in front of the cops when they arrived. Being the only one watching the place I asked my boss if I could bring protection, pepper spray or a tazer was all he'd allow.
Wait, what? If someone doesn't pay the bill they take that out on the _waitress?!_ That's fucked up! And then they have the gall to say they shouldn't chase non paying customers?!

sadly many places do this, although its becoming increasingly less common and some states have laws preventing it now
Relatively normal policy. It doesn't happen often but when it does it sucks pretty hard.
