I so completely respect the judge for adjourning this for a day in order to NOT react against the defendant for his lawyer's extremely ignorant statement! I'm reminded of the opposite reaction I saw on Court Cam where a defense lawyer refused to waive the right to a speedy trial for his client and the judge ended up literally brawling with him off camera in the hallway. Judge Simpson is one of the good ones - tough but fair, and willing to give truly repentant people the help they need to get back on the straight and narrow.
Damn. He pissed him off so much that he couldn't even hold a hearing on it this day for fear that he'd end up being unfair to the defendant out of anger.
As a retired trial attorney, I have a great amount of admiration for Judge Simpson. His willingness to acknowledge he is no less human than any of us only increases my respect for him. He knows his job and he honors his commitment to that job by making as sure as he can fair treatment towards the defendant by refusing to make him collateral damage to the ire raised by defense counsel’s incredibly rude attack on Judge Simpsons ethics. Law nerds, students and practitioners: take note of what you should be doing if one day you are either in court as an attorney or as a judge.
I am a practising barrister, and I am appalled by this lawyers comment. We all make mistakes and I know how easy it is to speak out of turn, or to word something incorrectly, or to have the court misinterpret something you said... But I'm appalled that he didn't apologise immediately and profusely. He spoke ignorantly out of turn and in frustration, and I'm sure judge Simpson would have accepted an apology.
Defendant's thought bubble as he walks out: "I know that the judge said that he never punishes defendants for the behavior of their attorney, but can I find a new lawyer by noon tomorrow, anyway?"
I like that when Judge Simpson gets really mad he breaks for a recess. In this case, he goes even further and adjourns the proceeding to give himself a chance to cool down. It is good that he gives himself time to get his emotions under control so he isn't ruling while being heated.
Better for himself. Because it would be a great argument before the appellate court if you can prove that the judgement was based on emotions and not on facts.
If gives all the parties that opportunity as he is responding to their actions. It is the professional thing to do. Reconvene after things are given time to settle with better afterthoughts
Oh I have, but not with lawyers for a while. There was also a case recently where he was testifying from the bench (IMHO) about offences that were never charged by the police because of the victim impact statements making him emotional. But most of the time he seems chill.
Wow the defendant is going to have a sleepless night and I hope his attorney lays awake wondering whether there is a complaint to the BAR in his near future.
The closest I've ever seen Simpson get that mad was when the lawyer for the OWI case that killed the two young women got upset that Simpson was investigating.
To be fair, once the judge shut him down anything he said would have been grounds for contempt. I have seen otherwise chill judges on here that have increased contempt sentences because the defendant wouldn't stop begging and shut up, and this lawyer perhaps thought the discretion of smouldering silently was the better part of valour.
The best thing about Judge Simpson is when he gets emotional about something and orders a recess as soon as his temper rises. I've noticed it lately in his cases and its very honorable of him to make sure his emotions don't affect his rulings as much as they could have.
