    I really dislike Leases but I get why it exist for foreigners but why cannot Ghanaian citizens have freehold?

    For me, I want to entirely read the Ghana New land ACT 1036 then I will have a better understanding after consulting a lawyer to explain where necessary. From what I know this far. A stool, a skin, a clan and now families can not give you freehold on land, rather they can give you a leasehold up to 50 years for foreigners and 99 years for Ghanaians. The 50 years leasehold May be widely used for all as it gives land owners the right to renegotiate lease terms for generations to benefit off the land. Only individuals can give their freehold interest to citizens who have interest in their land.
    Foreigners will have to rethink their actions. Because after the 50 years, if no renew clause is signed, a land owner can refuse renewal and take over. This laws are colonial laws from UK 🇬🇧. Americans may find it difficult to understand.
    Land has always been leased before this new land act. However it was implied that after the lease term, 50 or 99 years, whoever sold you the land might have died and gone and it belongs to you forever. So take note 📝 this is why a family, stool, clan or skin can’t give you freehold because it does not belong to one ☝️ person. However an individual who has the freehold before this new act can entirely give you full rights to the land forever.
    We will discuss this issue for a long time until fully understood. Simply get a lawyer to help you in land matters and all this comes at a cost. Lease land, you pay, get a lawyer to draft lease agreements you pay, do search 🔦 at lands, you pay, find a surveyor, you pay, register land you pay, acquire permit to build you pay, finally get land title and documents you pay. Everywhere you go you keep paying.

    I am a Ghanaian, and you can lease land for 99 years even as a Non Ghanaian. They do it a lots days, you just have to agree with the owner of the land. Even I know some AAs who helped others get the 99 years with renewables. All depends on who you know. even some chiefs do 99 years. Maybe it is in the books, but its all up to the owners. I bought my land 4 years ago and built my dream house, and there is no limit. It is mine for life.

      the lawyer is talking about what is legal and not what can be done . If a non Ghanaian buys a land without knowing this and get into problems it’s bad . Just like driving , the law says stop at the red light , you can choose not to stop and what ever happens after is your own problem. James Bond you as a Ghanaian you should be protecting the interests of Ghanaians. Everywhere in the world there are things that are exclusively for citizens.

    I think buying land in Ghana is a TRAP, Every African American/Foreigners should try and buy land or property in Nigeria instead, The land is yours in perpetuity. No lease or long stories when you use a good lawyer. I bought 8 plots of land in Ghana and I truly doubt if I should build anything on it. Unless they change this colonial law. I remember that Nigeria used to have the same kind of land lease law that they inherited from their British colonial masters, No More Investments from me unless they change the law .

    Find somewhere that will allow us to own land outright
    Many of us are trying to have generational legacy. We can’t do this if we can’t not fully own our land
    Why would you make a land rich and profitable for someone else’s legacy.
    I guess I will have to keep looking

      The rules around freehold land are very specific and would only be transferred to another Ghanaian citizen. At this time, this is the law of the land.

      Not every African is Ghanaian. Have you confirmed that you have Ghanaian ancestry? Even when you do, you still have to remember that things can’t be freely given to you because you’re a foreigner whether you like it or not. If you’re asked to pick being an America or Ghanaian which would you choose? Exactly! So you can’t have it both ways.

    With laws like these, how do you expect foreigners to invest in your Country? Even England has realised the fallacy of leasehold properties and is converting leaseholds into Freeholds. It sounds like one of Busia's acute sighted laws akin to Aliens compliance order. There's so much wrong with this law
    i. What if the foreigner after 10 years sells his property to a Ghanaian citizen, does the Ghanaian gets 89years?
    ii. What if the Ghanaian sells the property on again to another Ghanaian after 20years? is it 69years.
    iii. This is just a future conflict waiting to happen. Ghanaians have a rent collection mindset and this will only hinder development and forever make families/communities socially immobile.
    Diasporas Beware, they only want your money, but not for you to have permanent foundations!

    Interesting!!! So, after the 50 year lease agreement is up and you go to renew the lease, you'll have to repay for the land again, but at a higher rate. Wow! This is making me feel like there's no place on earth where AAs can feel like they belong 100%.

      The law is very exploitive to most people that buy land, be they foreigners or Ghanaians. The land most Ghanaians buy have 99 years and after that it faces the same problem. That law need to be abolished but for now no one is taking anyone to court for renewal of land purchased. The law affects many of us and the 99 year lease rule was started not log ago according to an elderly man that bought a land many years ago

      Well, 50 year for foreign nationals and 99 for Ghanaian with a cross of renewable but the new price should not be more than 10% of the original price. Normally 5 to 10% for the new price.

      Well, it's your birthright, Africa is surely where you belong. So begin through naturalization, and become recognized as a citizen of Ghana too... This entitles you to a 99 year lease (obviously a renewable clause should be triggered, and also at an agreed percentage). The whole point of this lease-hold, was to protect families whose head(s) recklessly sold lands to the detriment of the unborn generation, keeping in mind, the country was and is still developing and opportunities were limited ... Laws are made and can be unmade or changed. In years to come, i think land ownership, would revert to free-hold again, as the country opens up and there are vast opportunities for all... This lease-hold is something citizens want to take up and challenge in the near term...

    Things have changed with technology. One can build removable building on the land after the lease the fixture can be moved. But it must be expressed in the terms of agreement.

      I’m guessing you probably can if and when you become a full Ghanaian citizen. Which is only right in my opinion. but till then you are only eligible for the 50 year lease which you will have to renew.

      Certain lands in Ghana are only sold through leasehold. Stool land or government land is only leased, and that is whether you are a Ghanaian or foreigner. 😂. I am Ghanaian, have bought Stool land, which is on a 99 year lease, and I have freehold land. I need to check my lease to see whether it contains the renewal clause

    Let me make this perfectly clear, call me what you will.
    For African Americans the only home true home we have is for Better or worse AMERICA, North, Central and South including the islands between.
    It’s here and ONLY here that we can lay claim to true land ownership, and “rights”.
    Our ancestors HERE fought hard to obtain what we have now, and it’s our part to build upon that.
    I bare no hatred towards Africans, but once again African Americans and Africans in the American Diaspora mentioned above are being bartered for whatever it is we have of value materially and experience wise to help to stimulate African economies, and to me it’s not much different in bottom line practice what took place when they participated in the selling of rival Africans or even many of the own, for their economic growth, until the hand that fed them bit them as well.
    I’m not falling for it, unless I can be given the same rights as the mainland African born Africans, PERIOD!!!
    Any business done outside of that will be done with my best interest in mind from a financial standpoint First, and only.
    Because without ownership, true ownership rights, I’d be a fool and so would others, to invest and abandon the only home we’ve known for a 50 year, max 100 year guarantee.
    My posterity can’t bank On that!
    It is insulting, anyone saying otherwise is I’ll informed to say the least.
    America love it or hate it, Is both loved and hated for its money and military strength.
    The fact is African Americans are the richest Africans in the world collectively, so if we could be sold another bait and switch, abs abandon the only home we have true rights to, and then move to Africa with our wealth we’d do so like fools, and once again become orphans!!!

    I OWN my land here for perpetual generations, yes eminent domain and taxes exists, but EVERY COUNTRY IN THE WORLD government can usurp under certain circumstances the land as they see fit. But at least here we’d still have to be paid handsomely for it, and this contrary to popular belief doesn’t take place regularly.
    There are surviving land ownerships dating over 130 years When African Americans were given full rights to land ownership in 1886.
    Say what you will, but yes, hell yes this is insulting to AFRICAN Americans who’s ancestors didn’t CHOOSE to leave Africa for a better life and opportunity in Europe or elsewhere. But who’s ancestors were SOLD, after having bs wars waged against their tribes, or simply caught slipping all together by the ancestors of what’s now called Ghana and other countries in Africa.
    So if a true mends to ills of by gone ancestors is to be truly realized, then only full rights of land Ownership and other rights is only fair.
    Lastly they could easily put in the clause that the land can only be passed down to heirs, or only fully transferred to other Ghanaians, mainland or diaspora.
    Anyway I agree with the comment that this is an insult, and is what stopped me in my tracks to opening up my factory to Manufacture motorcycles in Ghana.
    If I’m not going to get a better upside as an African In the Diaspora, then It makes far more sense to go to a country with better overall infrastructure and logistics systems and processes in place overall than Ghana or any other developing African country not allowing true ownership for those who become citizens of Ghana which takes about 10 years.
    I can agree with the foreigner 50 year rule, but once citizenship is given, then full rights should be expected and given.
    But to each their own, but I don’t get caught up in symbolism, and hype, I have to many employees who depend on me thinking beyond emotional impulses and publicity stunts.

    So basically no matter what, you potentially can build and own a home in Ghana without possibly having to pay more or lose your home after 100 years. If the landowner decides not to include a renewal clause after the second 50 years, or they may decide to charge more for the new lease. If you don't pay new lease term then you lose your home that you built on leased land.

    It is an insult to be a black American, being held to the same standard as someone who is European. Many of us have ancestors who were stolen from lands which are now called Ghana. To be told by Ghanaian authorities that we are ineligible to acquire lands by freehold interest fails to take into account that we have ancestors who were snatched from those lands, and sold into slavery.

      This issue is not about black Americans and everything do not revolve around Americans either. The man doing the interview is a Brit, so where are you getting the black American from? They lease the same land to people who are Ghanaians but not from Accra for 99 years, just 49 years more. The key word here is LEASE and it applies to foreigners as well as Ghanaians

      It is not an insult, but not fair. Africans from the diaspora just have to make their case to have the law change to reflect their are also full Africans and just like any other. Taking people from their ancestral lands and imposing a nationhood over them, does not deprive them of their ancenstral nationality. That case just has to be made and won. Beware in mind, the present generation will be more open to correct this and the generation before. So do not feel insulted, just make the case and you will get my vote.

    Not good to invest! As with America generational, wealth is not passed down! After all the hard work you put into an establish a homestead 😮 thank goodness I watched this video before taking all my hard earned money to move to Ghana! Gonna invites us home only to take back after we have built on the land! it’s sad and on comprehendible: i’m thankful that now my eyes are wide open. Yeah, I feel hurt in my soul!😥

    Thank you Sam for this very in-depth concise explanation of the freehold and leasehold property in Gana. I have an American friend who literally does not understand the concept of freehold and leasehold but as I am from the UK like yourself and your wife, we are very much au fait with these two concepts as most of the land. especially in major cities like London is owned and leased out accordingly.Not to say that 30 isn’t an abundance of freehold land available in the UK. But one question or maybe this will be covered in a next Vlog. For example, you and your wife are of Ghanaian extraction like myself, you are living in your Home which you are renovating. I can’t remember if you said this was a originally your mothers house who I’m guessing was originally a Ghanaian citizen and you inherited it off her. Or is this just another 50 year old leasehold property that your family are living in. My question is to those who have parents who were born in Ghana and have brought property then moved abroad but returned frequently to stay in their houses. They have built if they pass away as they were Ghanaian citizens when they originally brought the land can the children of the parents who originally brought the land. inherit? Or can Ghanaian citizens only leave their land to other Ghanaian citizens. Hopefully you understand what I’m trying to ask LOL.

    In my opinion, I think it's best non citizens rent houses instead of buying and building houses. You will never truly own the house.

      I know it is best that the deals be given to Caribbean and Haitians so they won't be dieing at sea to get to America. They share a common culture with them. We don't.

    This is why Nigeria will be far better than Ghana in this perspective. In Nigeria 🇳🇬, its FreeHold. In Nigeria, once you own it, you own it for life.
    LeaseHold in my opinion is the same mess in America where you pay taxes on a property for life simply because you dont own the land which means no freedom lol 😅😅

    Another idea to consider, what if a foreigner starts a company in Ghana and then asks the land owner to make the lease be in the name of the company? That'd make it easier for the foreigner's heirs.

    So if everyone leases the land, who truly owns the land , the government or the local government ( chiefs, etc) ?
    Let’s say person B “purchases” land from person A , does the renew clauses transfer from person A to person B ?
    Truly important to involve a lawyer in this process .

      The land is owned by the chiefs and families primarily. A small portion is owned by the government

    If you already have a contract, which does not include the renewal clause now, can you legally amend it now to include the renewal clause??

      @@ammabarb7028 if you have not given up or renounced your Ghanaian nationality then you retain the full rights of a Ghanaian citizen and can own land freehold where it's available regardless of a second nationality. When I say renounced, for example, Holland doesn't allow naturalized citizens to retain citizenship from their original land of birth so you have to formally inform the Ghanaian govt that you're giving up your Ghanaian citizenship. But England or the US allow people to retain their original citizenship when they naturalize. So, if you've never had to legally renounce your Ghanaian citizenship, there's no conflict there having dual nationality. As long as you retain a Ghanaian passport or Ghana Card indicating that you're a national, you just have to present the ID to register the freehold land with the Lands Commission. If you left at 14 yrs and don't have any national Ghanaian documents, you'd have to go through the process of getting said documents with the assistance of your Ghanaian relatives and then you can proceed with buying land.
      But that doesn't automatically mean you can buy any land freehold. The owner has to be willing to transfer a freehold interest to you. Not all lands will be sold freehold especially within the Greater Accra Region where most lands are under lease. In more undeveloped regions like the North, perhaps the Central and Western regions, there's more freehold land available there since there's less pressure from the population.

      I don't think the citizenship is the same type of a natural born Ghanaian. There are different citizenship types.

    So if you get citizenship in Ghana as someone of the diaspora, you can find a way to get freehold land? or you are still limited to 99 years as a “citizen?” Based on the very last question in this video that is…or, must you be born Ghanaian?

      If you can find a Ghanaian that is selling their freehold yhen as a Ghanaian citizen, you will be able to buy it free hold

    Well, if 50 years come to pass and such person still not a Ghanaian citizen and no crosses for renewal the chief can take their land back. But the property on the land have to values and pay compensation to the owner.

      After 50 years the renewal is 1% of the value of the land not the structures on it we would all love freehold and this can be found in a specific set of circumstances only.

    Once you have obtained citizenship, would you be able to own freehold land?
    My intention would be to obtain the lease, apply for citizenship and then once I am a citizen, pay for the freehold right to the land. Is this possible? And could parameters for that freehold purchase option be included in the lease contract?

      The land purchased would need to meet certain criteria, it's best to get the advice of a lawyer if this is your intention BEFORE you make any purchase.

      ​@@GhanaBound If a lease-to-own agreement was offered on some qualified real estate in Ghana, I think it would be very attractive to foreigners. Ie, you are getting the standard 50 year lease, but if you become qualified for freehold ownership within that time you have the option to purchase the land at a previously agreed upon fee.

      Honestly we should stop buying land in Ghana! so basically we American, UK, Caribbean ect should come to Ghana, use our hard earned savings to buy land and build houses That will never be ours 😡😡😡😡😡😡😡 when we die our children will never get it!! So basically Ghana just needs us to use our money to build up, improve Ghana! So it's basically giving your hard earned money to others to better there life and not yours and families! Right! Well seen that the case I will buy land in my brith country jamaica! Whenever we buy in Jamaica belongs to me and my family without restrictions! OK its a strong possibility I will get killed maybe two weeks after buying and building the house but at least my labour will go to my children 😔 plain and simple stealing.😢

      Sellers are obligated under law to renew the lease. Since filming this I've had many hours talking with different lawyer and you can expect to pay around 1% of the value of the land on renewal.

      Lawyer say yes it applies to all non Ghanaians. He did say that a foreigner can buy/set up a Ghanaian company which he will go into in part two this coming Saturday.

    Is important to let the lease holder interest put in account
    Also is important to have conversations with the
    Lease holder because of transferring to your children bearing these in mind

    Not only African Americans are classified foreigners. Ghana born diasporans are all classified foreigners and receiving 50 year land lease.

      If you have a Ghanaian passport, you will get the 99 years. Regardless of where you are born.
