    A brief summary of the process is as follows:
    We prepare an application, it is submitted in the USA to the United States
    citizenship and Immigration service (USCIS),
    And then once USCIS has completed its review, the case goes to the US State
    department’s National Visa Center (NVC) in New Hampshire.
    And finally NVC couriers the case overseas to a US Embassy or Consulate near your partner for your partner’s in-person consular interview and issuance of the visa into your partner’s passport..
    Then your partner travels to the USA, shows the visa at the border, and joins you here inside the USA.
    My philosophy, the VisaCoach philosophy, which we rigorously follow on every case,
    team VisaCoach works on, is that success, final outcome, final approval,
    depends 99% on the quality of your application that you and we together
    prepare and submit to US immigration.
    We take every opportunity, leave no stone unturned, in making your application
    as complete and persuasive as possible.
    The quality of the work we accomplish at the start, at the "front" of this process,
    determines the ultimate outcome.
    When quality goes in, we expect a positive result to come out.
    The petition package is mailed to USCIS.
    Spouse Visa applications go to Chicago or Phoenix
    After initial sorting then the applications are assigned and forwarded to one
    of six USCIS service centers that are scattered throughout the USA.
    At the destination USCIS service center your case is reviewed and processed.
    USCIS takes many months, often over a year to complete their review. For current timing best is that you contact my offices as USCIS processing times are a moving target and recently have been changing on a monthly basis. Sorry, but recently they have been going slower.
    Applying for your partner’s visa through US immigration is similar to traveling on a one lane highway. The cars that get on the road ahead of you must exit and get to their destination before you arrive at yours. And the cars behind you, must wait for you to get to yours before them. The only option you have is to enter and get in line as soon as you can. At VisaCoach we can’t help you pass the other vehicles, but what we do do is work to make sure that YOUR vehicle, your application is done properly, that it reliably makes the journey without breakdown and gets you to your destination as quickly as the immigration traffic will allow.
    The sooner you get started, and the sooner you submit, PROVIDING your application is properly done, then the earlier you get your visa.
    The review at USCIS includes an FBI background check. This is usually only on the
    US Citizen’s background, however it is also conducted on your partner if she or he
    had ever lived in the USA.
    When USCIS is satisfied with your application, they "approve" it. But they are really just saying that the USCIS review is over. Now another branch of the US government gets involved and must also finally “approve” your case. USCIS hands your case over to the US Department of State, for their review and processing, to their service center in New Hampshire, called the National Visa Center, or NVC for short
    NVC confirms which consulate is the one to process your case, and assigns a case number that starts with three letters that identify the consulate, such as CDJ for Ciudad Juarez, Mexico, MNL for Manila, Philippines, LGS for Lagos, Nigeria and so on.
    While your case is at NVC, two fees are paid, a visa application fee and the
    affidavit of support fee.
    Once fees are paid, then we gather and submit to NVC up to date information on your case, and prepare your Affidavit of Support.
    Based on knowledge of your situation, we also identify what civil and evidence documents
    are required by NVC and help you to submit them.

      The current income requirement for a household of two persons is $25,550. Does not matter how income is earned, pension, wages, etc.

    Happy Tuesday, Mr. Fred If France has more fiance visa applicants from an African country than the US does, does that mean the US embassy decision (approval or rejection) for US visa applicants from that African country will be faster than in France? thank you in advance.

      My fee for a spouse visa is only $1,490. However, your other question indicates you are not eligible to apply, so sorry, this is a non-starter for you.

    My husband is USA citizen and I applied for visit visa recently and it got rejected cos we didn’t have enough knowledge about the immigration. Will it have an impact on our i-130 application? I am residing in Muscat,Oman.

    Hi right now I am living in Thailand. Do I have to send all my documents to USCIS in America? Or is it possible for me to send everything to the US embassy?
    The USCIS here in Thailand closed permanently a few years ago.

    Hi Coach we plan on marrying online and then going to see him in April. In the mean time can I change my last name? and can he update his id card to say married? or do you recommend to wait since we have not filed the CR1 Visa?

      Name change, ID updates are not immigration issues. So have no effect on WHEN you submit the spouse visa application.

    If I met a woman who came to the United States on a tourist visa and we got married here. Can she return to her home country and file a CR1 visa? Or CR1 visas are only meant for couples who marry aboard in her home country?

      You have two options, you can apply for a spouse visa, and she returns to home country for her interview after which she can return to USA using the CR1 Visa, www.visacoach.com/spouse-visa/ OR you can keep her in the USA and apply for Concurrent Filing, which allows her to remain in the USA and get her green card without needing to leave your side.www.visacoach.com/concurrent-filing-adjustment-of-status/

      @@Visacoach if the woman came on a tourist visa from Nigeria and has been in the United States over 90 days is it probably better if she returns to her home country and file CR1 visa instead of Concurrent Filing due to the high fraud country she's from. Or not necessarily?

      USCIS is currently taking about a year, then State Department another 6 months, so total is usually about a year and a half from submission of petition to USCIS, to visa issuance.

      Theres always minor changes, usually on the slower side. Currently most spouse visas are taking over a year and a half.

      If you don't mind my asing, what country is your wife coming from? My soon to be wife is Indonesian, native born and citizen there. I'm Californian and my immigration lawyer told me right now, grand total wait time from filing CR-1 is 19 to 22 months for it.
      I also am using a joint sponsor (family member) because when I file, I don't have employment. Switching careers and studying at University, due to graduate May, 2025.

Like ds260 can i file that here in us embassy in manila Philippines.. or my ds260 you will be able to fill up that form, in my information.

    If I met a woman who came on a 3 week tourist visa and she overstayed and we get married 8 months later she is eligible to apply for AOS right? It doesn't matter that she overstayed .

      If you are a US citizen, and you marry someone who arrived on a tourist visa, and who (the traveler) did not use the tourist visa with plans to stay, you could apply to get permanent residency for your spouse.       If by SSDI you mean welfare, sorry you are disqualified from sponsoring an immigrant to the USA. Posible solutions are to find a way to support yourself and your partner without public assistance, another is to join your partner in his or her country instead of USA.

      Sorry but if you are on welfare, you are ineligible to apply for immigration for a foreigner.

    I submitted a k1 visa back in August of 2022, but then we got married in April of 2023 before we got the k1 petition approval letter on August 2023.
    Now I gotta start over with this cr1 visa.
    I tried letting the nvc know of this situation but they said I need to contact the Bogota embassy now to inform them of this change.
    Should I go ahead and start the new cr1 visa now even though we didn’t inform the embassy of this?

      You can only apply for the visa you are eligible for. You lost eligibility for the fiance visa the moment you married. Now
      currently you are only eligible for a spouse visa, and yes, you now need to start completely over from scratch. What you are referring to "contacting NVC, contacting the embassy" shows that you are getting very bad, and very inaccurate advice. If you hired someone to help, you should fire them. If you are doing it yourself, now is the time to hire someone who knows what he is doing.

      As a green card holder you can always apply for your spouse or children. If you made mistakes or deliberate falsehoods in your prior dealings with US immigration you might have problems. Bottom line, never lie, always be honest with US immigration or accept the consequences..
