Emotional Support Animal vs Service Dog and Landlords

  • There is a lot of confusion on the difference between an emotional support animal and a service dog. Many people do not realize that you have different rights between an ESA and a Service Animal and as a landlord what your rights are. This video is to help renters and landlords understand the differences between the two and further their understanding of the rights of those who have ESAs and Service Animals.

    If a tenant moves in with an ESA or service animal, we require a pet deposit
    If the tenant refuses, and says it's not a pet, we simply say no problem, your service animal or ESA will be on the lease and must pay the usual application fee.

    Actually landlords are allowed to require a letter for service dog from a doctor. I had to go through the process of doing that and it sucks. It’s because emotional support animals and housing for service animals are under the FHA

      I don't think it right for landlords to be forced to have animals in their home regardless if they are service animals or not. I think it the government should build apartment for people that service animals

      Agree and they need to supply a new letter every year. If more than 1 dog, a separate letter would be required for each dog and so therapists would often charge the tenant a separate fee for each letter. You can also ask for verification of the letter and ask the tenant to provide that verification from their therapist. While they might allow an ESA, it is important to be strict about the requirements and push back when the letter does not seem legitimate. Also consider that landlords will just simply raise the rent to accommodate for the dog and so there are ways to offset the added wear and tear on property.

      I am also a real stickler for the rules for the safety of all around. So the owners are requires to have their dogs receive vaccinations and all standard upkeep every year and show valid proof to avoid any potential liability (rabies, etc) if dog injuries others. Every precaution and safeguard must be followed to a tee or the dog must go. In all honesty, it is better for everyone around including the dog to make sure owners are being responsible

      I'm a landlord and I have not run into a problem with anybody telling me they have a service animal yet. I don't think anybody should have to have animal in their homes if they don't want to.

      @@johnniebeavers4003 this is just s stupid and brain dead comment….. I can tell you’re not a landlord or just dumb because literally just advocated segregation for the disabled. You’re logic is flawed and goes against federal law for service animals

    All a landlord has to do is just say oh well I may have to let a animal in my home but their one thing I don't have to do is rent my home out any more. I"m selling nobody can force somebody to be a landlord

    Hi thank you for such an educational video!
    Is the ADA federal?
    What are the options if the dog is an Emotional Support Animal and is being trained into a service dog for PTSD?
    Also what if neighbors claim to be afraid of the dog?

      The ADA is federal law, yes. It overrides any state or local laws, so you don't have to worry about being in the wrong for stating this.
      Not too sure about this one. ESAs are able to be trained into psychiatric service animals if their owner requires one,( i wouldn't recommend this, though. most service animals begin training at 8 weeks old and finish at 2 yo.) but it must be task trained to do at least one task relating directly to their owners disability. I don't know if SDITs are covered by the ADA.
      It doesn't matter if neighbors are afraid of them. Same with allergies. Service Animals are considered medical equipment and are covered under the equal housing rights. They cannot require you to pay extra because your equipment is a task trained service animal. They also cannot require you to leave, or anything similar due to the fact a neighbor does not like the dog. It is discrimination and is illegal.

    Heck my landlord when we first moved into this rental a little over a year and a half ago allowed my wife's esa animal and charge us a extra $250 pet deposit the only thing I disagree with in this video and ESA is not considered a pet they just considered them a animal but I rescued a dog I've been dealing with mental health issues all my life and it got documentation from my mental health care provider my landlord on the 17th of December found out about the dog I was giving it 5 days to find the owner but I had already contacted my doctors to get the ball rolling because we found her with no collar in pretty bad shape she is the most loving dog not aggressive and she makes me extremely happy but my landlord is denying me and esa she says you are not allowed it is not up for discussion. Point blank end of discussion take the dog to the shelter which in our county is a kill shelter if you do not you will get notice well that's discrimination off gate she hasn't even seen the dog nothing but it's not up for discussion I sent her the paperwork from my doctor and she told me I do not have an ESA and now we are facing eviction says we have 31 days to get out she doesn't have to take us to court which is another lie because it says breach of lease and then says they did not renew our least two months ago they didn't sign their copy they just brought us one if they weren't going to renew our lease they would have terminated the lease in October well gave us 30 days notice to vacate instead of bringing us a copy November 1st I know we are in the right here any advice I have filed a complaint with HUD they did get in contact with me the next day but she still saying she does not have to take us to court to evict us which is against the law but our neighbors who rent from her have multiple esa's a dog that stays outside all the time barking which is very irritating but the same rules don't apply eternal has their own lease and everybody is not treated the same it's her words
