I know someone in the intel field works at fairly high level in these matter and I've been suggested that when the gov wants to know something about you they have all the power and ability to find out and at a scary level, messages, phones calls, access to email, your phone, your home network. They will get what they want.

Of course. "Laws" are stagecraft. "Warrants" are stagecraft. All law enforcement gathers evidence without a "warrant", then sorts out the evidence, then automatically acquires a "warrant" for evidence that needs to be used in court. "Warrants" are like notary seals.
