Clearly you don’t understand the situation. Nintendo can do this since they are a company. Even though morally and legally it is true they can’t do that, going to court for it would cost so much for SML it wouldn’t be worth it. A trial like this could go on for years. The cost of the lawyers and other things could be literally millions of dollars. Nintendo is fine with that since it is pocket change for them but SML would go bankrupt in a year.
