Because Abraham Lincoln in 1862 determined that he was constitutionally unable to arrest a white southerner slave owner because that man was the Supreme Court Chief Justice. Abraham Lincoln was very able to arrest members of Congress for treason, but he determined the executive couldn’t do that with the Supreme Court justices.
That then forms binding precedent, just like George Washington only having two terms, something that future executives wouldn’t want to change.
