    I am an investor in BOXX, and got walloped by an unexpected distribution, one that evidently requires me to do form 6781. I just need to know how to transfer the values in lines 8-11 to the 6781 form. This seems to do so.

    If I start trading strictly futures contracts under an LLC, what would I have to report other than a Form6781? Would I still receive a 1099B, and would I still need to submit a 1040 Schedule D? Anything helps, and thank you so much for your wisdom!

    If I buy an Options Straddle (long call and long put) on normal stock - not 1256 - during the tax year and I receive a brokerage statement, do I need to fill out this form in TurboTax? Or is that automatically handled via the brokerage statement? Also, does the answer change whether I'm holding the straddle through the end of the year into the new year vs closing it out before the end of the year?

    How do we fill this out on turbo tax for futures options contracts? They should or is there any deduction for the profits I made reinvested and gave back? There should be no tax on gains that are reinvested. And even a refund for money invested and lost.
    Can I use a oic I think it’s called or carry my tax’s to the next year to get the 3,000 deduction unless I am more profitable and have more deductions

    Jason I also received a 1099-B Substitute Statement for regulated futures contracts. How do I input that? Use another 6781?

      A Form 1040 filer would only attach one Form 6781 to their tax return. You can report all of your 1256 contracts and straddles on one Form 6781 if you have multiple accounts.

    Can I deduct for example 2018 losses on 2019 tax return trading forex? Or only for that year what I loss

      You generally always record the loss in the year it was realized. There are special rules for carryback or carryforward of losses.

    Hi, thnx for the info. The info you provide is clear but i get stumped at the point of how to report the tax on the gain onto the 1040. Line 16 of Schedule is where my confustion start.
    So in your example above I would go to the next page an on Line 16 enter the total of the gain (1460+2191), 3,651. The bullets under Line 16 then indicate that if this is a gain to enter Lien 16 from 1040.. which I assume is the tax on my ordinary income?? Then the other confusing part is that on schedule 1040 it indicates that I need to enter my cap gains(loss) on line 7. That makes no sense to me cause then my adjusted income will already include the total cap gain(long and short)...
    If possible could u provide the end result of how this gain tax is eventually reported on a 1040? Please use the simple example you already have and lets say that we selected
    'Net section 1256 contracts loss election' on from 6781.
    Assume that my odinary income is 100K using a the 25K standard deduction.
    I would really apprecite it if you could clarify this for me. According to a friend (CPA), he indicates that my futures trading ( 1256 section rules apply) will be taxed separatley from my ordinary income. For example say I made $1000 in futures contracts trading. then my tax would basically be like this
    Ordinaring Income: (100K- 25K) x 30% (tax rate example) = 2250
    Futures gain = 1000 x 28% = 280.
    Total tax = 2530.
    I don't see how it works out like that...

    Hi Jason,
    Great insights. I rec'd a K-1 for a position that was held in 2021 for 4 months (sold in August). Line or Box 11 of Part III of the K-1 has a Code C next to the gain. Which identifies the gain as a straddle. Should I use Part 1 or 2 of Form 6781 to report the gain? The 1099B shows the position as a loss.

      I would reach out to the preparer of the K-1 and confirm the character. Line 11 code C on a 1065 Schedule K-1 can be either 1256 contracts or straddles.

      @@JasonDKnott Hello, I have the same situation as Harry with the exception of no 1099-B, my only question is: can the form 6781 be filed with no checkmarks for oprtions A, B,C, or D, before Part 1, or do we have to pick one option. Thanks in advance

    Does one have to report the gain/loss on each transaction involving Section 1256 option contracts on the tax form or can I do so on an aggregate basis? In other words, if I have 50 transactions during the year do I need to report the gain/loss on every single transaction or can I just report total gain or loss of all the transactions at the end of the year?

    Thank you for video. Very simple explanation. However, a few questions
    why doesn't the 1099b generate detailed buys and sells like the equity 1099b. how would the IRS know that the aggregates is accurate if they don't receive a detailed list of each transation ... like stocks.
    Finally, does futures trading have wash sale rule applied to it?

    So the elections are optional? That is the most confusing part of this form for me. Is a straddle the same as a spread? All I've done are option spreads. Thanks.

      The elections are optional in that it is possible to complete this form without making any particular election. However, if you want the 1256 contracts or straddles to be taxable in a certain fashion, you will need to affirmatively make the appropriate election.

    Hello Jason! Thank you for taking the time to explain form 6781 in this video. If I received a consolidated 1099B (like your example) do I need to enter anything in pat II or III of form 6781?

      It depends upon whether you entered any straddle contracts or had deferred gains from prior year. If you only traded Sec 1256 contracts, then you only need to complete Part 1. If you are unsure whether you have straddles or unrealized positions from last year, then I would consult with a tax professional to make sure you are reporting everything correctly.

    If I have a 2021 K-1 from a PTP (let’s say USO) that has income listed on line 11C, am I required to list that as income on line 1 of Form 6781 and pay taxes on it (based on the 60/40 capital gain formula) even if I didn’t buy or sell any shares of that PTP during all of 2021. If so, what adjustments are made if I sell all of my shares in that PTP later this year. Is my cost basis adjusted so I don’t pay for the same gain twice ? If I continue to hold onto it this year, how does the 2021 K-1 gain (in line 11C) affect how a 2022 K-1 gain (in line 11C) would be taxed?

      The partnership passes through all of its income on the K-1. Generally, you must report the income and expense items consistent with the character reported on the K-1. If you have 1256 contracts or straddles on the K-1, those are reported on Form 6781.

    I am dealing with a k-1 for the first time for the invesco db agriculture fund. Things for me are even simpler than you show. Why, though, is this not reported on page 2 of schedule e (or should it be)? I guess I am missing something.

      It's a good question! Schedule E Page 2 is only used to report the Ordinary Income (Loss) passing through from partnerships and S corporations, so Line 1 of the K-1. If your K-1 has other items of income (dividends, interest, rents, royalties, 1256 contracts, etc.) those items are not included on Page 2 or Schedule E because they pass through directly to the other relevant schedules on your tax return. Schedule E Page 2 is used to reconcile whether your ordinary income allocation is either passive or nonpassive income.

      Most taxpayers are not invested in foreign corporations, so they generally do not need to complete the Form 6781 or Form 5471. There are some U.S. taxpayers invested in foreign mutual funds which generally qualify as a PFIC, so that may require a disclosure.
