If you followed the breakdown of the unsigned Nijisanji contract by Legal Mindset, he goes over how the contract is actually quite overreaching and seems like it tries to claim ownership of the liver's voice. Like it is intentionally vague whether it is applying to only when creating content for Nijisanji, or simply as long as the contract is active (keeping in mind survivability). As such, they don't need the Ex-liver's permissions. They've already been given permission through their contract terms.

Their contract would get thrown out in court if other courts from other countries saw this. Their contract is so illegal it would take me a long time to point them all out.

Actually, and I'm playing devil's advocate here, because I don't condone how they acted afterwards, the difference is that they asked her to get PERMISSIONS to show graduated talents, which she allegedly did NOT and published the video anyway, while this video confirms they did obtain permissions here.
The problem has never been showing graduated talents, it's getting permissions for that. Did you even watch the video? It's not rocket science, people.

@@NineLives99999 Rosemi and Petra tweeted a while back that their parts are cut out(?) from the live which was speculated due to them forcing the 3d. In the ar live, we now heard(2nd handed, of course, i wouldn't buy that) that the graduated voice are included and since the songs itself aren't edited out(either due to time constraints or laziness), we can assume that the staff did not have enough time to edit out selen's part in songs that includes her genmates since if we heard selen's voice in the live, it would have way worse feedback.
this is all speculative so take this to grain of salt. i also based this on parrot4chan's comment during his latest stream, and the management's ability to puppet their talents like scarle and kyo's apologies, zaion's stuff, and the doki tweets.

Look at everything they’ve done in the past. “Asking” the previous talents that quit (for good reason) is just a curtesy for optics.

From what we've seen in the contract that was shown they are allowed to use the voices, but it is still a dick move to do when it was part of the reason Selen was fired.

I'm kind of on the negative side on the whole using ex talent voices. To me personally I can see folks like Khyo seeing it as a nice last send off but on the flip like cmon there's one voice missing from that damn AR event and thats Selen and we know exactly why. Seeing Reimu be all happy and talking about how the talents worked to on getting Nina, Pomu etc's voices approved, it is just icky to me like come the hell on I get none of them can say a damn word but just this continued acting like Selen never existed just puts a sour taste in my mouth. Thats honestly why I am on the negative side around this.

@@SheenaFujibayashisan Yeah that right there is the issue I have with this debate, not are they allowed to use their voices but how come this time it was ok to use ex-livers. Selen got punished severely for just having a 2 second shot of ex-livers backs (no voice at all) even though Niji owns the models and would have seen the scene months before hand to do quality check and updates but this time they were fine to use them. Regardless if they got permission to use their voice, I don't think it should have been done.

I think when they signed the graduation contract, there might be these term within it. Knowing how Niji work, they definitely have prepared the doc before hand.
First of all, it's SELEN, not "Selene". Secondarily, what you say is irrelevant to the context. Nobody said anything about using her voice.
The video itself shows proof that they did ask permissions. People mistook Mysta's tweet for a sign they did not and he replied, using his own private account, that dramafags came up with that with their own headcanon. They did get permissions, period. Selen did not. Are they still a terrible company? Absolutely. But there's nothing to suggest they were hypocritical in this specific context. This is a nothingburger.

It is just interesting that the only talent that might raise a war against Kurosanji if they dare use his voice files is the only one that does not apear at all. considering the lore she and elira probably had quite an amout of duos together on this concert.
I'm almost positive that Niji had full legal ownership of those recordings the graduated livers made. Not that I condone it cause it does still feel weirdly icky with how mismanaged internal rights issues usually are there, but in this instance I'm pretty sure the graduated livers were made aware that the vocals they recorded last year were still gonna be used in AR Live when it eventually came out after they graduated, and there's not much they really could have done if they had a problem with that
Niji completely had the ownership, which is why Selen's suspension back then doesn't make sense

In this instance, the livers made recordings while working there, and Niji still have the legal right to use the recordings even though they're no longer working at the company. In the case of the Selen video, it was a Niji liver not getting permission from Niji to have other Niji livers in her video... there was no legal issue and this wasn't even because the video had graduated talents, Niji still owns the designs. There was just some spiteful Niji higher-up that didn't want her to release the video so kept delaying her permissions, then got mad that his useless ass was ignored when she posted it anyway
They don’t have to own the persons voice, it’s covered under their company property part of the contract. If it was used then they can maintain the rights themselves, and repost/take down what ever they want. The evidence is all around.
That's not the issue, the issue is that they reprimanded Selen Tatsuki and took down her video because she didn't get permissions from former talents to use their image in her music video, that she spent a lot of money on, therefore they took it down, leading to her having a breakdown and an attempt to her own life.
Unless you are completely unaware of what happened in the past months, you should know that, it made a lot of buzz.
Such permissions are not LEGALLY needed. It's just a formal courtesy and an internal rule to the company, from what I can tell.
That said, if anything, this video shows they DID get permissions, therefore it's a nothingburger. This doesn't disprove anything nor prove anything, as it doesn't make them come off as hypocritical.

Maybe I'm misunderstanding, but that Reimu clip doesn't really say they got permission from the talents at all. What she says is they asked staff, who is neither Nina nor Pomu, to use their vocals, and staff said, (using Reimu's paraphrase), "We'll check with the team." who again, is neither Nina nor Pomu.
It just reiterates that the Nijisanji talents need to check with staff to use footage or vocals related to previous livers, but it doesn't confirm that they got permission from the former livers at all. Then Reimu goes on to suggest that at least she and Nina are still on good terms as she presumably sent her a friend code to the event.

No where does she say "Nina" was asked and you seem to be forgetting CyYu's experience where they 1000% wanted sole ownership of the voices. Besides it isnt like they are making AI recordings of the talents, they are using previously recorded songs. They probably just like having the red tape to dissuade talents from asking for stuff, because it has to be sent back to "the team".

Just to add to the discussion: there's a HUGE difference between featuring ex-livers voices vs featuring their images in media when it comes to vtubers.
For voices, Nijisanji doesn't own them. They need to ask permission to use their voices in things after the livers are gone (which I sure hope they actually got for that AR Live).
Their images, however, are company assets. "Nina Kosaka", "Mysta Rias", "Pomu Rainpuff", etc are all characters that belong to Nijisanji, even if the names are heavily associated to the streamers who used to give voice to those characters.
Selen using their images (again, company assets) for a few seconds in a clip, under a positive light (aka: not mocking, insulting, belittling, etc the ex-livers) should have presented 0 issues and require 0 permissions because those images belong to Nijisanji/Anycolor. Selen would have needed permissions, for example, if the song featured backing vocals from ex-livers.
Just wanted to add this, i saw a lot of people comparing the use of the ex-livers' voices in the AR Live concert to Selen's use of their images in A Last Cup of Coffee, i wanted to point out the 2 situations are not necessarily equivalent to each other.
You don't know what's in their contracts. There could be a clause that said the company can use everything the talents make when they are working under the company.

And you're right, their use of ex-livers' voices in the AR Live concert is most likely covered by the contact because everything was made while the livers were still under the company.
When I say that I hope they got permission to use the voices, it's because the use of those voices is monetized (it being a paid concert and all) and, with the livers no longer being associated with the company, they'll most likely not be paid for that, so the least niji could do is to make sure the livers are okay with it.
Tho, to be fair, I doubt any of the graduated/terminated livers would want to beef over their voices being used in the concert, they all seem to be very intent in doing their own thing and moving on from Niji.

@@Swagpion not necessarily, and part of it might be from regular typing habits for what autocorrect recognizes or doesn't - so one person's autocorrect might recognize it while another's might not, not to mention there are different autocorrect bases for programming which might not register the same names (or even words if they are obscure or unusual enough)

As much as I h@7e Kurosanji I would venture to say since they own everything from jump, the toons, the equipment, even personal devices if you used them for work, music (the coffee song remember) pretty safe bet that the voices that went with the character AT THE TIME OF RECORDING is all covered under their copyrights and signed away in contracts.
Even if they asked I don’t believe they would actually have to and it wouldn’t matter if the former talent says yes or no. They can do it anyways.
Also don’t forget about the fact they sc3wed over Ghost Data. The second the music is finalized it’s Niji’s.

As far as using ex talents voice, what people need to remember that when those were made, it was made with the consent of everyone involved. I believe whether they published it on time or they published it later when some of the talents involved is not there anymore doesn't really make a difference. So technically they can definitely use Selen voice as it was in the recording and Selen can't sue Niji for it. Heck, they probably can publish it with all the ex talents not being cut (obviously this will be really awkward). But of course with Selen, Niji probably want to actively remove any trace of her involvement because of the bad blood between Niji and Selen. If Niji ended up asking for permission from the ex talents, it is probably just a courtesy instead of a necessity.
Am I missing something or did Reimu not state anywhere in that clip that Niji had gotten explicit permissions from the talents themselves? Cuz I don't trust their management enough to take her saying that management said it was okay as good enough.
Also, let's keep in mind that Niji likely did have permission to use them when said talents were still part of that corporation. But, once the talents left, do we honestly think Niji took the time/effort to make sure it was still okay? Cuz I sure don't, given their track record. 🤷♂️

Simple and clean, this is a theft of their talent and labor. None of the graduated livers will see any of the money that will go to the company. Corporate theft, wage theft, is never seen as an issue when it is a massive one. And it's worse because fans will be happy to hear the voices of those they supported in their previous roles when that should set off alarm bells because it shows the company is willing to exploit their talent even when the person is *NO LONGER* their talent.

If the ex talents accepted to do this despite no longer being in the company then yeah its a nice way to send them off. But this is kurosanji and as people are saying. Aparantly selen wasnt allowed to do similar when she did what she had to do for the music video, but the company didnt managed to do what they had to do.

Every one who's voice was in the concert ended in good terms with the company, they had a graduation stream and a farewell from their coworkes... I know that people are weary at Niji but, seriously, had you ever had a job before???? This are mostly just business.

My personal headcanon is that the recordings were taken before the slew of graduations/terminations, possibly discounting Zaion and Yugo, (I haven't read up on who Yugo(?)/U-san is, Doki's Backrooms stream is the firstI heard of him.) They decided to cut the recordings of the former talents because they were no longer a part of NijiEN. Then management either were asked by the talents to include Mysta, Pomu and Nina's voices as one last project together, or wanted to profit on them without crediting. Selen, Zaion and Yugo are exempt because they were terminated and therefore not in favorable terms.
While writing this I noticed how the graduates were from Luxium (Mysta), Lazulight (Pomu) and Ethyria (Nina), while the others were terminated...
I don't think that favoritism necessarily means "some get good treatment while others get bad" as many tend to think of, the graduates did still seem to come of as if they were let free of a POW camp upon their redebuts. But it doesn't help with the favoritism allegations. Also yeah if they didn't need perms for the likenesses of former talents in the AR Live, why would they need them for Selen's MV?

Well, the voice of John Lennon just got fully recovered from the recording of "Now And Then" last year with the aid of AI. So to edit the voice of graduates out without ruining the recordings may not be an easy thing.
Also, I think like all recording companies, the company holds the copyright of all the song that was sang while the performers work for them. Therefore I don't think it's wrong to include their voice on a show that's after they've graduates, provided the recording happens while they're still employed by the company.
However, since this effective make the graduates still participating in the show, I think it would be fair to use the older poster that still got the graduated printed on it, since now they're officially part of the show.

They didn't have to watch the free part of it on UA-cam because it was exactly the same as what was already being broadcast if you paid for it. i honestly don't understand the legality of using someone who is no longer with the company as a way to make money. if they had permission from the talents then that makes sense, but i also wonder how much it was a 'asking for permission' and how much of it was a 'condition of us allowing your graduation' or otherwise under duress. i honestly expect it was probably either under duress or they lied tot he graduating talents about them having the rights and snuck in them signing away permissions in whatever graduation agreement they had.
I think they did according to the contract but even then, it is extremely disrespectful to do so, considering how the ex-livers dislike or hated the company and how they were treated, and this shows how lazy and scummy Nijisanji is. If this was any other Japanese studio, they would be out of business in shame.
They likely didn't ask permission from the ex-livers but they also absolutely don't need to. The song is likely owned by Niji so anything they do with it is their business, not anyone who has left the company. Companies don't just ignore an employees' work because they no longer work for them, that'd be silly.

They're technically not obligated to ask for permission because the company legally owns rights to the character IP per contract. (which is why they don't take their characters with them when they graduate)

The copyright issue with Coffee was that Selen used the assets without permission. From the contracts, Niji is the Copyright holder on that stuff, so they themselves don't need to ask anyone to use it. They can use images and voices as they see fit as long as its related to the persona they employed.
Backing that up is what Reimu said. Sounds like the Livers talked about rerecording everything so that the Graduated Talent wouldnt be used. But Niji staff conferred within the company to determine that they were within their right to use it and didnt want to spend the money rerecording everything. despite this being a paid event and the recordings being a year out of date, so used it as is.
Thats why is is a weird clash with the Coffee incident. Selen was punished for using company material to make material for the company, simply for not jumping through the right hoops first.
Then Niji do it themselves, most likely to save money, but only do it for some songs, leaving some Livers with half their screen time cut.

Personally I feel everything is a little hypocritical, didn't they remove ex-livers' portions from the AR live such that Petra had to apologize for not appearing as much? All while also removing ex-livers from promotional material. But Nijisanji still kept their voices in? It comes of as them being lazy to reshoot the whole thing.
Looking at what Reimu said, I'm confused over what happened. Did they re-record some parts? Then what was Petra's apology for? Was it not for cutting off segments of her with ex-livers? People that watched the AR live, how was it with Petra, how small of a segment did she have?
