“I would like a copy of my entire claims file to include all service treatment records, personnel records, DD 214 and rating decision/s to include code sheet and any compensation and pension exam from the VA and any third-party contractors. The entire electronic claim folder on CD.”

How I obtained a copy of my Summary/Breakdown letter.
I called the VA at 800-827-1000 and inform them that:
“I would like a summary letter/disability breakdown letter to include, all my service-connected conditions, percentages and diagnostic codes.” (if you are not service-connected, you will not have one). Also, you can have them email or fax (if you don’t have a fax at home, you can download a fax app in the play store on your phone) this information, if the person doesn’t want to email or fax it, hang up and call back and speak to someone else.

I got the decision in a week cause it was priority i am 1oo %service connected p&t ptsd mst and a bunch of other physical ailment my letter said i have the highes benifit i can give i asked for the one time car allowance to help sustain my independence cause of my service connected rapefrom active service and the perpertrator found guilty also was medic on ranges when people were blown up anf to pick up and bag age18 i was told to do i take care of the living not the dead but i did abd still gor a article 15 that why after 3 yrs i ets pfc wasnt fair the commander held it agaunst me personally i was very youn v it was traumatic i really need the car allowance im 60 after ruining my life they give 7 months back pay for decades of hirt and i have to spend it on a car not even brand new i feel my co i ntry and givernmrng has failed me i feel i have no worth even with the percentage sc and pt

@@DewayneKimble is there anyway that I can have you look at my ratings to see if my award letter is on point. I’m happy with my decision but I want someone with experience to look over it in case there’s something that I may have missed?
Mr Kimball, I have an attorney assisting me with my claim. For some reason, I feel things are dragged along because after all, attorneys seek lump sum outcomes for most vets. I find it hard to believe they attempt quickly resolve the cases.
That is correct, this is something you can do with the proper education.
Attorneys come minds handy when you been denied. My buddy lawyer got him service connected for ankle,shoulder and back with no STR or civilian records.He had been out 20 years or so
If a Veteran wants to get the earliest effective date for the claim, would that veteran need a "HIGHER-LEVEL" review to point out the CUE to get the earliest effective date.

I served in Iraq 2004-2005 I am 100% PTSD I’m 30% asthma 50% obstructed sleep apnea I submitted claims under the PACT Act and was denied on all. Next paragraph favorable findings says veteran served in approved area . Also has a service connected chronic disease. Etc. WTF?

Hi Dewayne, 13B Army Vet here. I missed the live stream but I turned on all notifications when it happens again. Have you ever run into a vet that’s 80% but bumped to TDIU but wanting to open some claims to get 100% scheduler? Or do you have any tips? I’m TDIU since 2013 but now have a wife and baby. I don’t work much because of my injuries but occasionally I deliver for Uber eats when we need a few extra hundred bucks for expenses. Would like to go from IU to 100 scheduler and can use some tips. If I file secondaries will they take the IU? Thanks!

The VA sent me their Decision Letter this week
They denied all 3 claims: Prostate Cancer w/ ED & Kidney Cancer
The Letter seems to contradict itself:
The VA says that they concede I have disabilities, they concede that I was exposed to radiation and they concede that I participated in a TERA (Toxic Exposure Risk Activity) while performing my job as a Missile System analyst Technician ( EMT Team Member ) in the Air Force.
But then they also say that the disabilities that they concede that I have were not caused by those activities that they concede I was exposed to in the Air Force.
Sounds like Government double speak ( talking out of both sides of their mouth.
I will be appealing

I have been waiting for over six months just to get copies of my DBQ and TERA which the VBA sends to the National Archives and they did not arrive in time to have the evidence in my hands at the time of the higher level review. This is inexcusable. The VA has a "duty to assist" and a governmental requirement to be efficient. the VBA is neither. The higher level reviewer called me and said that this was the interview. I told him that it was not because I had not been provided the evidence that I was entitled to and the failure of receiving was with the government. VBA higher level review closed my case, after he told me he would discuss the matter with his supervisor to reschedule.

I don't know why the government has said more about Panama and VA compensation. Good question for congress.

Can you answer this about VA car allowance?
I can't seem to get a straight answer.
I have 100% p&t plus SMC including aid and attendance.
I don't have prosthetics at all but I do have a TBI and have seizures. I am not able to drive and in fact the doctor took my driver's licence.
I have home care and I have to use public transportation which affects my other disabilities.
Do I qualify for VA car allowance?
Do you qualify per the VA criteria for the car allowance. You have to review the regulation and see if you qualify. Just because you can't drive is not the single criteria for that benefit. Hi
I am caregiver for Vietnam Veteran with 100% disability for Parkinson’s. I get a monthly stipend at level 1. In our option I provide all his ADL’s and requested to go to level 2 and was denied. Appealed with added info from his Neurologist where Dr said “ he can not maintain in the community” which are the magic words according to VA.
We were denied again. Don’t know what else to do. Several interviews by the Caregiver Social workers said they stated since he needs so much care I should be elevated to level 2 stipend.
Do you know much about Caregivers program?
I know of it but it's on VHA side of the house, I focus on the VBA side. Have you asked for the criteria for each level.
Good morning. I have a higher level review claim currently pending as we speak; however, I decided to go back and read their initial decision letter, and I was kind of shocked about a statement regarding a visit for a separate issue. the claim was completely inaccurate and misrepresentative about a shoulder injury I had years prior. This was used to make their initial decision in my estimation. How can I retort this? Can I?
The rating decision would have to be reviewed and then we can give you your options per VA guidelines.

What I didn't know when I went for my exam I wasn't educated on the process and when the doctor stated she didn't have any records so she couldn't do a through exam. I didn't call and ask for another exam...

Dewayne, I am at my end of the line! I need to get someone that will listen to the problem and the mistakes made by the VA with regard to my crecords & claims. I was at 100p&t but they are stripping it back to 93% because they said they made a unmistakable error. I had a nexus from a Colonel, full bird, flight surgen, and it was ignored. I had a TBI in Afghanistan 2014 so I'm getting very confused about going forward.
I have yet to find a vso that has the time or knowledge to help me.

I recently did a C&P for restless leg syndrome, is this hard to prove if I have no documented info, but have the symptoms. I’m prescribed meds for anxiety and sleep that doesn’t help. And also I have an upcoming sleep study for sleep apnea, are these two linked?
What are the diagnostic code criteria for that condition and do you have evidence showing you meet that criteria.
