And there's is no written document required for wife to becomes owner of half the property. And, A wife has half a share in her husband's property while he is alive, and after the husband's death, all the property becomes wife's. First , clear the definition of " shared household" and explain the term " constructive household" as per the judgement of UU Lalit given in 2022 when he was CJI for 2 months before DYC. Second , isnt it interesting? The property is made by FIL and now if he tries to sell it then for all practical purposes he wont get buyers with right to residence order in place... Second, under the very same DV Act , the poor DIL ( left in the state of destitution and vagrancy - very common line found in every petition) can enjoy life with her boyfriend / boyfriends , do everything and ofcourse occassionally make false complaints to court / police - under Protection Rights ( Sec 17, i guess) under very same DV Act against aged in laws.... Torture ka complaint hi toh dalna hain na....Kon sa proof chahiye ? Rape case mein laadki ka statement hi kaafi hain prosecute karne ke liye toh DV Act toh Quasi-Civil case hain.... And ofcourse , you missed something perhaps its not related to property.... There is a recent judgement where court ordered FIL to pay " maintenance" to DIL as husband has died.... Another interesting thing you mentioned - Right to residence cannot be claimed in MIL's property....
