    Not just stress, but any kind of sick leave. I know a few people fired during cancer treatment. Also, lost insurance. It didn't end well.

    This is a good video, IMO. And many employers will use a variety of tools to force you out if you do use too much leave, especially PTO outside of approved FMLA. It is always worth exploring your employee handbook, policies, and requirements surrounding PTO. For example, some employers have a discipline policy around "unexcused absences" such as calling in sick without supervisor authorization. They'll count an unexcused absence as half an absence and it will count towards a rolling period, so just be sure to read all documentation.
    If the stress really does evolve into a condition protected by the ADA, then you really do have a lot more options available to you in terms of legal protections, as this articulate lawyer explains. And yes, as one person pointed out, there may seem to be very ableist overtones to it all... the modern job environment is very ableist. But that doesn't mean that you can't fight back and win with a disability... you just have to play the game well, learn the law as best you can, and consult an attorney when things get too far out of hand for you to handle and/or if you have been fired unlawfully.

    It's still a world better than quitting. I agree that an ADA/FMLA qualified stress leave is part of an exit strategy. It needs to be done expecting an adversarial response from the employer. I make triple sure that it's fully documented by a health care professional as a qualified disability. Know this: You'll get an exit check, NOT continued employment.

      They can’t fire you for the FMLA time , once it’s approved. But, they can nickel and dime you for other reasons. There is some risk in this for them if you can prove retaliation.

    I took stress leave due to issues with my then-boss (the CEO's daughter), which I disclosed during an occupational health assessment. Upon my return, my employer attempted to subtly push me out. I was ostracized, and management used colleagues to provoke incidents. When this failed, they recently offered a departmental move, which I accepted. I see it as the _The Departure Lounge_

    I am currently on stress leave. Honestly, I am in the position to lead a team and I just feel so hopeless. I have fought for a pay increase for my team, I have fought for only to recognize the team out of my own pocket…I feel so hopeless because the hard work of my team is undervalued by management and their pay sucks. Lord, please help me with my team! I am on the verge of tears…
    My manager seems to only care about themselves. She told me that I must learn that I can’t fix everything which doesn’t resolve anything.

    In EU doctors not allowed to share with company why you have sick leave and you do not need to tell your boss the reason. It is a private matter.

    I have to go on stress leave so often. It's because I already have a diagnosed mental illness + my boss gives me more work than to my co-workers because I am a high performer. So yeah, I get more burned out because my workload is higher and I already had a diagnosed illness.

    If you want to know what stress is, be unemployed or work a min wage harsh job to the point you live out of a storage unit and eat cheap food but go hungry every other day because food stamps don't have enough to eat daily and you have no car to go to a food bank. I assure you, after that office stress will roll off your back. 😉

    Mr. Robertson, Thank you for this video. In my case I went through FMLA as my employer was asking me to quit my job. There was retaliation and my life was made very difficult such that I could not function. It was INTENTIONAL EMOTIONAL DISTRESS the administrators was causing. Several agencies like EEOC/DFEH and department of Industrial relations have been alerted to the ongoing discrimination. My former attorneys are not replying to my emails/voice mail. What should I do?
