    Hi! I submitted I130 few months ago and I mistakenly answered #61. I should’ve left it blank since it’s not applicable. I haven’t received an approval yet and case is still being reviewed. To avoid filing I-824 when the case gets approved, can I file typographic error on this case? Thank you!

    Hello, I have submitted my application for the O-1B visa. On the I-129 form, I made a small mistake-on page 2, instead of marking option B, I accidentally marked option A. Is there a way to correct this? Or just to be safe withdraw the whole application and send it again?

      I’m not sure if you chose the incorrect option on question 2 or 3 on page 2, but either way, it is important to try to get the correction submitted as soon as you can. Our recommendation is to submit an inquiry/request for assistance through your online account. In our experience, this is the kind of error that can lead to a denial, so if an applicant cannot correct the response through the online portal, it may be best to pursue a case through the USCIS Ombudsman, which can be done here: www.dhs.gov/topics/cis-ombudsman.

      In situations like the one you describe, we would advise the applicant to correct the information at the interview. It might be a good idea to take the information written out on a page and hand it to the officer when you begin discussing the form, just letting them know that you accidentally left the information off the form.     I sent out the I-129F packet last Wed, but I'm worried that I forgot to include the date on the form. I recall signing it but may have forgotten to include the date. I'm expecting a request for evidence (RFE) due to this error. Is there anything I can do since they haven't received it yet?

      Hello,
      In our experience, failure to include a date with a signature does not necessarily result in rejection or denial of the form, though the mail-room contractor may return your packet to you if they deem the signature insufficient because of the missing date. If the packet is rejected, it will be returned to you without being processed. You can then enter the missing information and re-submit the packet. If the case is accepted and you are sent a receipt notice, you can then create an online account for the case and through that portal submit an “e-inquiry” notifying adjudicators that you would like to enter a certain date next to your signature on the form. Hopefully this will not be a fatal oversight - we have seen many applications adjudicated even when an applicant did not include a date with their signature.

      Signatures are only required from the applicant in one place on each form. USCIS will reject any form that is filed without the correct signature, so if they have already accepted a case and issued receipt notices, the signatures should have already been deemed correct and complete.

    3. have you ever violate the terms and conditions of your non immigrant status?
    Is that detrimental to my case?
    on form 1485 they were supposed to be YES

      In a situation like this, we would recommend submitting notification to USCIS that those answers need to be corrected. If you have an online USCIS account, we would recommend submitting the corrections there.

    On the I-130, the petitioner wrote the name of the beneficiary in the column she was supposed to sign for I-130 , how can it be corrected and does it mean the petition will be rejected ?

      In our experience, this kind of error is likely to prompt a Request for Evidence from USCIS. When that is issued to you, you may submit a response that explains the error and what the correct dates are. We would not expect this kind of issue to cause a serious problem for the case.       In our experience, the main concern with address-related errors is making sure that the card is properly delivered. If you have an attorney and indicated that you want the card delivered to them, then it should not be an issue. Otherwise, we would recommend going through your online USCIS account to submit a correction, if you have one, and if you do not, making a call to the USCIS contact center and also sending a letter to the service center where your card is being processed.

    Hello! I accidentally type and submitted my current address (Zipcode) on employer Zipcode. For instance, 12345 is my physical address zipcode. i put 12345 zipcode in employer history zipcode. I was suppose to put different zipcode in employer but it's a typo-error. is that going to cause/ delay the case? It's been only a week that i summit the form.       In our experience, a mistake on a zip code for a past address or employer address is unlikely to cause a problem. For the current address information, it is important to ensure it is correct so that mailings arrive safely.

    What is considered serious errors or mistake in filling out forms?
    I made a huge mistake for not putting my maiden name in other names used section both in i751 and N400 also under N400 form i did not put my stepchildren which my husband's adults daughters, and I entered a wrong ended marriage of my husband would these amount of mistake put me on trouble?       In our experience, the best approach is to tell the officer in your N-400 interview right away that you need to make corrections to your application. The interview is a chance to ensure that the form information is correct. If you are able to hire an attorney to accompany you to your interview, we would recommend doing that to ensure that the officer is respectful and follows the law with respect to making those corrections. If the response from USCIS is not clear, showing that they have updated the information within 30 days of our request, we would then call the National Customer Service Center at 1-800-375-5283 and report the issue.       This is a common mistake and easy to do because the form is not necessarily well-structured or easy to follow. In this case, it seems likely that the I-130 may need to be re-filed. In addition, it might be a good idea to contact USCIS via the petitioner’s online account and attempt to withdraw the I-130 that was filed incorrectly.       Hi, I filled an I-131 for my brother a couple years ago and I forgot to add a last name and mistakenly put his year of birth with a year difference.the beneficiary was scheduled for interview overseas on the 29th of the current month and the officer noticed the errors at the time of interview, canceled his interview and told him to reach out to your petitioner to get it fixed with uscis. When I called uscis for instructions they told me to refile I-131. I don’t think I have to redo one again. What’s your recommendations? Thanks.

      If you have an online USCIS account, we would recommend submitting a note through that portal to inform them that the date of birth has a typographical error. Otherwise, you may do so through this link: egov.uscis.gov/e-request/displayTypoForm.do?entryPoint=init&sroPageType=typoError. If you submit the notification of error outside your own online account, it will be a good idea to capture a screenshot of the submission and save it.     Thank you for such a helpful video! I made a mistake not including my mother’s name and address in native language on our paper I-130. What should I do? Should I call them or this is not a crucial mistake and it might get accepted?
    Second mistake - I don’t answer question 61 (or 62) - where we will apply for adjustment of status. I filed I-485 with I-130.
    Do you think it will this be rejected? And - in that case - can I resubmit without paying twice? Thank you!

      In the case you are describing, I believe it would be worthwhile to resubmit the corrected I-130 if USCIS has already issued receipt notices. It would not be necessary to pay again, but re-submitting the form with the receipt notice should enable USCIS to amend the filing.       In our experience, this is a common approach because many beneficiaries of I-130 petitions have lived in the USA for a long time and no longer have any foreign address. We have not seen problems with this; however, if USCIS needs clarification about their addresses, they may send you a Request for Evidence.     Hello, I just filed my i130, but when they sent a notice that they received my application, it went to my neighbor because I put the wrong apartment number. It got to the right, building but not apartment. I have tried to change my address online, but it days I can not change at this part of the process. How can I fix this problem?       How frustrating that the system is not allowing you to update your address! Submitting a “typographical error” message is probably the next best option to the change of address for the moment. On the other hand, since you already have the receipt notice, it is likely that you won’t receive another notice for a few months at least - perhaps waiting a week or two to see if you can then update the address is the best approach.       If your husband’s case is at the NVC, they should have provided instructions to you about how to proceed. In our experience, if an I-864 is rejected by the NVC, they request correction and resubmission.     Hi I recently filed an i90 and I made a wrong selection for reason on replacement. Instead of selecting 2a my previous card has been lost, stolen, I selected 2b my previous card was issued but never received. Usps lost in mail and I never gotten it, but the instructions form says it needs to be undelivered and I need to choose pick 2a instead of 2b. Do you have any suggestions on how to proceed?       In our experience, it is a good idea to update and correct the information on forms and applications whenever an error or omission is discovered. If you have an online account, you can upload birth certificates there and request that USCIS update the information you have submitted.

      In our experience, if you’ve already submitted the correction, it is unlikely that a social security number error will cause a major delay. It might be good, if you filed online, to upload a copy of the social security card as evidence, if you haven’t already done that.

      Hi!
      An incorrect date of birth, if left uncorrected, can cause problems after the card is issued. It will be important to submit ID documents such as passport and/or birth certificate to demonstrate the correct date of birth and contact USCIS to let them know about the needed correction. If the application was filed online, you should be able to submit an e-inquiry there; if not, we would recommend calling the USCIS Contact Center and request an “Infopass” appointment so that you can be certain that the error is fixed.

      If the I-130 was filed online, you should be able to submit a notification through the online portal that there is a spelling error. If you filed through the US mail, then you may still create an online account for the case using the number assigned on the receipt notices. Finally, electronic notifications about issues like this may be filed through the uscis.gov website at egov.uscis.gov/e-Request/Intro.do. Best of luck!

      In a situation like this, we would recommend simply putting “N/A” in the field where the spouse info is requested. If NVC wants more info, they will follow up with a “Checklist.” Then, we would recommend responding with a sworn statement explaining that the information on the I-130 was an error.

    I file my i751 form but I sent it to the wrong USCIS lockeroom.
    The uscis have 2 different locations depends what state you live at.
    I should' ve sent it to IL, but I got confused and I sent it to AZ.

    Hi! I'd just like to ask something. I've just noticed that there's an error in our I-130 form page 3 (Information of all Spouses). And this error is massive! 🤢 From what we understood, spouse 1 is for the current wife. I have no idea how section 21 in I-130 (date of marriage ended) is populated. I guess when my husband was putting the information, he put his ex wife's detail in Spouse 1, but later moved it to Spouse 2 which is correct, but he forgot to remove the date on which his current marriage is stated. Basically, it should be left blank.
    PLEASE let me know what we should do to correct this. Thank you so much!

      In our experience, a minor misspelling of a name should not affect the ultimate outcome of a case. It will be important to make very clear to USCIS or the National Visa Center or Consular Officer handling your case what the correct spelling actually is so that your final resident card is issued with a name that matches your original documents. Otherwise, getting the misspelling corrected can be a hassle and take a long time.

    My husband filed for my immigration and he mistakenly wrote “single” marital status for both of us.
    Plus he wrote wrong city of birth for me😢
    We filed online just received out receipt notice yesterday
    What to do?

      In our experience, an innocent omission on the employment history section of the form I-129F should not cause a major problem for the case.

    We, while filling Form
    I-130A, made a huge mistake.. need ur help..My wife is from USA and she applied for me online.. So, this form of I-130A was supposed to be filled by me, being the benificiary cuz it required all of my information.
    But on the first page of the form, I mistakenly filled all the informations of my wife who applied for me..
    and in the next all pages of I-130-A, I rightly put my own information...
    So, i want to let them know and correct it only to the extent of the first page of I-130A..
    my case is approved and at the first stage of submission of the required fee with NVC...

      Congratulations on having your case approved - even in spite of the mistake. In our experience, it is easy for petitioners and beneficiaries to mix up information on Forms I-130 and I-130A because the format of the forms can be confusing. If a client of ours had this same situation, we would recommend simply proceeding with the next step of the NVC process, and include a notation in the case that indicates any errors that were made on forms previously filed, if possible - the DS-260 may not allow for inclusion of a notation like this, but we may try to upload a signed statement identifying the errors along with the other civil/supporting documents. If nothing else, the interview at the consulate gives applicants the opportunity to bring up and identify any errors that may have been made and request corrections.     I made a mistake and didn’t mention that my sister which is 17 yrs old is accompanying my mom to US and now my mom alone is approved and waiting for Visa interview. What should I do now? Should I fill I824? Or resubmit I130 or request to correct the form and put my sister in the consular processing?

      Hello,
      If your mom is applying as the parent of a U.S. citizen, then unfortunately, she is not able to include children as derivatives, so listing the 17 year old child would not enable that child to also immigrate at the same time through your petition. Once the mother has completed the immigrant visa process, then she may petition for her minor child (so long as the child is unmarried) and allow the child to complete immigrant visa process relatively quickly. U.S. citizens can also file petitions for their siblings, but the wait times in that category are quite long.       We recommend that your son check all of his spam folders and other filters to see if there are any emails there from USCIS. Hopefully you will find the missing communications.

      In our experience, a minor error on a medical form does not typically cause a problem. If USCIS has questions about the discrepancy, they should notify you via Request for Evidence.

      Yes, sometimes errors on forms can cause delays in the case. Sometimes USCIS will also reject a form if specific mistakes are present. If they reject the case, the form, packet, and payment are all returned to the return address of the filer or to their attorney if they have one. The rejection process usually takes several weeks. We recommend that you verify whether the payment for the case has been cashed by the bank. If not, it may be advisable to stop paying the filing fee and re-submit the packet with corrections. These are steps we have taken for clients with similar situations.
