Mojang had no contractual authority to set a deadline or mass delete accounts, period. Deleting accounts impacted everyone who lost an account, and the statute of limitations is not over on that yet. Alpha customers were not required to migrate. Their contracts promised them service without jumping through more hoops to receive it. When Mojang went on twitter and said migrating was mandatory, they hit the final nail in the coffin of their position by openly breaking the law. Nobody has a right to force or coerce someone into entering a third party contract under threats or duress to invalidate another contract.
All who owned legacy accounts that were deleted received account codes to get a new account for free so there wouldn't even be any monetary losses making a case for that situation harder to make.
remember, DO NOT HARRASS ANY EMPLOYEES ESPECIALLY DEVELOPERS FOR THIS. they have NOTHING to do with mojangs issues, the people that are responsible for it are the lawyers and higher ups
1) I wasnt expecting to ever be this excited about a lawsuit that while not directly including me will still have a major impact on my life. 2) I wasnt expecting it to be completed so damn fast, people must really want Mojang to be held accountable if they are willing to put so much money together.
It was at 50% done in less than 30 hours, people really want justice, not only for the crimes Mojang has committed but also because the community is fed up after everything they’ve done.
I imagine they'll probably need a lot more than $100,000 for a full legal trial with mojang, however I doubt it'll ever get to that. The case will either be dismissed, mojang will just reach an agreement, or the person who's meant to be filing this lawsuit just doesn't do it(I personally believe he'll try but it's possible)
@@NoShadowsHere essentially, mojang broke a number of laws regarding how legal contracts must be written, neglected to notify their customers of the TOS changes (as they are required to do by law), and then actively tried to cover up that they broke laws. if you'd like to learn more, check the video description - op linked the video by the person leading the lawsuit, which explains the situation pretty thoroughly

Happened with activison a few years ago so definitely possible ( basically a zombie dlc keep crashing at the end of the level and they fix it only on pc because they didn't wanted to pay the update fee, they were force to fix it)
1:00 what are the risks in donating? Like will Mojang gonna hunt every donator down and ban them from the game? Is it a concern that people may not *know* what they are actually donating to? If so why? I’m very confused.
Honestly Mojang is likely to fall back to Microsoft to defend them in this Lawsuit, which what seems like the crowdfunding only gained about 90k usd, which isn't much in terms of a legal battle against one of the most well known game studios in the world
2:22 there is the third option which is also definitely possible that the lawsuit is settled out of court and in some way the eula is changed &/or the suing party gets monetary compensation. this is bad press for mojang, so they may just want to get ahead of it before it gets bigger. maybe not the most likely but possible.
@@PineaFan Settling out of court isn't brushing it under the rug. Mojang still have to pay, and the suing party still negotiates terms. It just means instead of negotiating with a third party that decides what the outcome is, you're directly negotiating with each other.
Unpopular opinion: It's not only Microsoft, Mojang is being awful too. It's not 2016 anymore guys, Mojang changed for the worst unfortunately, we just have to accept that it's not the Mojang we used to love anymore.
Don't forget: This isn't about the guns. It's about the SUPER VAGUE rules in the eula having cost mod creators and server owners their livelihoods/income. It's about the people who weren't chosen as an exception like Hypixel was for no reason other than Because They Felt Like It. I may like Mojang, but I don't support their actions regarding all of this. I stand with Kian.
Personally I enjoy Mojang’s games, but like some other game companies I dislike the company itself, the corporate parts at least In other words props to the Minecraft game developers you did an amazing job, same to the artists, and to those who make the rules you can leave through the window because you don’t deserve doors.
@fldom4610 As someone who played Destiny (1&2), I've come to learn that the fault doesn't rest solely with the bigger daddy after a couple years under a parent company. People with different ways of practicing business will change in that time, and creative people whose contributions weren't fully defined may slip out in that time too. Even if you were to separate them now, you can't guarantee things will go back to before, and could even get worse.
@fldom4610 mojang most definitely IS at fault, microsoft isnt forcing every change on them. Remember they're a massive company and cant babysit mojang. So all these shitty changes are most likely mojang and not microsoft.
@duckyduckington9736 a mojang employee exposed Microsoft before, they DO control everything mojang does. Mojang contains only the developers and the designers, the guys who make decisions are Microsoft
My favourite thing about the internet is that people genuinely expect a billion dollar company to respond to a potential lawsuit outside a court room. Regardless of what happens with this lawsuit, Mojang was never going to respond in a youtube video expecting that is just silly.
Getting negative press and fighting a battle against the community for years hurts your PR a lot more than saying "oops some low-down underlings didn't understand what the law meant, ok you can have an obscure gun server if you want."
In the US there is case law 'Douglas v US District Court' which informs similarly on the matter of clear notice of EULA and changes to the contract. Part of it states that it is onerous/unreasonable to expect a party to have to read/review a contract every time they intend to benefit from the agreement, or to review the contract under a particular set schedule. Therefore, case law was established increasing the obligation of the company to inform the customer. If it went to court and the lawyer did their homework, a similar result could be achieved.

I find it funny Mojang has stated that it's against EULA yet never takes any actions against servers, even Hypixel, having p2w features within Skyblock.
@ imo, anything that helps you advance in the game solely by paying is p2w, unsure where this competitive narrative came in, I’ve been using p2w for all sorts of genres of games.
@fldom4610 hey other, my comment is a single comment, and I already stated it’s just my opinion of p2w and other predatory marketing schemes. No need to agree, just remember whose comment you’re originally replying to.
Correction: It's only against EULA for customers who are subject to revision of their EULA/contract. The early adopters of the game have broad rights in terms of development, modification, add-ons, publishing, monetization, etc. Mojang has no contractual authority to dictate or limit what content early adopters can use/create/share outside of redistribution of their game.
i hope to take comfort in the fact that even if this lawsuit doesnt add up to anything, this is still a very bad look for them. Hopefully this will have a happy end
@@thedeadpoolwhochuckles.6852 No, a LARGE portion of the fanbase cares about this. That's why the go-fund-me page got so much money in such a short amount of time. People want Mojang to actually be clear about what the rules are, and people are fed up with how Minecraft is being handled. This lawsuit isn't about guns being banned in Minecraft, it's about being held accountable, and if this lawsuit actually goes somewhere, could set the standard of EVERY company getting sued for similar things they're doing Even if this goes nowhere, people will still stop playing Minecraft because of this lawsuit, out of principle. That leaves them with mostly kids on their tablets, which is NEVER a sustainable business, and will just result in Minecraft slowly becoming another one of those shitty mobile games
@@DarkXSolver17They don’t care about Minecraft becoming a shitty mobile game. They want to make money. Although I hope that staff and other personnel will leave once that happens.
@@chezzy1908 I see absolutely zero reason as to why that would matter? And even if they aren't active on either that much, they'll hear about it because of how much this could change Minecraft and the gaming industry as a whole, assuming the lawsuit goes anywhere. This lawsuit could very well set the standard of what is and isn't accepted, and could lead to more lawsuits like this one being created on other games for similar reasons. No matter what platforms people do and don't use, so long as someone has heard about this, if Minecraft is brought up there's a high likelihood of the lawsuit being brought up. And even then, this video has nearly a million views, with the video posted by the creator of the lawsuit having 2.5 million views. That's a large enough number for most people that play Minecraft to hear about the lawsuit, no matter the platform they reside on
Roughly from what I can remember, they are being sued for : withholding info in the Eula and rules n' stuff AND changing with Eula without notifying customers If anybody knows anything else in the original video I missed that Mojang is being sued for or can perhaps even dig up some dirt on Mojang that the original vid didn't, that'd be neat!
- The allowance to advertise, promote and monetise gambling to both adults and children with lootboxes, slot machines, luck based games etc. - misleading information in both EULA and ToS - changing both EULA and ToS without notifying players - intentionally leaving out key details and information from the EULA and ToS - stealing content creator ideas and promoting it as their own (the whole sky block thing) That’s as much as I remember, but there’s definitely plenty of other things they’re hiding and not wanting to be out in public.
It’s weird that nobody ever thinks about how crazy it is that lawsuits are just a “who has more money” competition. You just mention it like it’s normal.
@@HungryWardenoh, no, i agree. It is absolutely NOT justified, nor SHOULD it be normal. I think people do think about it a lot but just feel essentially powerless.
no, I doubt it because this isnt american courts (im uninformed on swedish courts though) and in most of these "drag out" cases, its because they're suing with little evidence and you have to prove the people are guilty. In this case we actively are shown the fact they're guilty and their own admission of guilt has been shown as well.
2:35 yeah, but when they impacted the workings of the modding community with rules that are hidden from the public and can be used discriminantly on different people and modding communities, for some people a lawsuit is the way forward to defending the creative integrity of the game.
I remember a few years ago when there was that one meme "companies that nobody hates annual meeting", and Mojang was the only one pictured. Oh, how that meme aged like milk.
Funny that while this was happening I went to my state court for a tour of how their court system works, and the night before I got my house searched by US Marshals & police about a suspect under warrant which didn't live or know in my place. The December of all time.
That was in a few hours you clowns. they're still going - by the time I saw the video and threw in $2 the goal had been met for several days; In an EU court case, when he has excessive evidence of them breaking consumer protection laws. These laws are important, stop being a drag and a pessimist and help fight for them.
The literal only two things keeping me going to play Minecraft at all is mods. Mods and previous versions. I am not at all happy with what Mojang is doing.
Still don't this really getting anywhere. There's many reasons why huge companies rarely get sued, one being that they can afford to delay stuff until you run out of funds, which is especially likely for a crowdfunded campaign like this
You don’t really get to see many court cases happen of this scale happen frequently, but they’re handled professionally, they do not get delayed at any circumstance unless one of the party members can’t attend the date, but even so the date can be moved around, just not by years like what happens in America
I hate to be a buzzkill, especially when it comes to doing damage to Microsoft, but if this doesn't get tossed out as a frivolous lawsuit, it's just going to be Kian getting absolutely minced in the courtroom. He's got pocket change against a 3 trillion dollar corporation and he's trying to sue for a consumer rights violation when his entire case looks more like a copyright issue. This money is going right down the drain.
What matters is also the backlash. I’ve completely stopped playing the game (and won’t come back to it unless they get their shit straight), and many have started to do the same.
@definitely_just_floating Unfortunately, I don't think they care about grizzled old Java veterans not playing the game anymore. The only money I have ever and will ever pay for Minecraft was deposited into Notch's bank account 13 years ago. They care a lot more about the children and their parents who are the primary audience for Bedrock Edition's in-game store and all the merchandise, the kind of people who wouldn't be following a consumer rights lawsuit in Sweden. Granted, I'm just one example. Maybe you're an Emirati oil Sheikh buying minecoins for half a million every week and they really will panic over you pulling out, I just think it's a statistically sound bet to assume you're not and you're closer to a case similar to mine. I want you to be right though, would give anything to make Microsoft see consumers as people for once.
@definitely_just_floating”many have started to do the same” you are all so embarrassing Minecraft is played by millions of people they don’t care that like 200 people aren’t going to play their game anymore
Anno Domini 2024, and people still think they can just sue two multibillion dollar corporations. All the money they collected for lawyers will go to waste.
Back before I installed an ad blocker I noticed that Mojang tended to double down on advertising every time they had a controversy. Peak corporate behavior.
I really hope SOMETHING comes of this. It doesn’t need to be major, but mojang is flying way too close to the sun and if the people don’t stop them, they’ll destroy themselves.
I'm really happy that people are FINALLY standing up against corporate bull crap. All we've done is complain that the corporations are bad, but these people are standing up and making their point that they're not going to be manipulated for money anymore.
if servers like hypixel are the ones getting actually financially harmed by the illegal EULA changes, why aren't they all getting together and doing a lawsuit? It's probably because 1. microsoft gave them an easy way to get around the rules like with crates. 2. their actual lawyers dont think they can win
I hope they, us, can win the lawsuit, this is big, I wish I and others like me can help but unfortunately we can't (I am from a third world country). The best I and others like me could do is translate videos like these and spread proper awareness (news like these are unknown to people like us due to a language barrier, 80% of the time). Minecraft is my childhood, it's my everything, and seeing Mojang do things like this and try to get away with them, that's just bad, it makes me really upset, and that's why I really want the lawsuit to commence, even if it won't turn out as a win I hope it'll be a reminder to tell Mojang that we don't tolerate such unfairness.
@@Adstral idk bro maybe the lawsuit might not go well and everyone who supported it loses their money for nothing? I'm just asking how people supporting such an influential cause might NOT pose as a risk
I, too, give money to strangers without consideration for consequences. Ok, even if it's not a scam, those people could have their Mojang or Microsoft accounts banned/deactivated, or the lawsuit might just, you know, go nowhere.
im a bit scared on what this lawsuit could start, on the one hand I think its great that we are trying to force mojang to be more accountable and make their EULA a lot more consumer friendly, but on the other hand i fear that this lawsuit can cause a chain reaction leading to mojang to be a lot more enforcing with its EULA since if mojang starts to crack down on gambling its going to crackdown on other things like anarchy servers such as 2b2t or chat moderation is going to be a lot more heavily enforced. Idk maybe its just an irrational fear of mine but i hope the best course of action is that mojang just backtracks on its changes, makes its EULA consumer friendly and actually tell you if they are making any changes to it, and finally just leave their focus on making minecraft more child friendly because minecraft's community is not child friendly or made of only children
If they crack down then Minecraft is _definitely_ going to be on the decline. Already their crackdowns have seriously pissed off the community and sent people looking for alternatives. I could definitely see them going down that route, but in case that happens just switch to Vintage Story.
I feel like most of the things that brought me joy in my childhood and teen years are either dead or otherwise a warped shadow of what they once were. So having some changes to make at least one of them be less scummy would be nice. But that's also a lot of money to go to something that might lead to nothing. edit: Also in the inevitable future videos you do about this, maybe elaborate a bit more on what you meant by "risks". This video's only been up an hour and some people in the comments are already getting confused and conclusion-jumpy.
You do realize this is *Microsoft,* something so powerful it took out the IRS *and won.* There's no hope, they could just ban the suers and get away from it because they have such powers. I'm just accepting that this is the way the world works. You can't cancel a megacorp.
They could have sued Mojang a long time ago, because of fake copyright strikes of videos, that show minecraft bedrock dev versions. In copyright strikes they mention music, that doesn’t even in the video, and that they doesn’t even have rights for
It's called patient and waiting to fill that negative until it's overflowing with illegal things that Mojang done also before you don't have much evidence compare to now
Mojang/Microsoft do not realize that just because they have language in their EULA covering how you are allowed to title, display, or represent media content that this does not prove that the person who posted a video on UA-cam is a customer of Mojang. Furthermore, such terms don't apply to people with contracts prior to May 24, 2011. Microsoft and Mojang are required to play by the rules like everyone else and operate with respect towards fair use statutes, unless they can prove that the customer published the video AND that the customer is subject to the terms.
i think it's very important that we more so attack the suits from Microsoft that back all the db stuff we hate like marketplace and Eula, not the developers themselves

Luckily the guy suing has copies of the EULA changes.
It's not the fact that the EULA was changed. it's that the EULA was changed without notifying customers, which is illegal

This is in Europe so I'm guessing this is going to go way differently than we all expect it to be if it were a US case

Mojang is Swedish, so this Lawsuit will be handled by EU courts.
They are known for not allowing corporations to bully the little guy.
That's not how it works here in Europe, here big corpos get smacked in the courts all the time.
What matters is also the backlash. I’ve completely stopped playing the game (and won’t come back to it unless they get their shit straight), and many have started to do the same.
EULA abuse is consumer rights
Enforcing rules even more harshly is a very dumb decisions economically, but I can see it happening because companies don't think with their brain
If they crack down then Minecraft is _definitely_ going to be on the decline. Already their crackdowns have seriously pissed off the community and sent people looking for alternatives. I could definitely see them going down that route, but in case that happens just switch to Vintage Story.
"Yar har fiddle de-de, being a pirate is so fun to be!" is such a great line I think we could all learn from it.
this game is slowly turning into roblox tbh and it really scares me
You already literally can't turn off chat moderation in bedrock even when playing private servers with your friends.
I got recommended the original video, and dang! Even the government officials aren't holding up the laws they should be
I so hope he wins this lawsuit. Mojang needs to actually lock in.
You do realize this is *Microsoft,* something so powerful it took out the IRS *and won.*
There's no hope, they could just ban the suers and get away from it because they have such powers.
I'm just accepting that this is the way the world works.
You can't cancel a megacorp.
Holy shit, it's happening.
Oh man, this is going to be so fun to watch. I genuinely can’t wait!
i think it's very important that we more so attack the suits from Microsoft that back all the db stuff we hate like marketplace and Eula, not the developers themselves
I agree, Microsoft is the main problem, yet these folks think mojang is a world dictator. Mojang is just people trying to do their job (yeah they're somewhat corporal, but they don't have a full say, those says come from Microsoft themselves)
minecraft fans only target the devs though
@@russt2793 no, mojang is the problem here. Microsoft isnt forcing them to do this, they're doing it and are shitty. Ubisoft used to be good a decade ago, but this isnt a decade ago and now ubisoft is going under.
Mojang is in the same situation of rose tinted glasses on their fan base.
@@duckyduckington9736 give me 1 good reason as how Mojang is this secretly evil company, which more vile, and dire intentions, compared to the tech giant taht owns it... I'll be glad to debunk them
In the grand scheme of things, i can promise you that Mojang is indeed more of a victim in comparison, than teh greedy giant, Microsoft
@@duckyduckington9736 (stupid youtube deleting my comment... let's try this again.)
How is Mojang objectively worse than Microsoft? How? Give me 1 reason, any reason that has this community demonizing them, to the brink of pure unfiltered evil.
So they made me pay $13 Dollars for Nothing
What are the dangers of assotiating with the fundraiser?
Good question
I think mojang may try and ban all the peoples accounts who fundraised this.
Altermatively the fund raised might be misused and the lawsuit will never take place. But people is pretty optimistic that thing like this will never happen.
The chance that the guy scams everyone and runs away with the money or he loses in court and nothing happens
@@Colis-xv6ehthat can't happen, as it's impossible for mojang to know who exactly donated. The reason is, as other people said, that it could be a scam
Being sued in your home turf of Sweden is nasty work.
