- The neighbors tree roots wrapped around a draintile system we replace. The building was flooding so we cut them. That didn't make the neighbor happy.

"Are you admitting that your trees flooded his property.?" That's pretty much where the conversation ended.
I mean...doesn't that technically mean he can be charged for his property causing damage to another persons property? Like if a tree at my house falls over on my neighbors? - He did change his tune when that was said though.
A bit after that he even says that his property line is on the other side of the trees... they're not even on his property so he has no say over them at all. He's a male Karen and doesn't even know what he's talking about, which is about the same for most other Karens too.
He realized he could be on the hook for the entire job. 🤣

When the arrowed showed the property line was 25ft away it looked as if most of the trees where not even on his property.
@@adamdlong the guy was obviously ignorant and didn't look like he was threat to anyone. So why not show him what they are doing and teach an ignorant person. It is no different than teaching a kid not to play with fire and why it is dangerous.
Mr. Karen is so worried about the roots being cut, but he doesn’t want to take responsibility for the damages they cause.

de-escalation is so important most people are awesome but every once in a while you get that guy that just cannot be reasoned with.

@@Dirtmonkey no offense to the good apples but cops could learn a lot about de-escalation from tradesmen. I'm convinced that police should at least have experience in public facing trades or service where violence is an absolute last resort, or that it should be an ongoing requirement. 1000 hours of that would do better than 5 years of training. And as a legal professional i can tell you that it was a very silly thing to do. In this case it was lucky that it did deescalate. However, in general, legal speaking, you should never talk to neighbors about what you are doing. You are opening the client up to potential legal liability. If the neighbor wanted information he should have talked to the client.
That moment when he realized he could be liable for damage caused by his roots was priceless.

As a horticulturist, the small amount of damage done to the root mass of the tree should not harm the tree as a whole. The spruces do go dormant in the winter, which looks like when the project was done, and is the normal time for these trees to be dug for retail sale. The damage done to the roots will actually promote new feeder root growth.
We definitely killed a massive tree that stood af the edge of our backyard for decades by tilling the topsoil, so sad because we loved it so much and never would have thought it could have happened.
As an apprentice arborist, I can even concur that damaging just 1 root offshoot won't hurt the tree too much.
That really depends on the tree though. Some are really sensitive to root damage and die a couple years later

@@GlorifiedGremlin Not sure, it was definitely deciduous but whether it was oak, elm, or ash, I couldn't say for sure without a bunch of references. The original owner of the home in the 60s was a park ranger or something like that and planted about 15 different trees on basically a 1/8 acre property including two different apple trees and a lemon that I believe crossbreed with nearby grapefruit and makes these giant delicious juicy lemons which cannot be beat by anything storebought. My family ended up taking out at least 6 or 7 of them because they were tangling with power lines and various things (one was within inches from a fence and dropped these spiky round balls which were annoying to step on barefoot.)
So if his property line is 25' away then those are not even his trees.

So in essence, he planted trees as a privacy screen on someone else’s property and then bitches when they have to deal with the damage the trees caused. I would’ve taken all the trees down so that he could stare at the side of my commercial building. Possibly with a one finger salute spray painted on it for Karen/Ken!
@@LegendLength oh ok thanks. Well either way, once those roots and or branches cross over the property line and cause problems or not. The neighbor has the right to trim them back or remove them from their property. People should take that into account when they plant trees as a privacy buffer right against their property line and at a minimum allow for the full crown of the tree not to encroach.

Anything on, under, or above the ground that extends over the property line can be cut off. I know. I cut my neighbors roots because they extended under my driveway and were destroying my driveway. I removed them to place a new driveway, and the branches hanging over my driveway, which is 100 ft long. The trees died and the neighbors took me to court. They lost. The judge told them exactly this : Anything on, under, or above the ground that extends over the property line can be cut off by the owner of the other property.
Sorry you had to go to court- very cool you clearly won-but still lost your time going. That part sucks.
This I believe varies by state/county. I could be wrong. I tend to lean towards this but there are times when it shouldn't. It really just depends on how much of a douche the neighbor wants to be.
There are some states that give property owners permission to trim on their side, but the trimming cannot cause enough damage to kill the tree. If the tree dies, the trimmer is held responsible for not only removing the dead tree from the neighbor property, but also replanting a new tree.

I believe there is a common courtesy. If your neighbor is going to trim your limbs over his property, he should tell you that he is going to. When the power companies around here trim trees, they drop letters in everyone's mailbox and ask if you have any problems with them cutting your trees.
You handled the neighbor brilliantly. You could have gotten irate, but you kept your cool, did not get snarky, and won the day. Well done.

@@pats9414 well a normal, stable, healthy thinking individual probably wouldn't get irate. But Mr. Karen had a confrontational, accusatory tone and approach, and lots of folks wouldn't have kept their cool about it.

I’ve been working for years for my grandpa ... we do tree trimming. Well we’re on the job and usually we explain everything to customers and try our best to make sure that they understand the process we’re gonna do to not only be safe but also just so we don’t damage property. A little context I’m the youngest one on the job site around 16-17 at the time. I had been around it all my life been raised in in was training on saws when I was big enough to handle them. I was trained by my uncle on how to run ropes and I was the head rope guy so I had a lot of responsibility for the safety of the guys myself and the customers property. Well we’re out on a job working for a older couple and they watched us work that day cause we had to have the power line dropped to get the tree down safely so they had nothing better to do. My uncle is up in the tree getting ready to start dropping logs and I’m helping him with the ropes, my dad and the rest of the brush crew was finishing up the brush and the older guy walks up to me and ask me what I’m doing. He would come talk to me more than any of the other guys, I didn’t mind I like to talk but he was asking questions in that condescending way almost like he was implying I didn’t know what I was doing. But this time he asked me why I was being lazy and not helping with the brush and just standing there holding ropes like I’m stupid or something. That really pissed me off but I kept my composure and asked him, “ sir that swing set there you must have spent a good penny on that to watch your grandkids play right?” He said yes I actually did. I then turned and pointed out his propane tank that he used to heat his house and asked him if that kept him warm in the winter ... he said ya. I then looked at all the guys working with us and asked him if wants a hard worker to suffer a workplace injury or worse a fatality on his land. He said hell no. So I looked him in the eye and said each and every one of them things have been on my mind all day that it’s my responsibility to make sure nothing is damaged and no one is hurt. So if you would kindly step back to his porch I be doing my job. Well I figured he’d tell my grandpa and I’d get fussed at for handling a customer myself but something strange happened that evening when we went in off the job. We usually have a discussion about the day going over any incidents minor or major but usually we’re just setting there bullshitn until we got a even hr for the day. Well my grandpa pulled in in a real big hurry which was unlike him. So I just knew it was about the older guy complaining. He gets out his truck and looks me dead in the eye and ask me what happened... I told him and he looked at bit surprised. He said he figured the guy had me and my dad mixed up but then he pulled some envelopes out of his truck and each one was blank except the one labeled THE KID. Inside each envelope was a 30$ tip but inside mine was not only the 30$ but also a little vile of dirt, and a folded piece of paper. It wasn’t just any dirt in that vile it was a pice of dirt from Germany that his father had collected in wwll. The note said not to worry they had a mason jar full of it but that his dad would have liked to have met me that basically I showed respect while simultaneously standing my ground and explaining what I was doing. Needless to say I still get calls from the guy and I do most of his landscaping now.
That's such a cool story, standing your ground and remaining calm has gotten me similar though less interesting results!
Your grandfather and father should be proud of the way they raised you. You handled that situation with words much wiser than your tender years, and that man saw it.

When it comes to private property you are always trespassing, Just depends on if the owner enacts it up you or not. you can be assumed welcomed to a place at first then be trespassed if they do not want you there anymore.

Could end up getting sued by the neighbor. Granted you might win the case at the end or lose, but it’s not worth the energy. Diplomacy first, when that doesn’t work bring out the heavy hand.

I think I might have pushed a little harder on his liability and mentioned how the entire project gets documented from start to finish with extra emphasis on the damage caused by the tree roots. Mentioning perhaps, how you made the documentation for the clients prospective 'case'.
It wouldn't matter. You can't sue your neighbor because the underground tree roots that nobody can see or has control over causes damage to you property. Just like you can't sue your neighbor if their perfectly healthy tree had fallen over on to your house during a violent storm. That is why we have insurance.

@@danhoward9671 Not if it is a healthy tree that you maintain. The rest is up to mother nature and is uncontrollable by the owner of the tree. If the above is true, then you wouldn't be liable in most cases. So when the neighbors healthy maintained tree falls on your house due to a strong wind storm, you can't hold your neighbor liable in most cases. That is why we have insurance.
In this case the owner wouldn't be held reliable for the damage that the roots did to the other property because nobody can control how a tree grows its roots. This is referred to by the insurance companies as an act of god.

I guess that this guy has never seen a tree growing through a stone? Roots can break through damn near anything. In Rural areas roots cause thousands of dollars in septic damage every year.

I don’t have any trees on my property but the neighbors all have huge deciduous trees with massive root systems that caused my sewer line to collapse so I have to pay to replace the entire line. I also had to replace my sidewalk in front because tree roots were causing upheaval of sidewalk and people can, and do, trip over it. I found out if someone tripped on uneven sidewalk in front of my house they could sue me. It was dangerous so that’s why I replaced it. All because of neighbors’ tree roots! $$$$ And in my county, Sedgwick county Kansas, I can legally cut all those tree roots, branches that crossed to my property even if it kills the trees. Just like he was talking about in this video. I try to treat others as I’d want to be treated so I just deal with it myself. You can’t change people, and they are my neighbors, so I try to get along. I’m not moving, I was born and raised in this house and I’ve paid it off. I just have to keep smiling 😁

I had a good size tree on my property line who’s root/trunk started to heave the fence between the properties. My neighbor came over and talked to me like a gentleman about it and I decided that I like my neighbor more than I liked that tree so I had it removed. He offered to pay half the expense but I refused and he agreed to pay to have his fence repaired. So that’s it.
And that is how adults handle a situation! I think you could give a course teaching others how to have a rational, healthy discussion with people. There are so many out there who could use it!
It was fully his responsibility to repair his fence. It was also very nice and generous that he offered to split the expense of removing the tree. You were right IMO to refuse his help on the cost. What I like best, however, about your story is that both of you acted like mature adults in solving an issue. Kudos to you and your neighbor, sir!!!

This response probably helped ensure that the situation stayed defused. It was a hilarious comment completely out of left field. I definitely laughed at that one. But seriously, dealing with ignorant neighbors and others in a way that doesn’t make things worse is truly an art form. Well done, sir.
The best thing I saw in the video was the willingness of the host to learn from his past experiences and to listen to those affected/impacted by him doing his job. Respecting people, whether it be a concerned neighbor or his employees goes a long way, at least gives you a chance to resolve issues. Those seemingly small dignities, such as basic respect, often turns out to be the key to success, which I don't always remember myself. Having your kiddo make you a grilled ham and cheese sandwich ain't too shabby either! Good luck with your next agender.
He was trespassing and complaining about roots infringing on another property owner. He even wanted your video as evidence. He has a lot of nerve.
Only reason he acts that way is because no one stands up to his bs. We call the cops on people like that who are trespassing on job sites we do, he has zero legal say with what's being done. We tell people it's not their property and none of their business what we are doing and they need to leave or police will be called.. Also quite possible those trees are illegally planted too close to the property line
real simple way to keep most them out the site put up a sign that says hardhat steel toed boots hivis and safety glasses required to enter. cut them off right at the start you cant be here its unsafe

I had a guy who supposedly had 20 years in landscaping try to tell me that hedge trimmers were self sharpening
@@cameronjellison2085 In one sense a properly set up hedge trimmer is self sharpening. The flat surface of the one blade rubs on the flat surface of the other blade and takes care of any burs in the direction. However the damage caused to the other face of the blade is what needs to be dressed (addressed:)) . The biggest problem is keeping the blades properly set up. That takes multiple adjustments every day, and wears the blades out a lot faster, than the normal set up. I suppose it depends on how much you hate sharpening the blades.
@@mavv7088 no, he had no idea how to adjust them. And he would yell at me for wasting time if I dressed the opposite edge with a file. He’d also yell at me for wasting time sharpening chainsaw blades. And the day that I hung the leaf blower up on a different hook than he’d designated for it in the trailer.
The trees were clearly on the businesses property. He obviously cared for himself and not really the trees. He just didn’t want to see the business the trees blocked. If the trees died he would end up seeing the business. That is really all he cared about.
I don't fault his concerns just his methods. If I had questions about a project near my property line I would never approach the contractors, but voice my concerns with my neighbor directly, it's just the right way to go about BEING a neighbor.
Those little roots and those tiny branches aint gonna hurt the tree.

@@berettaboi They are not cedar they are fir. It looked to me like they where outside the drip line and if that was the case it wouldn’t hurt any tree.
@@berettaboi Those are feeder roots out past the drip line with the exception of that 1 single large one. It's also well below the 1/4 rule for pruning branches and trimming roots. Plus, it's fall, so the summer stress is passed, the moisture content of the soil is a little higher, and worst case, throw in some fertilizer with only Phosphorus or higher P and it will help recover just fine. Almost no tree is so sensitive that touching any root will stress it beyond it's limits.

I just simply would have asked him why he was asking about work that is not on his property. If he pressured with questions further I would have sent him to the city to look at the permit.

I was installing a sprinkler system at a customers house and a guy came out and told us to move our truck because it was too close to the stop sign which was across the street from his house. we moved it. then he tries to punk out one of my guys for standing there listening to him talk to me even though the guy interrupted me and my guys conversation. Some people are just brain dead and have no idea where their boundaries are and think they own everything including stuff not on their property.
So, the court will see that his trees caused damage to the other person's property which will make him pay the bill.
Pretty much, guy is an idiot to even admit to that.

You'll have all the neighbors out bitching about every move you make, threatening to sue, calling cops, etc. I gave up doing fences, not worth the hassle. Every time my guys got confronted by someone I had to go out to the job to deal with it. I cant ask my guys to get yelled qt by stay at home karens, they have a hard enough day of work.
Moral of the story, if they aren't the ones putting food on your table, their input has little value to me. So long as my customer is happy and we are following city rules they can whine all they want

The "wicks" are weep holes for the building. There is a space between the inner and outer brick walls of the building that will collect water. As that water runs down the wall, it collects at the bottom. These weep holes allow the water to escape the void externally rather than seep into the building.
I have a similar problem with a neighbour's tree encroaching on my garden. He planted it about 3ft away from the boundary. Now it is about 40ft in height and pushing over the fence, overhanging my garden, and as it's a the southern end, casting everything into shade. People just don't think ahead when they plant trees. You have to think in a 30-40 year time frame, not just for next week.

This guy clearly doesn't know how roots work. Cutting roots that have extended as far as those roots have in *one* direction isn't going to do squat to those trees. If they managed to extend a root system that far, they have a massive network underground. They'll be fine.
Also, by his own admission, they're not even his trees.

That guy, Karen, is one of them busy bodies who's sole purpose is to let you know, that in his own little world, he was somebody!
The light bulb came on when the neighbor realized he was liable for damage to the bldg.. He should be glad you took care of the problem so well.
I think he just needed some excitement. I hope I was able to make his day interesting because he sure made mine interesting.

You handled this neighbor like a champ. I work with an unnamed utility company, and deal with trees on our facilities constantly.. I learned to deal with the customers based on their approach. I have countless stories of customers with trees, shrubs/bushes around and on our equipment. I use to try to do all I could without damaging customers property on our facilities. Until I had a small tree limb push the door to an underground transformer off, and it landed across the primary and secondary bushings (can we say FIRE).. From that day forward I clear out a path (within reason) despite customers complaining. And I usually handle the situation just as you did, by letting them know their trees/bushes/shrubs have damaged or is damaging our equipment. I have also said it in it's simplest terms, "we plant poles, Not trees"..
I could say so many things about trees.. Generally, if you let them know it's their fault, they don't stick around long after that.

In Australia , thats exactly what happens , which is why I dont have any tree in my place , all pulled out , so no one can do the dirty on me , But i have about 20 Bonsai's and other larger potted tree's , if they get outa hand , i just roll them over cut the tap root out the bottom of the pot and get rid of it , im about to do that to one tomorrow thats just in a bad spot , shouldnt die though , to start a Bonsai you cut that tap root to fit it in a shallow pot. Fingers crossed though never done it with a 8 ft'er before lol
The contractor should of said something to the effect that he was going to share the video with the owner to let him know how the damage was caused. That would have probably ended the conversation.

Great job handling the "Mr./Ms. Kravits from Bewitched." I personally could not have stood the utter stupidity that he was displaying. He first off did not even know where the true property line actually was for sure; the next thing is that he is the person that is impeding on your crew and costing you downtime and loss of revenue while dealing with his ignorance. You are a better compassionate person for the indigent soul looking for a hand out (which is what he was fishing for). (I would have been tempted to send him a bill for the lost time incurred for you and your team and with a Mechanic's Lien Statement against his property's address if not paid within 15days, and see just how fast he would be ringing your phone off the hook to apologize). I personally would have had to ask for him to go stand on the property line he thinks he has and to give me just a few minutes while we get the police present before we begin our theoretical debate (all the while waving the permit in the air as we had the conversation with the police present). Then it's possibly a harassment complaint time for the poor fool to understand why he should mind his own business. You're a true workingman's scholar Stan.

My Dad worked for the Forest Service for 26 years. I believe he told me that the main tap root was pretty much all you have to worry about when digging around those trees. Those trees will be perfectly fine. I would have told him to stay on his own property. You are a better man than I, Stan. Great video! Thanks, Russ from Oregon.

Reminds me when I was doing a flood at 3am in apartments 3rd floor. Lady comes out demanding I stop because her child was asleep. Long story short I ended up threatening her with the bill husband quickly came and showed her back into her apartment and thanked me for my hard work. Lol

I am a tree sugeon in Vienna . You do the right thing to the neighbor. As i always said : The roots from the trees ( Pinus pungens ) are always growing to the water . So in 5 or 6 years you have the same work to do . But finaciely is the neighbor resposible to pay for the work . This are his trees witch are to close to his borders. Good luck for your company !
My response to neighbor would've been the same. "So your tree's roots caused this pipe damage?" If so, I think you and the property owner need to have a chat. You may have some responsibility here." Especially because he's being so difficult.

Actually on top of a berm you would put an oriental spruce they have a massive root ball that’s Stays contained
he probably already had a Arborist out to look at those spruce and was told that same thing...but thought he could get the building owner to pay for the removal/replacement of trees that were dying from disease as if the landscaper "killed the trees"
