Sen Kennedy is an amazing representative . This man balances all the qualities that make a great man . Accountability , responsibility , discernment , morality , and integrity . And most importantly trying to hold his colleagues and peers to a standard as they should be. He not only talks the talk ... But is big enough to walk the walk . All of these qualities and actions are a very rare thing where that man serves, look at whats going on .

When a nominee has previously acted, spoken or written a mindset illuminating their prejudice it should be fair game to question them and expect an intelligible answer.
You should expect an intelligible answer, but they seldom receive one. The nominee have been coached prior, so say as little as possible. The votes for the higher court usually along party line anyway.
To play devil's advocate, these senators dig up anything and everything and try to hold it against them so it's appropriate to dodge sometimes or dismiss a request for an opinion when the request is likely irrelevant or based on an opinion from before they were even in law school. I caught Kennedy in a big one recently. IRS developed a new filing requirement for a new payer document form to be filed. He stood on stage with two other republicans and was squawking for over 30 minutes telling people the IRS would be examining all bank records if you received more than $600 in bank deposits. I could not believe that was true so I looked it up. And it was not remotely true. The filing requirement applies only to payment processing companies like PayPal or Venmo or others like them. That is the biggest lie I heard from him. Opinions about the judicial nomination process are just varying opinions. But lies to the American public is a whole new ball game.

A judges personal views shape the way they interpret the law regardless if they are supposed to or not. It's human nature. Questions pertaining to their personal views are absolutely relevant.

The 2nd amendment is one, some believe that the right to bare arms is an individual right, while others believe that the right is only for a militia, so yes, a personal opinion does guide your interpretation of the law.

They just don't have a defined term limit and there is no mechanism for replacing them until they leave the seat either by impeachment (forced by the Legislature), choice or death. This was by design by the Founders to make SCOTUS a stabilizing force in American politics. A stable country requires stable laws. Imagine if the entire political landscape could swing in just a handful of years. If either party has a particularly good election cycle BAM... they can remake the laws as they see fit in very short order. What was legal yesterday is illegal today, what was illegal yesterday is legal today. A society based on laws cannot function this way, so we NEED a braking mechanism to slow down the zealotry of Congress. That's what SCOTUS does. Or, at least, that's what they're supposed to do. When Justices go beyond simply interpreting the law and venture into legislating from the bench this purpose is corrupted.
The Constitution provides an avenue by which Congress can remove a Justice. They need not commit a crime; it is even less well-defined than the section about Presidential Impeachment. "Good behavior" is the standard for SCOTUS.
If the Democrats wanna start impeaching SCOTUS Justices leaning on the vague language of the Constitution like they did with Impeachment... I encourage them to do so. They don't like what Thomas is doing? Easy, just call that "bad behavior" and impeach him for it the next time they hold the House. Even if it fails in the Senate (which it most certainly would), they can use that attempt as grounds for claiming any subsequent opinions from him as politically motivated revenge for trying to impeach him. Rinse and repeat until it sticks.
Then, I guess, just pray to god the Republicans never get the power to do the same thing. The days are gone when they could count on the GOP not having the balls to play tit-for-tat and they know it.

@@1965Grit Are you suggesting that anyone who holds the latter opinion is anything resembling an originalist? SCOTUS Justices are supposed to ensure the actions of the Legislature and the Executive do not violate the Constitution. The text of the Constitution is clear; it was written so that 18th century farmers could understand it. Any interpretation other than an originalist one is invalid because the Founders wrote the thing and their intent is clear and has been for over 200 years.
We have ways of amending the Constitution... SCOTUS is not even a part of that process. They do not get to add or remove anything no matter what they think about the issues at hand, they are not the Legislature. Their job is simple: read the Constitution, decide if the law under review violates it or not. If they are unable to divorce their personal views from their CONSTITUTIONAL rulings... they should not be on that or any bench. Judges are not Legislators; they are not in the business of MAKING laws.

The thing is that they can be removed for bad behavior. If they are pushing a marxist agenda in a constitutional republic that is very bad behavior. The people need to remember that this is the only country in the world where the people rule over the government and we need to start demanding that our representatives do what the people want them to do. This starts at the state level by only voting in people who will represent us, that means getting rid of the parties who chose the candidates for us and give us the illusion of having a real choice but letting us pick one of their picks. Think about that, no one not approved by one party or the other doesn't have an opportunity to represent the people.

Use information from committee hearings to buy/sell stocks is probably the most used way of getting rich. These ppl spend MILLIONS to get a job that pays $170k (somewhere around there anyway) We MUST have term limits AND a way to track how they use info they get from hearings because they just tell a brother, cousin, friend, WHOEVER, to buy/sell stocks then the split up the $. THEY make the laws, so nothing will ever change.
