    This is a good example that VA will low-ball veterans filing claims for service incurred injuries and diseases by any means necessary to harm the veteran and his or her survivors. Thank you CCK for sharing this message with veterans worldwide. Never quit fighting the VA for the benefits earned shown in this case, it’s simple that the VA decided to obscure and low-ball the veteran way back in the 1980’s.

    Amazing! So happy for this veteran and thankful to you guys for standing up for him. I am currently on my 3rd set of Lawyers. I filed a claim in 2007 and after years of appeals (some wins!!!), I now have to have my file remanded because of new evidence that was submitted in 2017, however, the AOJ did not review the evidence. This process is so frustrating and stressful. Also, I get denied for tinnitus, but I was a 5811 (Military Police), station aboard Air Stations (Yuma/Miramar) during my last 4 years in the Marines.

      When did you last file for tinnitus? They have added a lot of MOS's that automatically get up to 10%. I worked at Station Weapons Yuma from 91-94 and Mals-13 from 95-99. Since We worked around the flight line and the Harriers. I submitted and received my 10% last year.

      I was a heavy equipment operator (1345) and actually did my MOS everyday stateside as well as in Iraq and during my deployment I spent a couple months assigned to the flight line and even with those shitty ear plugs that was constantly very loud and now being 15 years out of the military I know my hearing is degrading and the tinnitus is terrible especially at night whichever ear is on my pillow it rings and just sucks so bad. Fortunately my wife is okay with me having the TV on at night and the fan blasting right at me and it helps a little but the explanation for denial from the hearing exam didn't even mention the tinnitus just the gradual hearing loss but they stated it could just have happened over time not necessarily service connected so they kicked that Lmao What a bunch of clowns.

    Oh my goodness thank you guys so much for your service to our community! I finally got my claim overturned 10 years later I got a rating that I am happy right now I need to go back to the original claim using the CUE if I can’t get it myself I will definitely be securing this agency

    Glad yall won, glad the vet got what he deserved. Disappointed this vet and so many more have to, at their own expense, hire a law firm to acquire the benefits they are entitled to. The law firm will now get, unless im mistaken, up to 20% of the award… which sounds like will be quite substantial. Wonder if the court identified what the percent the firm gets… i think by law it can be no more than 20%. Alternatively, i think the VA should have to pay the court cost… perhaps this would teach them an expensive lesson and get these things correct the first time.

      CCK just today, 3 hours ago that for taking my Case, their percentage will be 33.3%, i balked at that number and am still not happy with that but it is better than the NOTHING i have been getting for 31 years now

    These guys are real.deal. They took a case of mine where VA erred. The VA acknowledged and i am now waiting on the final decision.

    Hey I'm one of those people, my husband served in Vietnam
    A veteran of 20 years in the United States marines.
    So I know where these veterans are coming from.
    God bless all the military people who served
    And my grandson serves in the military. And yes a lot of our military men and women just
    Screwed out of what they have worked and for, and they die young
    And if they're lucky enough 😮to stay alive, lots of healt

    I was an 0811 in the Marine corps, yes. The VA will try anything to not pay benefits to veterans, the veterans of today, have all the information they need to get their benefits. #wallstreetthenewhustle

    We need new laws...IF a VA Board is overturned at the Court of VA Appeals, all members of the board should be fined what it takes to pay the Veteran the proper award amount, and they should then be terminated from their job, no pension and No Appeal, PERIOD.
    Fixing one case at a time is not giving the Veterans Justice, getting rid of Bad People at the VA WILL get Vets Justice.

    Bravo for these lawyers - they seriously represented a veteran. Thank you‼️ & just another proof how many years the VA will continue to screw a vet until we find the willpower to fight them. We are SICK & many of us do not have the physical and or mental strength to fight the government. Most of us are alone & don’t have a spouse to fight for us. It really is a shame when welfare benefits are easier to get when people just don’t want to work. Yeah, the ones who fought for your freedom are manipulated, jerked around & given more medication than required or no medication at all then when you do have medication, the doctor doesn’t even care about getting your prescriptions to you on time. Every month my medication is at least 2 days late. Well, what am I supposed to do about those 6 to 18 doses of medicine I missed before I finally received my medication. I have very little respect for the VA because they have zero respect for us. Just the fact they hire cops to stand around the hospital or clinics to make sure the vet’s temperament is okay is a telling story of the government. There are NO cops standing around waiting to arrest the welfare people when they go to the ER or to a dr appt. It is just wrong how veterans are treated🥵

      @@kingfriday3050 I was not speaking negatively about welfare recipients. I was merely making an analogy. I once wrote a paper comparing the Federal prisoners to the US military troops & no, I was not making fun of anyone or denigrating them then either. You really need to learn to read & if this round#2 doesn’t explain it then maybe I should Breakout a crayon & draw you a picture! Oh & btw, veterans don’t request cops to be present. That’s to make the employees FEEL safe & for the gov’t to say, “oh, we are just helping.” They don’t wanna help and never did want to help or they wouldn’t have put us in harms way with WMD & LIED to begin with for their monetary benefit.

    My husband filed a disability claim for PTSD in 2017, the board denied it, husbands case worker said he could appeal it which he did, board again denied it. Yrs later my husband had a heart attack and had quad heart surgery and was able to get 100% temporary disability. Husband did get disability of 70% after heart surgery, then he was able to get his 100%. Out of the blue husband received a call from a law firm and this law firm said they were contacted by the Veterans Affairs office to look at my husbands case. Which the law firm stated they were going to represent him and they did just that all the way to Washington D.C to the court of appeals went before the judge, and husband received a call and a letter telling him they won his case for him. They filed a claim for the 2017 PTSD and we thought he would have received his back pay but not knowing that the law firm won my husbands case we were told it's still up to the VA board and till this day we have not heard anything. My husband served in Viet Nam 65-67 Artillery Army.

    Recommendation. It would be insanely awesome if there was a way to speak to a lawyer without going through a call service. Specifically for those that are willing to compensate you all for your time on the phone.

    Will the Veteran Affairs acknowledge if I filed claim for a symptom I was denied for that later turned in to a diagnoses service connected disability?
    Backstory-I filed a claim for trouble with sleep but was denied within the first year of separation. Later I was diagnosed with Asthma and the trouble with sleep, including snoring, wheezing was due to burn-pit exposure.

    That's good the veterans is getting his 26 years of back pay for a 100% SC condition. And I've never used any of the VSO to get my Service Connected increase rating to 100% IU, because they will not fight for you, but B'S' you, so I had contacted my Congresswoman Barbara Lee, and she took care of it.

    They lost my records for 22 years and I had to launch a congressional investigation to get them. I did end up getting TDIU...

    I originally applied for disability back in 1983. I was honorably discharged from the Navy at the convenience of government due to a pre-existent personality disorder, per my discharge order. But I wrote to the VA and maintained that the disorder may have existed before I enlisted, but it was dormant and unknown until a married female supervisor whose advances I rebuked sought to destroy my military career, going so far as to switch patients’ med orders so that they would have been blinded, thereby creating the grounds for having me dishonorably discharged, all because I would not have sex with her. She even said “I have to punish you. You can’t handle responsibility, so I am putting you in charge of the whole clinic, which will STRESS YOU OUT.” Besides disobeying the base CO’s order that I not be in charge of a single patient after I had been put on probation for another matter, she engaged in blatantly creating a hostile work environment as well as aggravated assault against me and our patients.
    Surely I should be entitled for back pay all the way back from 1983 to my more recent application for disability, but they listed my last date of application, April 5, 2022 as my effective date. Also, before then in 2004, I tried to get compensation but got a new job in Eastern Washington. A few months later I got a letter from the VA that had not been forwarded for months; they had made an appointment for me to be interviewed so that I could possibly be awarded compensation, so I frantically called them to say that I had just got that letter months after the appointment date. They agreed to try to set a new appointment, but I got impatient and said forget it , my new job was paying well. Months later my mental health issue flared up again, and I lost my job.
    I have not had a decent job since then, and during an interview with a new mental health care provider, he said he was amazed that I had been so badly neglected by the military and the VA, and that my childhood PTSD was greatly exacerbated by the the sexual trauma I encountered in the Navy.
    I am still waiting for adjudication for my latest application but am disturbed that my backpay will more than likely be only for the months between then and April 5, 2022, especially after viewing your video. Would the VA have to pay me for your services if I were to hire you and you or your firm prevailed, or would I be on the hook? If the latter, how much would that cost; bear in mind my SSDI is less than $1500 a month.

      The law firm, if they take your case, take 1/3 of your backpack as payment, you pay nothing out of pocket

    Checkout your military discharging "Routing Form" very carefully the government may have made a decision that's something very differently than what the VA is doing to service members!!!!!

    I have a similar situation. Was awarded pension, 100, 20, 10%, for 3 conditions but not compensation. Was denied for "nervous condition" (PTSD) in 1976. Original claim in 1975, a year after discharge. Any comments and/or suggestions?

    My spouse rated 100 percent disable passed 5 years agoI was 64 at that time , I had 1 year to file and they based that on our savings and what I would draw from his S .S.I . I was greaving and had no idea what I was doing or I would have waited till I was 65. Which I’m now told I would draw his full benifits instead of approximately 1/3 of what he drew. Have you ever filed for widows ..Now I look back , it took me three years to think straight I am sick at the poor decision I have made . The V.A . Really needs too extend va limit for widows. Have you ever fought this type case ?

    What are back pay limitations? Is it from the date of the injury while in service or is it from the first time filed in 2012 at a homeless program called Stand Down where I first got a in service injuries? Thanks again

    Received 100% August 2022.
    File to increase my ptsd Nov 2022. Granted the increase from 30 to 70% September 2023. I know my 100% will not go up, but back pay wise I should be entitled to the difference, 40% for 10 months. Am I correct??

    Hi dear sir/madam , I have a question . I know someone who has now a 100% permanant, and total , but before they received their 100% , they already had place previous claims in and are now waiting on the decisions for those claims . My question is will they or could they receive any back pay for those claims once they are service connected ? Thank you

    My husband is a veteran of Vietnam war and he suffered Diabetes and Ptsd in 2016 he was hospitalized in psychiatric was for two months and later went to ICU for 11 days and he contracted intestinal infection while in ICU I personally paid about twenty thousand dollars in hospital bills including caregiver watching hin twenty four hours three shift eight hours each I filed all .y receipt in the USVA Manila for reimbursement in Oct 2017 The VA never inform us regarding this matter we live in the Phil even the VFW said that cannot do anything about it but they help him to have 100 disability on the date he was hospitalized in Sept 2016 his ptsd got so severe that he don't eat and he didn't sleep for almost a month can you help us I will send his personal data later
