    I talked to my primary care at the VA regarding a diagnosis, she said there isn’t a way to diagnose it, and the C&P examiner denied it without a prior diagnosis. I provided blood work covering numerous areas to rule out other issues, sleep test, psych exam, yet without a diagnosis I’m told I will continue to be denied. It’s a lose/lose situation

      What was your outcome? I am about to go to a C&P, even though it's a presumptive (I'm TERA concded and GW vet) and have a DBQ from my RA doc. I thought the M21 was supposed to mean no C&P exams if a diagnosis is already there......

    It sounds nearly impossible to get service connected for CFS. Doctors will always point to a reason for the symptoms other than CFS.

    I am currently diagnosed with CFS and it has sucked the life out of me! I have a C&P exam in 5 days. Many “symptoms” I have for years and has been recorded when I was in service. I just plan to be honest with the C&P examiner.

    Very important to have a diagnosis. Even if you’re TERA conceded, you need that and even better, have a DBQ from your doc. I filed a supplemental, learning this whole process, but originally claimed symptoms in the 90s, when cfs wasn’t known about. Doubt they’ll go back that far for comp, but now I’m just waiting for a decision.

      Have an upcoming C&P exam for CFS, it was "deferred" status. The company who was doing the scheduling had my wrong info and called AFTER the "scheduled" appt was missed. DUH, no emails, no letter from from, just a call out of the blue, lol. Not sure what to expect about the exam, but I'd figure since it's a presumptive and I have my doc's DBQ, I wouldn't need this C&P. I'll update after the exam....

    • @user-ym9wb2mk5e
      @user-ym9wb2mk5e 7 місяців тому +1

      Update- first C&P examiners failed to fill out DBQ correctly and I have the emails from her apologizing; sadly, va used her DBQ and low balled me. Had to go to another exam, that NP was shocked, now waiting for those results. Per the 38CFR, I should be at 60% minimum.

    I Was stationed at MCAS El Toro in the late 70's in Hangar 296 which is considered ground zero for the toxic plume of PCB's and TCE that caused the base to be listed as an EPA Superfund Site. I have chronic fatigue, fatty liver, central sleep apnea and other issues. There's documentation in my medical records of going to sick bay for stomach issues, sinusitis but for some reason being stationed at El Toro isn't listed as a place like Camp Lejeune for Presumptive Conditions, at least to my knowledge... My Sleep apnea is well controlled by a BiPap so the chronic fatigue isn't related to sleep apnea and my Sleep Doctor at the VA concurs that it, although she feels the sleep apnea may be a result of being stationed at El Toro and the jet fuel and TCE that we were exposed to on a daily basis...

      If your illness or condition was diagnosed while you were on active duty or before December 31, 2021
      You can get benefits for your illness or condition if both of these descriptions are true for you and you have one of these presumptive diseases.
      Both of these must be true. Your illness or condition:
      Caused you to be ill for at least 6 months, and
      Resulted in a disability rating of 10% or more
      And you have one of these presumptive diseases:
      Functional gastrointestinal disorders
      Chronic fatigue syndrome
      Fibromyalgia
      Other undiagnosed illnesses, including but not limited to cardiovascular disease, muscle and joint pain, and headaches

    Why is CFS a Presumtive condition for Gulf Veterans? What Gulf Veterans experience that other none Gulf Veterans did not? I believe all veterans go through the same real deal. You don't have to be a Gulf veteran.

    • @VAClaimsInsider
      @VAClaimsInsider  2 місяці тому +1

      A PACT Act presumptive disability is one that the VA “presumes” to be service connected, even if there’s no specific Nexus (meaning “link” or “connection”) for service connection.
      Presumptive disability works like this: If you served at X location during the qualifying period and developed Y condition as a result, then X + Y = automatic service connection.
      Instead of having to prove a service-connected disability, you only need to show on your DD 214 that you were in an eligible location during a specific period and that you developed a qualifying condition as a result.

    So it sounds like if a veteran has a PTSD rating it could cancel out or exclude you from being diagnosed with CFS, because they may say that your being fatigued comes from your PTSD, but on the other hand, it's being said that you can get a rating for CFS by claiming that your CFS is secondary to your rated PTSD. Is that true or how does it work? I'm just wondering because I'm a little confused about how that works.

    • @VAClaimsInsider

      Many veterans with Chronic Fatigue Syndrome, especially those who were diagnosed long after leaving the military are eligible under the law for Chronic Fatigue Syndrome Secondary to PTSD.
      Service connection on a secondary basis requires a “showing of causation.”
      A showing of causation requires that the secondary disability be “proximately due to” or “the result of” another service-connected disability.
      By law, there are three evidentiary elements that must be satisfied for Chronic Fatigue Syndrome Secondary to PTSD to prove secondary service connection:
      #1. A medical diagnosis of Chronic Fatigue Syndrome in VA medical records or private records (unless you already have a diagnosis in your service treatment records, which is unlikely since the condition typically manifests itself after leaving active duty)
      #2. Evidence of service-connected PTSD at any rating (eBenefits or VA.gov snapshot), AND
      #3. Medical nexus evidence establishing a connection between the service-connected disability (PTSD) and the current disability (Chronic Fatigue Syndrome).

    Currently active but retiring in a few years. How hard is it to exclude sleep apnea as a reason for chronic fatigue?
    I have mild sleep apnea, but consistently using the CPAP and getting 7+ hours of sleep a night for two years now has not improved my extreme fatigue. The Sleep Center that diagnosed me even looked at my statistics and stated that the CPAP corrects the apnea and should not be causing my fatigue. I’m wondering if this is enough to rule it out considering that many are saying the VA doesn’t care… i.e. if you have sleep apnea, then you can’t be diagnosed with CFS. (Blood tests also came back fine, I’m going to keep working with Doc to see if anything else is causing it)
