- If you have purchased any plot or land and paid an earnest money. For remaining sale consideration, it is settled that you shall pay remaining amount to seller within a certain period, but on the specified date, you approach the seller and seller either refuses to transfer or fail to transfer the property in your name, you can file suit for Specific performance of Agreement along with application under order 39 rule 1 and 2 read with section 151 CPC for performance of agreement as well as restraining him from alienating or transferring the property in question to any one. The stay can be obtained in many cases. Ek property sale karne k bad, agreement likha jane k bad,party payment delay kar rahi Ho,buyer ne 40% payment kardi,second installment ka time aya,par na unho ne koi rabta nai kiya payment dene k bare main.jab ham ne rabta kiya tou Unho ne kaha hamare pas abhi payment nai hai,isi liye rabta nai kiya.aur ab mere dost ne mana kar diya k app defaulter ho.ab reschedule ho ga agreement nai tou main kisi aur ko Sale kardunga.
Sawal yeh tha k legally ham right hai kyun k Unho ne payment nai ki,kia unke pas b koi legally right hai ???? Kindly jawab dijiyega,thanks in advance
