A crime becomes a crime, if the person does it with intent. How could someone prove he intended to do tax fraud if he did for hush payment. You can not have it both ways. A hush payment or NDA not illegal.
You can prove it when you have testimony from people who were in on the scheme and documents that show them carrying out that scheme to defraud.

The name Trump is a brand. Trump has a fortune that rides on that name.
Having, what I would call extortionists threatening to bring down the brand is not acceptable and worthy of hush money.
