Yeah the dive down is called a stoop and they literally tuck to reduce all possible drag,the trick is levelling off to go horizontal, that would put tremendous stress on their wings and it has to be perfectly timed or they smash into the ground. When horizontal they're going well over 100 and with those huge sharp talons no bird stands a chance.
The only bird that can bring down an absolute overgrown eagle I have seen videos of Perigrines trying to mess them up pretty bad Though it's all about the element of surprise with these beautiful falcons

I think what you may be trying to say is that the potential top speed, aerodynamically, might be 400 mph, if the bird were to dive from a high enough altitude and perhaps sweep wings back for minimum drag to reach that speed.
