  • Assalamualaikum, todays topic is “Difference between section 8 and section 9 of the Specific Relief Act 1877”. In the use of section 8 and section 9 of the Specific Relief Act, both are very close in nature though not the same. It’s important to understand their differences and similarities.
    Sec-8 Deals with Recovery of possession of the immovable property.
    Sec-9 Deals with Recovery of possession of immovable property, where dispossessed without in due course of law.
    To sue under sec-8, Order 21, Rule 35 of Code of Civil Procedure, 1908 must be follow.
    Under Sec-9 Summary trial under the Specific Relief Act, 1877.
