It is not a matter of the 1st Amendment. It's that SCOTUS Justices are *supposed* to be impartial and their job is to uphold the law and the Constitution. Can we agree that the peaceful transfer of presidential power falls under both these categories?
And if a SCOTUS Justice finds he/she cannot uphold their duty, has a conflict of interest, or if there is the appearance of a conflict of interest, that Justice is supposed to recuse themselves from connected cases. That is in the Constitution.
Alito and Thomas have both flatly refused to recuse themselves despite clear conflict of interest and appearance of conflict of interest. That is a violation of their oath and a dereliction of their duty.

Imagine Justice Sotomayor flying a LGBTQ flag at her house but still sitting in a case involving an LGBTQ issue. Would you have no opinion on that? Freedom of speech is not freedom from consequences. He has the right to fly the flag upside down, and he and Thomas has the right to associate with billionaires. But judges at every other level of the judiciary would be required to recuse from cases where their impartiality might reasonably be called into question; why aren't the justices of the highest court enforced to maintain the same standards?

It's true...when significant issues come before the scotus that have political implications. Roe, gun control, election question the media target justices they know that are prone to take positions that are constitutional text based . They do it every time any hot button issue comes before the court.
They're corrupt, & we (apparently) have no remedy available to us to employ checks or balances on them whatsoever.

The Courts do not make law. Congress makes law. The Supreme Court determines whether laws made by Congress are Constitutional when a case is brought to them by a citizen of America.

As long as the flag is not permanently attached to the pole, it is not difficult to flip over and fly it upside down.
This is distinct from some of the flags seen in this video, where printed text made it clear the flags were designed to be flown upside down.
The upside down flag represents discourse and/or the camp has fallen from being undersiege. He knew exactly what he was doing.

@billhuff131 married over 30 years, and yes, over matters I feel are important, she supports me to the last, and vice-versa. Of course, that helps explain why we have been married 30+ years where so many others fail.

In the late 50s & 60s to "run it up a flagpole and see who salutes" meant to tentatively present an idea & see whether it receives a favorable reception. The Alito household used political rhetoric to publicly signal their ideas; the gesture is a speech act.
This is such a threat to our democracy. I've actually experienced these red hats first hand and the trauma they cause. They drive around the community with those big American flags waving off the back of their cars while shouting USA and it's absolutely terrifying to experience.
