    thank you for this video! i remember back when i was a high school student and was naive, i tried to call in sick but an awful manager at my min wage job forced me to come in to work at the time... luckily the store owner drove me home and got me free food since she said that the manager wasn't legally allowed to force me to work when i'm sick. know your worker's rights everyone!

    As someone who went from hourly, to salaried, if I ended up working any overtime, the company either made note and paid me as "overtime", or I made note of the amount of extra hours I worked and took them off "in lieu", which just means leaving early some other day (or taking a day off if accumulated 8 hours) to make up for it and get paid for it.

      Thanks for this. My employer hired me with overtime (in the offer) but upon starting told me I had no overtime pay but may be expected to render it anyway. I guess I will do as you mentioned and note down how much actual overtime so I can leave earlier on other days (the boss is allegedly flexible on the hours at the office so it is allegedly output based).

      Make sure that all your overtime is also recorded in a written form, and ideally acknowledged by the employer.
      Additionally, please note that it's a lot more beneficial for the employer to do " in lieu" because they SAVE MONEY on paying you. With overtime, you're enttled to 1.5-2x pay, with. in lieu" they are technically paying you regular wage. It may not matter if you value time off more, of course!

    Thank you ladies for this informative and very important video. As a person who is in the final stages of getting their PR processed, this was very important for me to watch so that I can have an idea of what my rights are going to be. I wasn't quite sure on the difference between a salaried and hourly paid though. Additionally, I would appreciate it if you could guide me into some sort of bridging programs for cloud roles in Toronto as I am looking into those and I found very little. It would be awesome if they could be available for someone who already has the Pre-Arrival services document but hasn't landed yet. Much love from Saudi Arabia.

    😎it all looks great, but it's not for truck drivers, it's different, they simply have to work hard for 70 hours a week, 14 hours a day, also on weekends, they have to go away on holidays, they have to go away and nothing works here!
    Can you dig deeper and make a similar film but for truck drivers and see how different these regulations are

    Please answer this question. Once I worked at a company for 8 months, and they fired me without notice and said I could apply for EI, which I did but never paid me anything for not giving me a notice. Also, in my other job, they also let me go but they paid me for not giving me a notice because usually two weeks' notice is required, or else the employer must pay. Why did you think the first employer did not pay me even though he did not give me a notice?

      Hi, you’d have to check your contract to review your termination clauses. If what’s happened doesn’t respect your termination clauses, you’d have to file a complaint to the labour board in your province.

    The problem is I have been harassed at work by both my colleagues and my manager, and even if had reported it, they would have sided with those who worked there before me so I'm at a loss here. 😢 What can we do in this situation when a person harassing you has more authority than you?

    Hi
    I work 2 months, and then my employer terminated me. I join as a cook but he put on me other task. When i ask, it's not my jobs i join here as cook, and then he said dont come duty. And one day he give me termination paper.
    In this case, what should i do?

      Depending on your contract, there’s typically a probation period between 3-6 months. Employer has the right to terminate employees without notice , employees can also leave without notice.

    I think you have underplayed one of the largest loopholes in Canadian work force.
    That’s the hiring company. These Companies are hired by major employers because it allows them to skirt the Canadian Labour Code.
    Simply put. You are not employed by the Company. But by the hiring Company. Which allows Companies to fill jobs. Without establishing a probationary period.
    So it could be 3 months. Could be 6 months. A year. Then they could just decide they don’t like you and end your employment with them.
    Because technically you are employed by the hiring Company.
    There are a lot of things to navigate in the work force. This is one.
    You think you have an understanding of it. Then you get into Union Contracts. Then Arbitration.
    Which Acts take precedent.
    The difference between the Green Labour Book. And the Pink Labour Book.
    Then of course. The pocket green book. Which is the O.H.S.A.
    Nice video. However you barely scratched the surface.

    Also, everyone who is reading this, try to work at a unionized work place. Having worked in manu different places, without a doubt, unionized work places are so much better for your health and work life balance, and general work environment. Also, getting involved in a union can really improve your work experience and make your workplace even better.

    great on paper rights. but not much on the things to watch out for with shady employers. for example hr is there to protect company from employee not for benefit of employee. also remember to set acceptable or low standards so you show growth overtime. otherwise the high output will become base standard. employers don't care you are feeling down or had a dr. appointment. so if you give yourself extra time to recoup after busy days. remember also to avoid doing more than 40h when on salary. employers love to abuse unpaid ot if you let them

    Thanks fro the content! I was verbally offered a hybrid work option during the job interview, which was also extended to one of my colleagues. After accepting the offer and completing my probation period, my manager initially approved my request. However, after two days of working from home, he asked me to return full-time to the office citing software issues and rejected my request for hybrid work. Meanwhile, all other team members are still working from home. Do you think this is something I can legally pursue?

      That must be frustrating. Do you think your manager's justifications are valid? If hybrid work was ONLY discussed verbally, and never in the written form, it might be hard to do anything about. Double check your contract. Secondly, I would talk to the manager human to human and try to understand the real reasoning why they're rejecting hybrid work, maybe it's something both of you can work out together over time. It could have something to do with trust or communication issues they've run into when you've worked remotely. Have an open conversation about it!

      @@MakeThatChange Thanks for your reply! I don't think his justification is valid plus we have hybrid work policy and already 8 people on my team are working remotely! I checked one my colleage job description and did not find hybrid work option on that neither.

      You’re welcome! Talk to them and ask them what needs to be true for them to become comfortable to let you work hybrid. There must be an agreement you two could get to. All the best.

      Uber drivers are considered independent contractors (under Ontario's employment standards act)

    Why Uber company not covering any of this law… I am a Uber driver customer made a dent on my car but Uber refused to pay for the damage even I went to pick their customer

    My employer didn't give my my offer latter, and everyday giving pressure in my head,
    Telling that he can fire or he will send me home back .
    Working environment also very bad .

    My supervisor kept calling me last couple of days after work telling me to step down since I called in sick couple of days last time my aunt died and the same day after hours supervisor called and told me to step down. I asked him am I being fired and he said no but you missed training and cannot catch up so it’s better I quit and apply when I get better instead of being fired. Very strange situation

      This is not nice, if you voluntarily step down, you lose any protections you might have, including EI if you need it. Don’t ever agree to quit if employer asks you, they should lay you off properly (not fire, because there’s no real cause) if they really want to.

    All my life, here in México i has the obstacle with employers to get a copy of my employment agreement. For disgrace México is not rule of law country. I will arrive there as international student soon. There in Canada is normal to get a copy of your employment agreement? Or literally it depends a lot of the employer?.
    Also, here is practically a miracle to get a permanent position. Generally the employers hire you like "independent service provider" to avoid to pay the benefits that correspond by law. There in Canada how it works? Is common to get a permanent contract? Or also is the same case?

      Everyone in Canada gets a copy of employment agreement, since both you and the employer must sign in and legally hold a copy.
      As for permanent vs contract work - it depends on the employer, but full time permanent is rather common for most jobs you see published online. Contract work is not uncommon either, depending on type of work you do, but it has a number of advantages for you and the employer.

      When you’re employee on payroll, your employer is required to deduct EI payments. Should you lose the job ( not at your own fault), then the government can support you with payments up to about half of your last salary.

      Reference letters are typically individual and not mandatory for the employer to issue. Typically we recommend to reach out to your manager or HR individually to request a letter when your future employer asks for it.
