Nintendo vs. Galoob Game Genie Lawsuit 1992 Exhibit F: Peripheral Misuse

  • (Warning: Rapid flashing images.) This is a VHS tape that was prepared by Galoob and submitted as evidence in its defense against the Game Genie lawsuit brought by Nintendo in 1992.
    Many details about the Game Genie case are not available online, so most people are not aware that the NES Advantage joystick played a huge role in the proceedings. As explained to the court in this video, the Advantage could make games easier, harder or even impossible to play, which made Nintendo seem hypocritical after it had objected to the Game Genie doing these same things.
    Later, after the court ruled in favor of Galoob, sales figures for the Advantage were used to estimate the amount of revenue that Galoob lost when Nintendo filed an injunction to prevent the Game Genie from being sold. The damages awarded were based on the market penetration that the Advantage had achieved!

    I was an Expert Witness for Galoob in this Trial, and I’d never seen this before. Very cool find!

    The first time i played super mario 2, i spent 20 minutes trying to figure out what to do because i didn't want to fall off the edge and die.

      I first tried the Slow button on the NES Advantage in Super Mario Brothers 2, but it didn't work very well because it kept switching to that level page screen!

    8:19 that's actually STANLEY! Just saying if they're gonna use this in court they might wanna have all their information correct. However they did highlight a fatal flaw with the Advantage joystick and why slow-motion won't always work.

    That slow motion button on the NES Advantage is annoying to me. But I don't use it for my NES Advantage.

    The big difference between the NES Advantage and the Game Genie, however, is that one exists to mess with inputs and be an arcade-style controller, and the other messes with software. Somebody didn't learn that the "Slo-Mo" setting merely rapidly presses the Start Button over and over, and that the Turbo buttons do the same with their respective buttons. It's kind of the point behind the NES Advantage. You're supposed to mix and match the settings, especially in games like Bucky O'Hare, where you have to shoot a lot, and the special abilities are limited to holding the Shoot button, and that game is very finicky about it.
    ...either that, or Galoob already knew that, and thought the court could be easily misled, like with that Night Trap case.
    Also, anyone can cherry-pick games. This was made in 1992, when half the NES library was already non-subject to the same standards and practices they had in the '90s and possibly late '80s, and they're cherry-picking games from the mid-'80s. The only one made in the '90s here is Batman, and they intentionally went to the second level, skipping their copyright nonsense they've been spewing.
    Of course, thanks to this case, now we can't speed past title screens, starting with the SNES. Nice going, Galoob. :/
    Also, 11:58 "Now I will play The Legend of Zelda." ...and totally misses the Sword on the first screen. Also, the name-registering thing was skipped, and you should be stuck there instead of on the world map.
    17:38 The whole point this video was trying to make to the court. Yes, any tool CAN produce undesired effects if used incorrectly, including the internet. That doesn't mean any tool should. However, as a game designer, I have to cry Objection to that gamers expect odd things to happen. If odd things are supposed to happen, they expect it. If it's something like a character flying when they shouldn't, they'll call it out. Players actually do have an expectation of works-as-intended. If things don't seem to work as intended, players will complain. Also, why do you think the AVGN exists now?

      personally i think it's more of a content warning. though I guess technically flashes are something that "triggers" seizures, they aren't "triggers" in the usual clinical sense of the word idk
