      Earlier this month, Senator Chuck Grassley (R-Iowa) introduced S.J. Res. 94, a Congressional Review Act (CRA) resolution to overturn the Biden administration’s Unaccompanied Children Program Foundational Rule. The CRA resolution initiates the congressional disapproval procedure that would prevent the Biden rule from going into effect. Without congressional intervention, the rule becomes effective July 1, 2024.
      The final rule from the Biden administration concerns the Flores Settlement Agreement. The Flores Settlement Agreement, signed in 1997, requires the government to release children “without unnecessary delay” to: (1) parents; (2) legal guardians; (3) other adult relatives; (4) other adults designated by parents/guardians; (5) a “licensed program” willing to accept custody; or (6) any other adult or entity that wants custody if there is no other alternative. Unfortunately, rather than eliminating incentives for unaccompanied alien children (UACs) to enter the country illegally, the new rule reinforces incentives for minors to migrate illegally while failing to put in place safeguards to protect them.
