Does anyone else find these videos super helpful but each person for the most part except for Joe at Prep Agent reminds me of Alex Tribek Spell - HAHA he is reading the answers but delivers them as he already knows.. - cracks me up!!!
Dual agency is possible in NYC if disclosure is provided to both parties And agreed upon by the client. So my question is by saying it results in conflict of interest which would violate fiduciary duties. Please elaborate.
Dual agency will only become a conflict of interest when it is done without the consent of both parties. It is completely legal in New York and can be ethically done, but you need to have both parties agree to be represented by the same agent. This question makes dual agency more confusing than what it needs to be. Hope this clarifies things for you! Let me know if you have more questions.

I thought the same, but it is because the question did not specify "consensual dual agency" is why it is a conflict of interest.
Bob, I did not think a mortgage broker could approve a loan? I thought that is beyond their scope?
I think the answer should be the mortgage banker and not the mortgage broker.
