I think you could only get him on a misdemeanor impersonation because he only said he was an FBI agent but had nothing else to indicate he was actually impersonating a federal agent. If he had a badge, then I believe it could be a felony. There's a video on UA-cam of a dude impersonating a US Marshal with a badge and all at some store and the police tell him it's a felony, so that's what I'm using as a basis for my thoughts.
