You said the Tenn code was more liberal than common law, but wouldn't labeling an act as an attempt further from its expected commission make it less liberal? Wasn't the defendant arguing that Tenn purposely omitted part of the MPC that defined a substantial step when writing their own very similar code? Thank you.
