Don't File For A Patent Too Soon!

  • So if you think you need to rush out and protect your invention, don’t make the mistake of filing for a patent too soon. One of the biggest intellectual property problems for startups is filing patent applications too soon and setting themselves up for massive costs before they are ready for them and creating unnecessary risk for the company. Instead, wait until just before you start making public discloses, public uses, offers for sale or pitches to investors.

    How could it be too soon? It takes 3 years for it to be granted. Wouldn't having a patent be better than not having one? Better to have a fence around something to keep people off of your property. If they want to try to steal it, let them spend the money to do it.

      It's counter-intuitive, but I see filing to early being an issue way more often than filing too late.       Thank you. My idea is one of those too obvious solutions to a problem. I suppose if after production I get feedback and need to change it, I can just file a provisional patent again. At that point I should have a pretty good brand If I go with high quality construction. I also just realized that you get patent pending status after you file the utility patent. Thanks for your feedback. It's super helpful and I understand it.
